Duality of the legal regulation of a dominant position in EU competition law

Résumé The presented work addresses the issue of the double-tracking nature of a dominant position in European competition law. The aim of the integration efforts during the establishment of the EU was the creation of an internal market, especially the customs union. In order to achieve this state, it was necessary to take a number of integration measures and create a legal framework, i.e. conditions, under which economic competition in the internal market could operate effectively. In this context a variety of legislation valid for the whole EU territory has been accepted. However, in the context of the economic competition this work analyzes the legislation on market dominance carried out first in Article 102 of TFEU (Treaty on the Functioning of the European Union) prohibiting restrictive business practices in the form of abuse of a dominant position and also in Council Regulation (EEC) No 4064/89 and later in Council Regulation (EC) No 139/2004 regulating the control of concentrations between undertakings. In case of both the legislations the crucial question is the "dominant position" of an enterprise in the market, while Article 102 of TFEU represents the ex post control, i.e. applies only to the possible abuse of the dominant position, and in this sense the dominant position itself is not the...

Comparison of impacts of oil crisis in 70´s on USA automotive industry

The main objective of this work is to prove the hypothesis that the oil shock of the year 1979 didn't have a negative impacts on the US automotive industry. Solution of this hypothesis is not found in the period of the second oil shock, but in the years 1973 and 1974, when the first oil crisis broked out. As a result of its development the United Sta-tes Government was forced to take a number of measures to mitigate their impacts. The-se administrative measures touched not only consumers, but also the energy industry. Using the government's measures laws regulating driving conditions on roads were mo-dified, technological innovations in the automotive industry were financially supported, oil supplies were diversified, an attempt to increase domestic mining was carried out, prices of oil products were regulated. However, those measures couldn't fully manifest in the second oil crisis, because they haven't been completed or haven't worked. The automotive industry had to adapt to new trends and customer requirements for cars with lower fuel consumption and it invested billions of dollars in new technology in the mid 70s. Other changes have taken place in the production and sales strategies to prevent or largely eliminate the sharp falls in sales and production.

Economical criminal acts in Spanish law

This bachelor thesis is about economical criminal acts in Spanish law and is divided into three parts. The first part describes basics of Spanish Criminal law, where some basic key words are explained, as well as the common features of economical criminal acts. In the second chapter differences between Czech and Spanish Criminal law are explained. There is also mention of the European Convention on Mutual Assistance in Criminal Matters and how it works. The final chapter is divided into two parts. The first part describes the results of analysis on Economical criminal acts worldwide that was carried out by PricewaterhouseCoopers and is concentrated on Spain. The second part of the last chapter is dedicated to analysis of Criminal law in the case of corruption and money laundering that the family of Jordi Pujol is guilty off.

Students’ Motivation for Working during Study at University

The Bachelor Thesis deals with the issues of job motivation of university students. In the first part, there are described the basic terminology connected with motivation as well as the key stimulation tools affecting the employees at work. Next the types of labour-law relations, their advantages and differences are stated. The practical part is based on the questionnaire survey carried out among the university students. The survey results are compared with ones of the expertized research. The thesis examines this problem even from the employers' point of view and describes how students are approached by the international company IBM. The thesis aim is focused on the determination of differences in job motivation among the university students of different specializations, the analysis of working opportunities and their use by current students.

FOUNDATIONS SUPPORTING CULTURE

This bachelor thesis on topic Foundations supporting culture was from its beginnings realised with a vision to fulfill several targets. The first one is to simply describe foundation function, as majority of the Czech population agrees with the existence of such non-profit organizations; however they do not know how they work. This fact was confirmed also by a survey carried out during the process of information gathering. The thesis is enriched by another point of view where selected foundations are divided into two categories depending on the way they are financed. The first group is named ?private? foundations, second one ?corporate? foundations. Particular chapters deal with the origins of the word ?foundation?, followed by its history and law in force governing the rules up to concrete examples of well functioning foundations in the sphere of culture. I believe that the thesis Foundations supporting culture will be beneficial to future readers and will enable them to understand the basic principles of foundations and the way they function.

Overview and comparison of Oracle database system administration tools

The aim of this work was to create an overview of applications suitable for the administration of Oracle database system and then to compare these applications. Another aim, which is directly linked to the previous, was to test these instruments in acts carried out by the database administrator. This work compares the tools from different aspects, such as graphic design, lucidity, functionality and price. Reader can make an idea of what tools can be used for administration of Oracle database system and how the different instruments work. If the reader is interested in the purchasing of such tools, this work can give him the recommendation based on the comparison.

The importance of economic factors in reasons of commiting suicides focused on czech citizens aged 15-24 (2015)

Bachelor thesis deals with social-pathological phenomenon of suicide. Due to the broad range of the topic, the scope of this work is reduced to the view of high schools and universities students. The main objective of this work is to determine whether young people hold the opinion that a free man who has the right to life should also have the right to die discretionary. Also whether they have ever thought about suicide as a solution of negative economic factors. Finally, compare the difference in opinions on the issue of students from high schools and universities in different years of study and not studying respondents. The theoretical part, which deals mainly with economic factors and the cost of suicide and the practical part where I carry out own research, where I try using the questionnaire to find out the importance of economic factors for respondents. The research says that the economic factors are very important even for students and that there is possibility they would thing about suicide due to these factors.

Sleep disorder as a nursing diagnosis

This bachelor's work deals with somnipathy as a nursing diagnosis. This topic has been current problem for many hospitalized patients. This bachelor's work is divided into the following two parts: theoretical part and empiric part. The theoretical part deals with sleep as such, specifying its phases, factors affecting sleep, identifies individual sleep disorders, sleep diagnosis and its therapy, which is divided to the following two: pharmacological and non-pharmacological. As last but not least the theoretical part deals with nursing process and its phases with regard to a patient who was diagnosed nursing somnipathy. In the empiric part the following goal has been set. The aim has been to find out specific items of nursing within the scope of nursing somnipathy diagnosis with patients. The following two research questions have been set meeting the goal: 1. What are the specific things of nursing care within nursing diagnosis of somnipathy with patients? 2. What are sleeping troubles solved by nurses who are the integral part of our research group? For the purpose of elaboration of the empiric part of the work it was the qualitative examination that was used. Data acquisition was performed by semi-structured interviews. Standard questions were expanded when necessary by using supplemental questions. The research itself took place in Neurological and Gynecological-Maternity Ward of the Hospital of the City of České Budějovice, The chief nurse of the aforementioned hospital was approached beforehand and asked for permission. Both workplaces were submitted both prepared intended topics and questions for their consideration, the whole group of respondents consisted of 12 respondents of which there were 6 nurses working in Neurological and Gynecological-Maternity Ward of the Hospital of the City of České Budějovice and 6 patients hospitalized in the ward. S far as the patients are concerned it is important to mention that these patients were diagnosed nursing somnipathy and of course the nurses were those who diagnosed the somnipathy. In the very beginning of interviewing all respondents were informed about the purpose of the research and assured that everything in connection with the research was anonymous and all pieces of information gained should be used only for this bachelor's work. At the same time i.e. at the very beginning all respondents were informed about the purpose and basis of the research examinations to be carried out. To types of interviews were applied one for nurses and the other for patients. The results achieved in these research examinations are compared with the same or similar results published in professional literature and of course discussed. The results can be summarized as follows. The nurses for their patients perform the following measures taken to improve quality of sleep for their patients: airing the patient's rooms, making their beds, keeping their eyes on observing night silence and assistance with evening hygiene. Majority of the patients interviewed were informed about the measures to be taken for improving the quality of sleep and they showed positive attitude resulting in positive effect. All of the interviewed were satisfied with nursing care provided in last two days. Moreover the tables in the case reports show that the nurses were solving the following problem regarding the patients sleep: the problem arising from falling asleep and frequent waking up during the night. The knowledge that I have gained by elaborating this bachelor's work I will do my best to make use of it in my future work as a nurse. The results can be used by students as a basis for elaborating their works and higher level of nurse information regarding the problems of somnipathy of the hospitalized patients. Furthermore the results may be used as a feedback for the hospital itself in which the research work has been performed.

Owertime work and entitlements implications

The content of the thesis of the topic Overtime work and entitlements implications consist of two parts. The theoretical part definesbasic concepts related to employment, overtime, service and overtime services. The significant related law regulations are reminded. In the practical part is consequently made an analysis carried out by interview with members of the security forces and theother equally important aspects related the issue of service relationship. The following is the synthesis and the explanation of the research results. At the end of this thesis are summarized proposals for invidual depertments, which participated in the survey, to eliminate misconductand increase the knowledge of the members, and also alerts to Nezávislý odborový svaz Policie České republiky.

Application of project management methods in public administration

This thesis entitled "Application of project management methods in public administration" handles real project, which will be held in public administration, with the help of project management. The work describes what steps must be pursued must perform in order to make the investment plan, in this case, the construction of a new building that will serve as the sponsor registry. The first part focuses on the explanation of the concepts of project management, dealing with specifying what the different terms mean and how they can be used in a practical direction. Along with these concepts also deals with the methods and principles that are used in project management. These include STEP analysis, which looks at what the external environment surrounding the subject and SWOT analysis, which in turn monitors the internal environment of the body. The work is also used and critical path method called. CPM and created hierarchical structure of WBS activity. The thesis also analyzes risk situations and procurement procedures and their financial value. The theoretical part serves as a basis for practical work. The second part is focused on practical use of knowledge, which are described in the theoretical part. There is described by the entity itself, which will carry out the investment plan and what needs to prepare and arrange before the project will be successfully completed. STEP analysis and SWOT are the practical part applied to a particular subject and their conclusions are then made the decision that the construction is necessary or not. Other methods, ie. critical path method, hierarchical structure, operations and risk analysis methods are no longer aimed at the very beginning and the realization of the investment project. This summary is presented in the final part.
