Work safety in the construction industry with a focus on accidents at work

The aim of the thesis is to approach the issues of health and safety at work and work-related accidents in the construction industry. The theoretical part is devoted to the historical development of occupational health and safety in general, and consequently the development of inspection bodies operating in this area at present. Then there is also handled accident statistics for 2012. The practical part is a form of treatment for specific health and safety plan construction contract with a subsequent risk analysis.
Safety and the risks of working in the construction and their evaluation

The aim of the thesis is to introduce the issue of occupational health and safety in the construction industry with a focus on work accidents. The techniques and methods used in searching and rating of hazard, basic legislation on occupational health and safety and work accidents are described in this thesis. Simultaneously the statistics of work injuries for 2015 are compared in four selected construction companies in the Czech Republic. Also the sources and causes of work accidents in surveyed construction companies are analyzed and then on the based this analysis I suggest preventive measures against the most common sources and causes.

The employer's obligation to compensate for the damage caused to the employee Abstract In the submitted dissertation, the author deals with the topic of the employer's obligation to compensate for the damage caused to the employee. This issue is highly actual, as in the past there have arised, and these days still continue to arise new and new connected questions to discuss, and sometimes the re-opening of questions that have already been settled occurs as well. At the same time, it is also a common-sense oriented topic, as almost every employer has at some point been in a position where they were forced to fulfil this legal obligation towards their employee. Within the scope of this dissertation, fundamental attention is devoted to the analysis of individual types of the employer's liability for damage caused to the employee and to a critical insight into the complexity of their legal provisions and their real usability. International comparisons are also provided in places, where it is appropriate and useful. A number of concrete suggestions de lege ferenda are also provided. The topic of this thesis is employee's claims in the case of work accidents or occupational diseases, because the assessment and determination of damages is still an actual issue. The first part of the thesis deals with theoretical introduction and definition of terms which are material for the whole thesis. The first part defines the liability in labour law, the liability of employee and employer, work accidents and occupational diseases and mainly the employer's liability for damages and non-material damage caused by work accidents or occupational diseases to employees. The next chapter focuses on insurance which is obligatory for all employers who employ at least one employee. This insurance is important in case of the employer becomes liable for damage or non-material damage caused by work accidents or occupational diseases. The insurance is important especially for small and medium-sized employers for whom the compensation could be liquidating and could lead to the termination of their activities. Qualified persons in the field of occupational risks Abstract Qualified persons in the field of occupational risks are persons dealing with different levels of risk, different extent and type of risks. In this set is not only the person for health and safety, but there are other qualified persons as well. For example, a qualified person who provides and performs the ccupational health services, a qualified person for fire protection, a construction safety coordinator, as well as an inspection technician of dedicated technical equipment, etc. A key qualified person in occupational risk and health and safety prevention is a person who assist employers in occupational risk prevention by managing risk identification, providing risk assesments, identification of source and risks causes and incidents. Thesis Title: Occupational Health and Safety with Focus on Atypical Forms of Employment The thesis aims to analyse and present the rules of occupational health and safety (OHS). The second goal of the thesis is the research of OHS solutions in atypical forms of employments with regard to current development of working relationships. The thesis also deals with the question of atypical forms of employment and the ensuring of OHS in Germany (GER). The collected information is used for comparison and evaluation of both countries and their attitudes toward OHS in atypical forms of employment. Part of the thesis is also devoted to possible course of OHS in the atypical forms of employment de lege ferenda including potential inspiration from GER in connection with ensuring of OHS. The thesis is mainly based on study of laws, relevant literature, comments and current articles. In the thesis, the descriptive and analytical method are used and at the end supplemented by the comparative one. The thesis is divided into six chapters that are split systematically into subchapters. Compensation for damage and non-material damage caused by a work accident

The diploma thesis deals with the issue of damage and non-material damage caused by work accidents. The first chapter describes the basic concept of legal liability and main functions of the employer's liability for damage caused to employees. The second chapter focuses on the basic assumptions, fulfilment of which creates an obligation for the employer to compensate employees for damage and non-material damage. It also describes the work accident as a legal term and discusses specific situations such as a heart-attack, a work injury during team-building or a work injury during a business trip using interpretation based, in particular, on a review of Czech case law. The employer is not always obliged to compensate employees for damage and non-material damage. Situations in which the employer is released from the obligation to pay damages and non-material damage are described at the end of the second chapter. These situations include violation of legal regulations or instructions, drunkenness or misuse of addictive substances and, last but not least, reckless behaviour of an employee. Compensation for the bereaved in the case of work accidents and occupational diseases Abstract The topic of my diploma thesis is compensation for the bereaved in the case of work accidents and occupational diseases. It is a topic with a relatively settled legislation and a subject which is present - nevertheless, ground-breaking changes in this issue cannot be really anticipated any more. Introductory part of my thesis deals primarily with a theoretical definition of a term liability and liability in labor law. It deals with the conditions of inception of liability, the reasons that allow release from liability and finally, with the obligation of an employer to compensate damages or non-material damage in the cases of work accidents and occupational diseases. Name of the diploma thesis in English: Compensation for detriments of accidents at work in terms of practice and judicature This diploma thesis deals with the topic of compensation for detriments caused to employees by an accident at work. Diploma elaborates the quoted topic with respect to the legislation in force in December 2018 and reflects the plentiful jurisprudence related to the subject.
