Recognition in the Investigation of Crime

(in English): The thesis " Recognition in the investigation of crime" is studies the interaction and communication of criminal proceeding participants and its influence on the quality of those proceedings on recognition. The theoretical part deals with criminal proceedings such as all the trial requirements and factors which affect police investigation. Rights and responsibilities of all participants of trials are defined. Furthermore, communication, its types and categories and -most of all -its impact on successful police interrogation is examined. In conclusion of the theoretical part we describe the aspects which control the investigation and potential offender recognition. In the empirical part the aim was to find out what impact the quality of instructions has on successful offender recognition in simultaneous and combined format. The empirical part was performed in an experiment. The research participants were devided into categories according to chosen standards. Then they were presented with a video recording of a criminal offence followed by recognition. We targeted at discovering whether the instructions and the way they are given influence the results of recognition.
Specificity of interrogation of children

My thesis is focused on the interrogation of children, who are in the position of victim or witness. Statement of a child as well as an adult may serve as the significant evidence within the criminal proceeding. During this challenging action, which the interrogation of child certainly is, many specificities and difficulties are involved. These specificities and difficulties distinguish an interrogation of a child from an interrogation of an adult. In the first part I described the term "interrogation", in particular general grounds of it. To reveal specificities and difficulties of the interrogation of children, it is necessary to become familiar with the interrogation in its traditional form. In the parts of my thesis, where I wrote about a child, it shall be considered that the term "child" has the meaning as stated in the Convention on the Rights of the Child, i.e. every human being under eighteen years of age. I consider the chapter dedicated to the assurance of any statement of child to be one of the fundamental chapters. In opposition to the past ages there is a major believe within the modern society that children are capable of giving as quality statement as adults. Methodology of investigation of sexual offences Key words: child abuse, investigation, examination Summary This diploma thesis deals with issues in investigation of sexual crimes, particularly child sexual abuse. Sexual criminality is a very extensive topic, so I decided to aim the thesis for specifics of investigation related to abused children. The aim of the work is to characterise investigation regarding specifics typical for sexual offences. There is difference between adult and child victims. This must be considered in the process of investigation. Each person taking part in investigation should have achieved at least basic course in psychology. It is necessary to apply considerate approach to restrain from secondary victimization. The first chapter describes the term of sexual abuse, fundamental definitions and forms. Current legal regulations in the Czech Republic are analyzed there. The second part is devoted to criminological characteristics. This chapter is about offenders, victims and typical ways of commission. The thesis is devided into chapters and sections and it deals with the specifics of the child interrogation. The aim of the thesis is to explain the specifics of the interrogation of a child in the criminal proceedings and to explain the main differences between child interrogation and adult interrogation as well as the general approach of an interrogator to a child being a party to the criminal proceedings - particularly being a witness. The aim of the thesis is also to explain the methods of using demonstration aids while interrogating a child. First, it is necessary to define the interrogation itself. Several chosen terms are explained in one of the first sections of the thesis. These terms demonstrate different positions of a child as a party to a criminal proceedings. This section contains also interpretations of particular law regulations. The Specifics of Children Interrogation Summary The diploma thesis deals with interrogation of children, which means person under 18 years old, as witnesses, or even victims of crimes. The interrogation of child witnesses should be approached with special care, as children are very vulnerable to their unfinished mental and psychological development and have a higher risk of secondary victimization. The graduate aims to provide the reader with a comprehensive set of information on the issue of questioning child witnesses. The issue has an interdisciplinary character, so the work contains criminal, forensic, psychological, and victimological knowledge. At the same time, on the basis of research and interviews with police officers and social workers, the graduate evaluates the legal regulation and interrogation practice, identifies shortcomings and tries to present possibilities for their solution. The Specifics of Interrogation of Children Abstract The diploma thesis focuses on the specifisc of interrogation of children. According to the thesis, children are persons under the age of eighteen. It is imaginary divided into three parts, because this topic can be viewed from the perspective of criminal law, criminalistics and psychology. It is divided into seven chapters. The Specifics of Children Interrogation Abstract This diploma thesis deals with the interrogation of children in criminal proceedings, with a focus on the specifics that are characteristic of it. The aim of the thesis is to provide a comprehensive overview of this issue at all levels - legal, psychological, as well as criminal, and to allow better understanding of its whole essence. In this introduction, the thesis focuses on the legal standpoint, in which it introduces the basic terms and outlines the current state of legislation in the Czech Republic. Then, it moves continuously to the psychological-criminal standpoint, where it reaches the point of its content - the specifics that may arise in connection with the interrogation of children. The thesis views these specifics from two different angles. From a psychological point of view, it enables to understand the complexity of a child's personality, which must always be taken into account during the interrogation. The diploma thesis deals with psychological aspects of interrogation. The aim of the thesis is to describe general psychological aspects of interrogation, contained in scientific publications in comparison to practical knowledge, gathered by experienced police detectives. The thesis covers both psychological aspects of interrogated person as well as the interrogator. The thesis is comprised of four parts, each divided into chapters and subchapters. In the first part, the focus of the thesis is on testimony, its creation and above all verifying its credibility, as the primary aim of an interrogation is to achieve a complete and credible testimony. In the thesis, there are mentioned psychological methods how to achieve such a testimony, and at the same time how to avoid psychological errors of the investigator. The core of the thesis is dedicated to the topic of psychology of interrogation.
