Dissertation: The Role and Activities of Employee Representatives in Labour Relations Author: Mgr. Aneta Průšová The subject matter of this dissertation is the analysis of the role and activities of individual employee representatives in labour relations according to the Czech legal order. The first aim of the dissertation is to find out and identify the similarities and differences between employee representatives with regard to their legal status under Czech labour law. The second aim of the dissertation is then to analyse the mutual interaction between employee representatives carrying out the activities at the same employer, including the scope of tasks that employee representatives can perform in promoting and protecting the economic and social interests of employees. The results of the research mentioned above, are used to verify the fundamental hypothesis of the dissertation that trade unions have a privileged position among other employee representatives. The dissertation also describes the causes and consequences of the given position of trade unions and compares the position of trade unions with the position of other employee representatives. Trade union plurality at an employer Abstract In this thesis I deal with the issue of trade union plurality at an employer. In the thesis I describe the role of trade unions and the development of the legal regulation of their plurality. In doing so, I analyse the conclusions of the Constitutional Court expressed in the ruling Pl. ÚS 83/06 and its implications for current and possible future legislation. I also describe the problematic aspects of the current legislation in this area. These problems concern both the representation of non-unionised employees in individual matters and, in particular, collective bargaining. The aim of the thesis was to try to suggest possible options for solving the current unsatisfactory state of the legislation. The thesis analyses three basic options for dealing with trade union plurality in the context of collective bargaining. These are the introduction of the majority principle in some form, the involvement of employees by way of voting, and allowing for the existence of multiple collective agreements at a single employer. Changing the conditions for starting of functioning of a trade union at an employer is mentioned as an additional option. The Role of Trade Unions in Protecting Employees' Interests

The main goal of this thesis is the description of the activities executed by trade unions. Trade unions represent an important aspect of labor relations and can have a crucial influence on working conditions. The legislation of the Czech Republic lacks a comprehensive legal regulation regarding trade unions, which leads to general confusion. One of the points of focus of this work is the exploration of the general opinion of employees on trade unions and its comparison with their actual scope. Questionnaires together with controlled interviews with employers and unionists are used as the main source of information. The results of this thesis show that the majority of employees perceive trade unions positively, even though they cannot characterize their activities. The outcomes also point to the importance of work safety as one of the main interests of the unionists as well as the impact of economic trends on collective bargaining.
Labour law changes after the entry of the Czech Republic into the EU

The aim of my bachelor{\crq}s thesis was to find out changes in the Czech labour law and labour relations between employees, employers and trade unions caused by the accession of the Czech Republic to the European Union. I focused on the EC directives that had to be implemented into the Czech judicial code because of the compatibility with the EC law. I focused on the mediation of employment abroad by Czech employment bureau for Czech workers in practical part of my thesis.
Trade unions in the media discussion on coronavirus: a comparative analysis of the discussion in the Czech Republic and Russia

This paper provides a comparative analysis of the first year of the media debate on coronavirus involving trade unions. An analysis of the media debate reveals the position and role of trade unions both on the subject of coronavirus and in society in general. We chose trade unions in Russia and the Czech Republic for comparison. We analysed the discussion in Russian and Czech media sources. The findings of the content and network analysis are complemented by the results of interviews with trade union members in Russia and the Czech Republic. The study highlights the bargaining and deliberative role of trade unions in the Czech Republic, which tend to act in concert. However, in Russia the division between traditional and alternative unions has become even more pronounced during the pandemic. The study shows that traditional and alternative trade unions have different methods and approaches to dealing with situations and bargaining in tripartite contracts. In both the Czech and Russian discussions, there is a model of biocommunicability - public sphere. The model assumes that information about health is useful because it facilitates collective decision-making about public interest, where both citizens and policy makers make decisions. This dissertation is presented within the doctoral study on the Charles University in Prague, Faculty of Law. The presented dissertation addresses the issue of the status and activity of trade unions in labour relations. The dissertation deals with the conditions for legal foundation and creation of trade unions, the conditions for their operation at an employer, their organisational structure, the conditions for the dissolution and disbanding of trade unions. The dissertation is also devoted on the questions of plurality of trade unions, as well as the questions of jurisdiction and powers of trade unions in labour relations, focusing on the right of collective bargaining and the right to conclude collective agreements. The dissertation also deals with the collective labour disputes and the various methods of their resolving, focusing on the right to strike as an extreme means for resolving a collective dispute. The Social and Political Regulation of Labour Migration: The Case of the Czech Republic

This dissertation is about the changes in the regulation of labour migration in the Czech Republic, specifically between the period of economic boom in 2007 and 2008 and the beginning of the global economic and financial crisis. The developments of labour migration processes and policies were studied in relation to the political economy of foreign direct investment and the rise of the competition state in the Czech Republic. The materialisation of these developments resulted in the Czech Republic's further integration into the global labour market. Labour migration policy changes in the case of the Green Card project, however, did not confirm the thesis that the Czech Republic's migration policy eventually became subordinated to the competition state project. Not only did the Ministry of Industry and Trade lack bureaucratic capital in the field of migration regulation but also, there were tensions between different notions of the competition state project while 'migration management' was reorganised in the interest of the Ministry of the Interior. Trade unions organizations in employment relations The thesis deals with trade union organization as the most important representative of employees in collective employment relations. The purpose of this thesis is to describe a task of trade union organization as a legal subject from the view of legal theory, as well as from the view of contemporary legal regulation which has recently been substantially changed due to the recodification of private law. These contemporary amendments change a status of trade union organization as a legal person. These amendments have been followed by many interpretative difficulties. The thesis further describes activities and rights of trade unions as a subject with regard to first, the last amendments in legislation and second, the current jurisprudence.
