The relationship between the state and church in the post-war history of Czechoslovak and Czech nationhood. A comparison of the legal status of churches under the Communist regime and today

Resume The goal of this paper is to describe the situation of churches and religious societies with respect to the legal system, through the changes that affected the Czech legal systém throughout the recent half of the century. Because it is impossible to fully deal with the entirety of the history of state and law over the century, it will focus on the developments during the totalitarian regime of the Communist party and on the results thereof. The main goal is therefore to make a comparison, this will be a comparativistic endeavor, and there will not only statutes and legal documents be described, but also the practical applications of these statutes and documents, and there will be focus on theoretical and constitutional basis behind the laws. Unfortunately, with the constrains of the current format, it is impossible to fully describe even one era of Czech statehood, therefore there will be an arbitrary selection of topics on which the facts will be demonstrated and from which they will be extrapolated. The other topics will only be adressed to in a general manner. Also, it is not possible to include in full the divergent approaches of law towards the various individual churches. Some of those differences can be shown, in part, but not all of them, fully. The paper therefore needs to focus of one...
Establishment of the State Bureau of Church Affairs

This thesis deals with state Church policy from the end of the World War II, with emphasis on the gradual seizure of power by the communist party and the process of systematic oppression of Church which resulted in passing the so-called Church laws and creation of the State bureau of Church affairs in 1949. The goal of the thesis is to map the relationship between the state and Church, to relate the systemic and administrative changes in the political and religious context which resulted in the State bureau of Church affairs representing the peak of state Church oppression. Influence of the Separation on Financing of the Churches

Abstarakt - English This thesis analyses current state of churches financing. Following implementation of the Act of Property Settlement with churches and religious societies, the churches receive state contribution intended for churches' service reduced by 5 per cent from the original compensation amount every year since 2016. The contribution shall be paid out till final termination in 2027. Moreover, according to the Act, churches receive financial compensation for thirty years since 2013. This thesis asks following question: Could the churches be able (after thirty years) to finance their services from the state financial compensation only which they would regularly invest during the thirty years and from which only salaries should be paid in the anticipated level of 2013 valorized since 2019 by supposed inflation. The state financial compensation is supposed to be valorized by the same inflation. The calculations resulted in finding that only the Roman-Catholic Church would prove to be succesfull under given conditions. Development of diplomatic relations amongst the Czech Republic and the Vatican

Diplomatic relations amongst the Czech republic and the Vatican have been formed since 1918. We study various circumstances which affect the process of shaping in the historical context and on the basis of liberal-idealistic and realistic theories. In this Bachelor work we will concern with factors which influence mutual relation of state and church in the perspective of international relations and in various specific significant moments. This reciprocal relation amongst state and church is not estabilished amongst two states, but also amogst state and international organisation, which is represented by the Pope, the head of the Church and of the Holy See. From the point of view of the mutual agreement every partner enters in this agreement with own demands and needs, which in the case of the papal diplomacy, these demands aren´t always in consensus with the diplomacy of the state. The Czech republic and the Holy See are democracies and such deal with problems in the diplomatic way, even though the consensus is not always possible.
