1. Vymezení předmětu práce Cílem této diplomové práce je popsat situaci církví a náboženských společností v rámci právního řádu v průběhu proměn, které český právní řád postihly za poslední půlstoletí. Protože není možné detailně zohlednit v práci tohoto formátu celé pestré dějiny státu a práva dvacátého století, tato práce se zejména bude soustředit na poslední vývoj, tedy na situaci za období totality. Dále i na novou skutečnost panující jako důsledek převratných změn, které nastaly po pádu komunistické totality. Hlavním účelem je zejména vytvořit srovnání, jedná se o srovnávací práci, s tím, že srovnávány nebudou jenom platné předpisy, ale i praktické důsledky a zejména teoretická ústavněprávní východiska, co se materiálních pramenů práva týče. Není bohužel možné v rozsahu daném formátem magisterské práce zachytit celou šíři, byť jen jednoho období historické české státnosti. Proto budou vybrána témata týkající se objektu práce, která jsou spatřována jako společná a stěžejní pro obě historická období a těmi se budeme zabývat dopodrobna, zatímco ostatní, související témata, jakož i související údobí, budou probírány více obecně. Také není možné dokonale popisovat rozdíly mezi přístupem státu k jednotlivým církvím. V tomto ohledu budou některé zvláštnosti nastíněny, ovšem nikoliv důsledně. Práce se tedy... Resume The goal of this paper is to describe the situation of churches and religious societies with respect to the legal system, through the changes that affected the Czech legal systém throughout the recent half of the century. Because it is impossible to fully deal with the entirety of the history of state and law over the century, it will focus on the developments during the totalitarian regime of the Communist party and on the results thereof. The main goal is therefore to make a comparison, this will be a comparativistic endeavor, and there will not only statutes and legal documents be described, but also the practical applications of these statutes and documents, and there will be focus on theoretical and constitutional basis behind the laws. Unfortunately, with the constrains of the current format, it is impossible to fully describe even one era of Czech statehood, therefore there will be an arbitrary selection of topics on which the facts will be demonstrated and from which they will be extrapolated. The other topics will only be adressed to in a general manner. Also, it is not possible to include in full the divergent approaches of law towards the various individual churches.
