Personal Rights and Privacy

The aim of this study is to analyze the level of privacy of person in the Czech Republic and further analysis of the scope of protection of rights regarding honor, esteem, human dignity and the protection of name with regard to current legislation and judicial decisions. I focused primarily on interventions, criticism, and collection of data and the possibility of receiving satisfaction. The issue was analyzed mainly on the basis of judgments that can also be used at time the effectiveness of current legislation, which is also based on the rulings of the ECHR.
Protection of personal rights in continental system and common law

With the increased global infringement of personal rights, it is necessary to be aware of the protection in the different legal systems, especially Anglo-American. Even if the consequences are to be felt in the domestic legal order, the enforceability is recognized under the foreign legal order. The protection is worldwide and through the case law from the European Court of Human Rights the two legal systems - Common law and the Civil Law are penetrating the legislation and the case law in respect of the institute of the protection of personal rights. The doctorate thesis presents the complex introduction to the area of protection of personal rights in the Common law, especially in English law, Commonwealth countries and USA that has not been presented yet for the Czech legal professionals. The thesis explains theoretical concept of the Common law and its background for the purpose of explanation of differences of examined legal orders. The institute is explained on the key historical case law that led to establish the Common law principles. The thesis uses the current and topical legal cases and problems that the orders face in the 21st Century.

This bachelor thesis "Protection of personal rights of a child in media" deals with protection of personal rights of a child in media. Media publish information about children all the time, but that is not always the right thing to do. A child has a special position in Czech legal system, it is important to have in mind best interest of the children that you write about as a journalist. This thesis defines the most important terms that are important to understand the whole bachelor thesis. The main goal of this thesis is to present legal background related to protection of personal right with a focused-on child's personal rights. It observes not only civil law that is the main source of personal rights protection, but also on criminal law and media law as well. The analysis focuses on Czech case-law in relation to media covering children in their articles. The case-law is really critical of some of the private information that journalists publish about a child's private life. Therefore, it is important to point out what are the boundaries that journalist shouldn't cross when they write or report on children's private lives. 1 Abstract European Court of Human Rights: its position and role in the protection of personal rights of an individual including analysis of judgments and the influence on domestic judicial decisions The thesis is divided into three parts. The first part is devoted to the theoretical background of the ECHR, its function within the Council of Europe, personal ground and analysis of statistics. The thesis is also focused on the procedural rules of proceeding, with emphasis on the filing of the complaint, its formal and substantive requirements and its compliance with the Convention. In this section, is also presented to the reader the procedure, the enforceability of the decisions and the renewal of the proceedings before the Constitutional Court of the Czech Republic. In the second part, the concept of personal rights and the Convention are presented in the light of the Article 8 and 10 of the Convention because these are the most important articles when it comes to personal rights. The third part is devoted mainly to the analysis of the case law of ECHR with a connection to the domestic case law. Freedom and personal rights of employees in Québec

The Thesis deals with freedom and rights of employees in the Canadian province of Québec. The first part characterizes the law in Québec and specifies the system of law in this province. The second part concerns the discrimination and the guarantee of rights and freedom. The topics of the third part are accommodative remedy, its future development, the relation with the increasing number of immigrants and some obstructions that the accommodation has to face sometimes. At the same time, it offers some propositions to accommodate effectively in order to maintain the development and prosperity of a corporation. The Thesis goes along with case studies that illustrate the problems with particular examples from reality.
