Public Work Contract

This bachelor’s thesis is focused on issue of the qualifying requirements for the public works contracts. The first part contains basic notions of the public procurement and describes the various qualifying criteria. The second part deals with the practical application of qualification requirements and evaluation criteria. The aim of this thesis is to analyze the frequency of occurrence of qualification criteria, evaluation criteria and examining the percentage weights for each individual criteria.
Tendering Procedure in Process of Investment Construction

The issue solved in this thesis is the procedure for the award of public contract with extensive subject matter of the construction works. In accordance with assumed level of fulfillment, over limit public order is awarded in open procedure. Afterwards, the analysis of submitted bids from contenders was created in parallel with an assessment of the impacts, which have occurred during the implementation of the fulfilling of the public contract. The thesis is examined from the perspective of the Act No. 137/2006 Coll., on Public Procurement, as amended. Future recommendation is the establishment of new amendment to that Act, with the aim to increase the evaluation criterion of economic advantageousness of tenders.
Decision-making practice of the Office for the Protection of Competition in cases of proving qualification requirements in public tenders

RESUMÉ AJ "Decision-making practice of the Office for the Protection of Competition in cases of proving qualification requirements in public tenders" The annual report of the Office for the Protection of Competition for the year 2014 comes to a conclusion that the most frequent mistake of a contracting authority is stipulation of disproportional (discriminating) qualification requirements. The objective of my paper is shedding light on selected contentious areas that are dealt with by the Office for the Protection of Competition, by regional courts or by the Supreme Administrative Court respectively, thus illustrating the most frequent mistakes committed by contracting authorities when stipulating qualification requirements. The paper is structured into several chapters for addressing the selected topic. The first part of the paper introduces the basic concepts and the institute of public tenders closely related to subsequent setting of qualification requirements while also referring to elementary judiciary practice. The subsequent chapters describe particular categories of qualification requirements like elementary qualification requirements, vocational qualification requirements, economical and financial qualification requirements, as well as technical qualification requirements. Qualification of Teacher's Assistant

This diploma thesis deals with the qualification requirements for the role of teacher's assistants.The main aim of this thesis is to find out a level of satisfaction of teacher's assistants with the current form of qualification courses for teachers assistant role. The diploma thesis consists of four chapters, three of them are theoretical and the last chapter is a practical part. Theoretical part defines legislative background for the role of teacher's assistant, preferred personal traits, abilities and skills, the scope of work and the possibility of obtaining professional qualification and further education for the role of teacher's assistants. Also, there is a comparison of the teacher's assistant role in Czech Republic and abroad.

Qualifications prerequisites contained in Act No. 137/2006 Coll., on Public Contract, as amended (hereinafter the "Act"), from the perspective of the judicial-making practice

This rigorous thesis deals with the fulfillment of qualification prerequisites from the perspective of Act No. 137/2006 Coll., on Public Contract, as amended (the "Act"). The aim was to analyze the various kinds of qualifications in terms of the practice of courts and the Office for Protection of Competition. The author also dealt with the legislative changes brought by Directive 2014/24/EU. Act distinguishes four basic types of qualification prerequisites. These are basic, professional and technical qualifications prerequisites and a solemn declaration of the economic and financial capacity to perform a public contract. The interpretation of the provisions of the Act serves the fundamental principles of the procurement procedure, i.e. the principle of equal treatment, non-discrimination and transparency. Based on the analysis of different types of qualifications prerequisites author proposes de lege ferenda following changes: extension of the basic principles of the procurement procedure on the principles of reasonableness and objectivity. Qualifying requirements and evaluating criteria in public tenders The purpose of my thesis is to analyse selected areas of public tenders awarding, namely qualifying requirements and evaluating criteria, which are used for selection of the most advantageous contractor for performance of the public tender object. The thesis is composed of four main chapters. Chapter One summarizes the development of public tender legislation in the Czech Republic, defines current legislation both in the Czech Republic and in the European Union. Chapter Two defines basic terms of the public tenders area which are typical and characteristic only for public tenders and which are not used in other fields of Czech law. The two remaining chapters are devoted to the qualifying requirements and evaluating criteria, their role and types. Through qualifying requirements contractors are divided into those who are qualified to perform public tender and those who are not. Regarding its importance, it is necessary to stick to the binding provision of the Public Procurement Act while setting the qualifying requirements. Selected issues of public procurement - tender requirements This thesis deals with the public contracts from the perspective of an important institute - "tender requirements". The thesis looks at the issues of tender requirements from perspective of the contracting authority in an open procedure. In the introduction (chapter I) thesis is briefly interpreted by the systematic and historical incorporation of law of public contracts. In the second chapter of the thesis tender requirements are unloaded according to the section 17 subparagraph l) Public Procurement Act, including the definition of the requirements of the contracting authority shall not, without complying with the terms and conditions. The third chapter includes the interpretation of the qualifications which are the nearest institute of tender requirements. In addition to the general definition and enumeration of each qualification it is summarized the common features of both group requirements. Whereas there is not a full list of tender requirements, some of the most important of them are enumerated in the fourth chapter. Evaluation of public orders

This thesis is focused on the evaluation process of procurement and its very detailed mapping regarding to example of qualifications, assessing bids in terms of ratings according to different methods. For the analysis of selected public contracts, the author used informations from the information system on public procurement, which is accessible to the entire job, including all relevant requirements. On the basis of this contract evaluation was conducted using three methods and their comparison. Furthermore, part of the thesis is to design a fictional version based on the same public contract, in which are also collected additional sub-criteria and information. On the basis of these findings and the criteria is carried out further evaluation and is observed difference from the original version.
Public procurement process in the Czech Republic

The goal of the bachelor thesis is the evaluation of the development of the public procurement process in the Czech Republic for the period of time beginning in 2004 focused on the most common mistakes of the submitters at the public procurement process. The thesis is devided into two parts, the theory and the practice. The theory focuses on the describtion of the historical development of the public procurement process and there are some basic terms explained (such as public order, dorts of public orders, submitter, public procurement process). The practice focuses on the problematics of typical submitters mistakes in the public procurement process. There are defined the most common mistakes of the submitters by the use of some samples of the decisions of the Office for the Protection of the Competition for the period of time 2012, 2013 a 2014 and there were made efforts to find out when the most common mistakes appear. At the end of the thesis there is an evaluation of the analysis and there are recommendations how to decrease mistakes in the public procurement system.
