The crimes of fraud, insurance fraud, credit fraud and subsidy fraud as regulated by sections 209 to 212 of Penal Code

This thesis complexly describes the crimes of fraud, insurance fraud, credit fraud and subsidy fraud as regulated by sections 209 to 212 of Act No. 40/2009 Coll. Penal Code. First the historical development of these crimes is described, both from the view of legislation and criminology. Further, the sources of the legislative regulation of these crimes are defined. Since fraud belongs in the category of property crimes, these are also discussed collectivelly, with emphasis on the individual common elements of the above-mentioned crimes. The above-mentioned crimes are each individually described with respect to their individual elements including the description of eventual problematic elements of the current legislation. In case of the special elements of these crimes the legislation regarding the respective contractual obligations is described. In addition to the above-described exposition a comparison with the crime of Act detrimental to the financial interests of the European Union is included. Criminal Aspects of Cybercrime

The purpose of this thesis is to introduce the issue of cyber crime, a phenomenon which is gaining importance in recent years. The first chapter outlines the basic problem: Mass use of information and communications technologies may have downsides. Consequently, the reader learns briefly about development of computers, which resulted in the emergence of the Internet. Especially, how this short evolution affected the terminology regarding crimes related to information technology. The term "cyberspace", from which we derive the term "cyber crime", becomes crucial. This virtual world is not only a place of fun but unfortunately also full of malicious behavior. Further, the work deals with the specifics of cybercrime and its differences that distinguish it from other types of crime. The fifth chapter deals with the legal regulation, both domestic and international. It lists major legislation related to the cyber crime and is especially dedicated to analysis of the Criminal Code, the law on cyber security and the Convention on Cybercrime. Next comes the main section of the thesis dedicated to crime in cyberspace. It describes the most common malicious activities which occur in cyberspace. Criminological Aspects of Hate Crime

The aim of this thesis on the topic of the Criminological Aspects of Hate Crime is to offer comprehensive point of view on this issues to the reader. The thesis is divided into five separate chapters. The first chapter is focused on definition of hate crime, specific characteristics of this criminality which distinguish it from other types of crime and also on typology of hate crime. The second chapter is concentrated to the Czech substantive legal regulation of hate crime and its possible regulatory options for the future in a first place. In its other part is focused on legal regulation of hate crime in the United States of America, Great Britain and Germany. In the last part of the chapter, the regulations of all these states are compared in terms of method which they used for anchoring hate crime in the legal system and how large their protection of minority is. The crime of rape under s. 185 of the Criminal Code

The diploma thesis The crime of rape under s. 185 of the Criminal Code consists of two major parts, which are divided into further subsections - first part consists of four main chapters and second part consists of six main chapters. The first part of the thesis, dealing with the criminal-law point of view, starts with a brief discussion of the sources of criminal law. The chapter then presents a comprehensive description of the development of the offence of rape in the Czech territory since antiquity up to the 20th century. The changes of elements of a crime and the very perception of punishability of rape may serve as a demonstration of advancement of personal freedom. Subsequently, more attention is devoted to the analysis of the current version of rape in the Criminal Code, Act No. 40/2009 Sb., which is currently included in Title III of the special part of the Criminal Code called Criminal Offences against Human Dignity in Sexual Sphere. Thieves in law - post-soviet criminal world leaders (from "perestroica" until today)

The work deals with thieves in law as chiefs of Russian-language criminal organizations. On the basis of an analysis of available sources, and their historical, criminologically focused processing, there is examined a hypothesis that criminality represented by the thieves in law creates in its fight against the society a specific form of self-defence. Part of the work being also an answer to a question to what extent today's division into old and new vors is topical, and whether this world has modernized in permanent relation to the environment surrounding it. The author proceeds in his analysis from the role of the thief in law as the individuality acting in constant tension with the society to the characterization of the thieves in law and to relations by which they are connected. He also focuses on power structures to which the thieves in law are subordinated. Thus, the author pursues an overall picture of chiefs of the Vor world and its possible modernization. Criminological aspects of hate crime

The aim of this thesis, focusing on the Criminological Aspects of Hate Crime, is to provide a comprehensive analysis of this kind of criminality in the Czech Republic from the criminological point of view. The work is divided into six chapters. The first of which introduces the topic and presents the definition of this kind of criminality and its close connection with extremist criminality. This activity is characterised by hate motivation against a group or an individual because of their real or presumed race, colour, religion, national origin or ethnicity, gender, sexual orientation or disability. The chapter also deals with the development of the hate crime concept, typology of criminal activity based on the committed type of crime or motivation and particular criminal acts occurring in the Czech Republic. The second chapter is focused on extremism and illegal activities of the members of this scene which attack the democratic system and are capable of jeopardizing it. Criminological aspects of hate crime

The aim of this master's degree thesis on the topic of the Criminological Aspects of Hate Crime is to offer a comprehensive perspective on hate crime from the criminological point of view. The first chapter is introductory and concerns itself with the phenomenon of hate crime in general. It deals with the theoretical definition of hate crime, its specific characteristics that distinguish it from other types of crime and it also includes a typology of hate crimes. Subsequently, it focuses on the international, European and Czech substantive legal regulation. The second chapter concerns itself with the related term of extremism. It defines the main ideas and manifestations of right wing and left wing extremism and it also focuses on the current situation and extremist scene in the Czech Republic. During the examination of the right wing political extremism, the terms of racism, nationalism, ethnocentrism and xenophobia are explained. Then, religious extremism and terrorism are briefly described. Finally, the last subchapter deals with the etiology of extremism. (EN): Criminal Law and Criminological Aspects of the Rape Crime The rape crime is a very specific crime. Although it belongs to the most painful and traumatic crimes, the public does not often pay enough attention to it, which in practice leads to the fact that rape victims are sometimes overlooked, treated insensitively, or their trauma is often trivialized. We also cannot ignore the fact that the rape crime is accompanied by a number of prejudices, which are for many decades ingrained in our society. All these aspects result in the fact that this crime is characterized by very high latency rate. In my diploma thesis, I dealt with the criminal law and criminological aspects of the rape crime. I was also concerned with the progress in legal regulation of rape, which has changed a lot in past 50 years. My diploma thesis consists of two parts; the criminological part and the criminal law part. Comparison of Juvenile Delinquency in the Czech Republic and Germany

This Master thesis explores delinquency of juvenile Czechs and Germans from seventh to ninth grade based on quantitative data. The data comes from an International Self-Report Delinquency study (ISRD-2), which is anchored primarily in the Social control theory (Hirschi, 1969/2002) and the General theory of crime (Gottfredson, Hirschi, 1990). Therefore, in the first section, attention is paid to these and other selected criminological theories; the other theories are mainly the strain theories and the cultural deviance theories. In the second section, the thesis deals briefly with the socio- cultural differences and similarities between the Czech Republic and Germany. The core of the thesis is the third, analytical section, which presents the findings of statistical analysis. A conclusion is reached that the theories studied are by far less contradictory than what the authors of the social control theory and the general theory of crime claimed them to be. It rather seems that the individual theories are complementary and often lead to the same predictions.
