Bills of Lading and other Shipping Documents in the International Maritime Transportation

(EN): Bill of Lading and other Shipping Documents in the International Maritime Transport Main aim of this thesis is an introduction to the law regulating shipping documents used in the international maritime transport and summary of current and possible future development in this area of law. The relationships arising from issuance and handling with the shipping documents may be quite complicated and the purpose of this thesis is to present these issues that have not been explored deeply in the Czech Republic yet. The original reason that led me into choice of this topic is my personal interest in international trade, ships and securities. The shipping documents enable smooth operation of the international transport and the international transport facilitates the international trade as such. At present, almost all goods at the market are being shipped via ocean during their way to the final customer. The entire movement of goods via ocean is being conducted under shipping documents and the significance of the shipping documents is therefore considerable. Computerisation of bill of lading and other carriage documents in international maritime carriage

ii Abstract and key words in English language Abstract This thesis focuses on the issue of electronization of carriage documents in international maritime transportation. There are two basic types of carriage documents in international maritime transportation - negotiable and non-negotiable documents. The negotiability of the document is based on the ability of the document to transfer ownership of the goods represented by that document by the transfer of the document itself. Typical negotiable document in maritime transportation is a bill of lading. The bill of lading is a security, in Czech legal system it is a special type of so called náložný list, with which the ownership right is attached to the goods that are specified in the bill of lading. One of the benefits of using negotiable carriage documents is that the goods can be negotiated (the ownership can be transferred) while it is transported. Whilst the electronization of non- negotiable carriage documents is not a problem, the case for negotiable documents is the opposite. The submitted thesis is divided into two parts. The importance of NVOCC operator in maritime container transport

The aim of the thesis is to generally characterize the maritime container transport and to describe a complete work agenda of an NVOCC operator. Another aim of this thesis is to introduce the transport chain and the role of the NVOCC. The first part focuses on advantages and disadvantages conected with shipping goods by maritime transport in comparison with other transport sectors. The second part divides sea transport firstly from a commercial perspective on liner and tramp shipping, and then by type of boats. The third part describes the development and interconnectedness of international trade and maritime transport, its commodity and territorial structure. The fourth part deals with the possibility of contractual ensuring of maritime transport, liability of the carrier and conventions which govern this liability. This section also mentions the role of insurance.

This diploma thesis analyzes the maritime container transport, it's history and development and the types of containers. It deals with the current situation in the maritime transport market. The main emphasis is on detailed description of the transport chain. The paper also deals with documents that are carried by sea, especially the Bill of Lading. This is a specific document, among other it is a tradable security. In the thesis there have also been mentioned the current issues of liability and insurance - (Rotterdam Rules and INCOTERMS 2010).

The aim of this bachelor thesis is to give a comprehensive overview of the carriage of goods by sea. Above all it focuses on the realization and the treaty reinsurance of the maritime transport. The first part of this thesis deals with the basic transport documents used in the carriage by sea. The main emphasis is focused on the bill of lading mostly used in the liner shipping and on the Charter Party used as the basis of the tramp shipping. The second part of this thesis focused on the insurance in the carriage by sea and on the liability of the carrier, which is differently regulated by many rules at present.
