Joint custody - its assumptions, strengths and potential weaknesses in the light of psychology

This bachelor thesis deals with joint custody in relation to its assumptions, strengths and potential weaknesses in the light of psychology. The theoretical part provides insight into the context of the form of contemporary family, with the issue of divorce and its impact on all involved individuals and with different forms of parenting. The legislative grounding of post divorce child care and its possible forms in the Czech legal order is also covered. The psychological assumptions of joint custody of both the parents and the child are emphasized to a great extent. On the basis of these findings are drawn possible strengths and weaknesses of joint custody. Last but not least are presented different approaches to joint custody among a few selected countries. The final part of this thesis is designed as qualitative research project focusing on the evaluation of joint custody from the perspective of individuals who have personal experience with this post-divorce arrangement. Potential risks of joint custody of pre-school child

The present bachelor's thesis deals with the possible risks of joint custody of preschool children. At the beginning there are some notes on family and the factors which can lead to its break-up. Then the three possible after-divorce arrangements which are allowed by the current legal regulation of the Czech Republic are defined and described. The core of the thesis is the chapter on joint custody, which describes its most frequently cited advantages and shortcomings which also presents previous research into this topic. The next chapter describes selected areas of the preschool period of child development, which are linked to the divorce of the parents, and to the pros and cons of joint custody. Emphasis is placed on the risks of this after-divorce arrangement, which should be taken into account by parents, as well as by courts. The final part of the thesis is the proposal for a research project in this field.
Parental separation and awarding custody of pre-school aged child

This thesis focuses on the topic of parental separation and awarding custody of pre-school and early-school aged children. In the theoretical part the specifics of each developmental stage and also of the mother's and father's role are described. In the following chapter the thesis focuses on the process of parental separation, its phases, causes and its influence on children. Also the most typical phenomenons and risks connected with this complicated situation are mentioned. Not to be forgotten, the legal side of the process is also included. The thesis contains empirical part, in which structured interviews with social workers were led, in order to map current trends, the most serious risks, the possibilities of different forms of custody and the role of psychologists in parental separation in the Czech environment. The influence of shared custody on the child's school success in primary school

The topic of this diploma thesis is the influence of joint custody on school successfulness of a child. In the theoretical part I describe a contemporary family and major functions of the family. I chart the situation of legislation in the Czech Republic, I deal with circumstances how the Czech courts make a decision about commiting children into parental care after a divorce of their parents and whether the number of children being involved in joint custody increases. I am really interested in the fact whether the courts make a decision based on the child needs. Following this part I focus on the definition of school successfulness of children and the behaviour of younger learners. I indicate the factors that could have an influence on school successfulness. In the practical part I present the results of my qualitative research. I explore the influence of joint custody into child school successfulness from the point of view of class teachers. I survey the behaviour of children who live in joint custody after the divorce of parents and I also take an interest into the fact whether the class teacher have noticed any features that could connect these children.
The Life Situation of Fathers who Actively Participate on Raising their Children after Divorce

The main topic of this thesis is understating the life situation of divorced fathers, who actively participate on raising their children. As a group of interest I define fathers, who have reached joint custody. I try to understand their specific situation by making three half-structured interviews, during which I examine different spheres of their life. Because of the he lack of interviews I've combined this information with the data from online discussion for divorced fathers. To understand this topic in a more complete way I've also made interviews with two experts - Lukáš Talpa and one of the workers of the Authority for Social and Legal Protection of Children. The theoretical background of this essay is an active fatherhood and a life-course perspective. By thematic analysis I discovered a few mutual patterns. First of these patterns is disadvantaging fathers during the custody courts. This topic is very specific and hard to prove. Also, there are not enough expert studies, so I analyzed mostly my own data. Even though the experiences of the fathers are mostly negative, the experts claim that there is no global discrimination during the custody courts and the chances for men and women to achieve the after-divorce custody care they prefer are equal.
