The Development of the Cult of St. John of Nepomuk to Canonization

The cult of St. John of Nepomuk was one of the characteristic features of life in the Habsburg Empire and other European catholic countries in the early modern period. The origins of veneration for the medieval martyr were tied to Prague, to his tomb in the cathedral, to the Metropolitan Chapter. The saint became famous above all for the conviction that he gave his life for the preservation of the confessional secret. With his death he preserved the good name of the Czech Queen Joan, who confessed to him; on the other hand, he is said to have punished those who were disrespectful of his own posthumous reputation and grave. He therefore became an immensely popular defender of honour and reputation, values highly valued in the early modern society. Under the influence of the Prague Chapter, St. John's veneration was taken up by the Habsburgs, the Catholic rulers who ascended the throne of John's torturer, Wenceslaus IV, and John's spiritual daughter, Joan. They venerated the saint as one of the patron saints of the Bohemian kingdom, which they ruled. 1 The crime of defamation under Art. 184 Criminal Code Abstract This thesis deals with the wording and the role of the crime of defamation in criminal law. Since it is a minor offense due to the objective aspect of a criminal offense and the type of object it protects, and it has repeatedly been considered for removal from the Criminal Code for the last 15 years, the author posits whether the existing factual basis of defamation in criminal law is dispensable. The first chapter of this thesis deals with the fundamental right of preservation of human dignity, personal honor, and good reputation. The introduction and differentiation of the enumerated institutes are followed by a summary of the historical development of penal regulation regarding preservation of honor. It aims to record how the definition of the crime of defamation developed starting from the beginning of the First Republic to the present day, and at the same time to explore the most important reasons that led the legislators to retain the crime of defamation in the Criminal Code after the Velvet Revolution. The topic of this thesis is " Protection of goodwill of a legal entity". It is an issue which deserves an attention, but seldom can man find any legal literature or essays on this topic, especially in comparison with the sphere of protection of personal rights. As the modern age moves ahead, there are more legal entities and also it is much easier to affect the right to goodwill of a legal entity and the encroachments are becoming more frequent. Due to the tense wording of the Sentence 19b of the Act No. 40/1964 Coll., Civil Code, as amended, it is necessary to follow the practice of the courts to describe this topic. So it is in this thesis, which is primarily based on the judgements of the courts, especially from the decisions of the Supreme Court of the Czech Republic. The other sources, I used in this thesis, are the commentaries and other legal literature. The aim of this thesis is to describe what exactly is goodwill, how a person can interfere into the right to goodwill, in which circumstances the person will not be liable for the unjustified encroachment, and if it is found, that the person is liable for the unjustified encroachment, how can the legal entity defend its rights before the court. This work deals with the term goodwill and its analysis of the legal system in the Czech Republic. Compares the relationship of "good reputation" and "goodwill". It also considers the relationship of goodwill and trademarks. It refers to the modern concept of goodwill in respect to trademarks. This work also introduced a system of passing off (unauthorized use of the sign) in UK law. In passing off goodwill is an important element in assessing whether the passing off occurred or not. It also examines the understanding of the goodwill in the Anglo-American legal system. It describes several theories of goodwill, according to legal-historical developments. It also discusses the possibility of transferability of goodwill.
