Legal and criminalistic aspects of crime scene investigation in criminal proceedings

This diploma thesis deals with the legal and criminalistic aspects of crime scene investigation in criminal proceedings, This metod is specified in the current legal regulation of section 113, Act No. 141/1961 Coll., Czech Criminal Procedure Code. Crime scene investigation is one the basic procedural acts, which often provides the only information about the investigated crime. Further, this special method provides key evidence leading ultimately to a final decision in the criminal proceedings. There are high demands on criminal authorities to investigate the crime scene. A possible misconduct could lead to the unusability of the investigation of crime scene as evidence in criminal proceedings. This is also highlited by the nature of investigation of crime scene as an urgent and unrepeatable act. The text of this diploma thesis consists of three chapters. In the first chapter, there is general definition of crime scene investigation, its basic characteristics and principles. The following is a brief definition of the legal interpretation and a comparison to the upcoming version of criminal procedure code. Psychological profiling of an offender Psychological profiling is a method of investigation developed in the 70's in the USA. This method is founded on research of behaviour of unknown offender with purpose to make conclusions about his personality. The purpose of my thesis is to find out how psychological profile can help during investigation. I would like to prove that psychological profiling belongs to investigation, that it can help during investigation and that it can bring a new view on case. The source of knowledge about the offender's behaviour and personality is the crime scene or text analyse. The thesis is composed of three chapters, each of them dealing with different aspects of psychological profiling. Chapter One is introductory and is subdivided into two parts. Part one describes history of psychological profiling. Part Two deals with theorethical background of psychological profiling. Chapter Two focuses on practical part of psychological profiling and consists of seven parts. Crime Scene Investigation is without a doubt one of the most important step in criminal proceeding, which allows us to gain a complete picture over events, that really happened. To helps us attain this knowledge, there are certain reflections of perpetrators actions in form of physical evidence, that needs to be found and professionally secured. The task of crime scene investigation team of the relevant department of the Police of the Czech Republic, which intervenes on the scene, is to examine the scene and to provide all the evidence that could help clarify the case. Procedure on the crime scene requires a perfect organization by the head of the crime scene investigation team, which puts high demands on expertise and practical experience of the lead investigator. This procedure is one of the most difficult in the entire criminal proceedings, because even small neglect od duties can have a fatal consequence. This thesis compiles a specific legal texts, that are designated to the students of the law faculties, and for the students of the Police academy of Czech republic, and also knowledge attain from practical guides and guidelines directly for the police officers in Czech republic and tries to create a set of law sources, that will not only compare them, but it will also include authors opinions....
Basic principles of behavioral analysis

This thesis is written as a recherche and the main theme is behavioural analysis. It is very young field of criminalistics, which investigates conditions and connections of crimes from the point of view of human behaviour: interaction of perpetrator and victim, signs and features of crime such as place, time, type of victim etc. On the basis of evidences the psychological profile of unknown perpetrator is set up. The profile can change during the time and it includes: presumable appearance and characteristics of perpetrator. Proces and methods of behavioural analysis are based on findings of many disciplines, common and also closely specialised such as: criminology, criminalistics, personality psychology, psychopathology, sociology, clinical psychology, social psychology and legal disciplines. At first the author describes history of the behavioural analysis what it proceeds from and how this field is used in practice. Than there are described particular steps of behaviroural analysis which are used by criminal profiler. In the next part the victimology field is introduced: venue, where the most evedences for revealing a perpetrator are; the ways of behaviour of perpetrators and the main points which psychological profile includes. The aim of this thesis is to introduce behavioural analysis, its progress and basics findings and possibilities of application during criminal scenes investigations.

The thesis describes psychological profiling of an offender, which is a method used for investigating serious criminal acts. It was developer in the United States of America, particularly on the FBI ground, and is based on creating an image of probable unknown offender. The goal of the thesis is to provide readers with basic information about what is psychological profiling and how the process works. The paper is divided into five chapters. First, opening chapter is divided into three parts. In the first one, the reader can find information about the term psychological profiling, how it is defined and what is it for. Second part contains information about history of the method including some about the development in the Czech Republic. The third part describes offences suitable for profiling and those which are not. The second chapter is focused on creating the profile. First it describes the characteristic of the crime scene as basic information for the investigation, and then the typology of offenders is mentioned, directed at organized and disorganized typology. Psychological Profiling of an Offender The purpose of the thesis is to describe and demystify the subject of offender profiling, also called criminal profiling or psychological profiling. Criminal profiling is one of key disciplines of forensic psychology which approximately in the last twenty years became recognized as a helpful investigative tool for resolving difficult criminal cases. The thesis is structured into four chapters, each one covering different aspect of criminal profiling. First chapter defines criminal profiling, its basic premises, formation and history, different approaches to profiling and possible uses of profiling. Second chapter focuses on practical use of criminal profiling. It covers criteria for using profiling in a particular criminal investigation, includes basic information about perpetrators and victims and shortly touches upon computer databases used in profiling.
