Dealing with the guilt of persons serving a sentence.

The diploma thesis deals with the ethical topic of guilt and its processing in persons serving a sentence. The paper elaborates with the topic of guilt on a practical and theoretical level. The theoretical framework deals with concepts related to guilt (morality, good, evil, conscience, sin), then presents the concept of guilt and the possibilities of its processing. Based on the description of the theory, the theoretical part formulates questions, which are used in the practical part. It describes three case studies of persons serving a sentence. The research is devoted to their individual perception of guilt and subsequently to ways of coping with it. Special attention is paid to Christianity and its influence on the perception of guilt, as two persons believe in God. Research shows that guilt is a fundamental issue for people in prison, whether it is in its negative or positive manifestations. The research confirms the fundamental theoretical starting point that there is a line from the negative effect of guilt to its positive contribution. As all three convicts confirm, guilt is the path to awareness, acceptance, and finally to the correction. The effect of selected types of penalties on the resocialization of convicts

The problem of resocialization of convicts and the effect of particular penalties on this process is a subject rather relatively neglected, but at the same time socially and legally fundamental. The success of the resocialization of offenders affects not only the entire criminal policy but also society as a whole. However, the view on this social dilemma is evolving over time. We do not longer examine the punishment as mere retribution, rather we expect it to protect society and have a positive effect on the convict. We also realize that most of the sentencing does not mean permanent exclusion from society. Therefore, the consequences of any sentence also affect us, the society. This phenomenon led me to analyze the three most severe sentences: imprisonment, house arrest, and community service. Gradually, I tried to investigate the outcome of the effects of these sentences on the offender's personality. During the analysis, I decided not to only benefit from the secondary data consisting of acknowledged publications, articles, studies, and concepts, but I also acquired findings from several interviews with experts within the sphere and convicts themselves. Problems of juvenile justice In my diploma thesis I deal with the issue of criminal justice over youth. Using the research analytical method, I try to describe juvenile delinquency, its causes, the development of juvenile delinquency in our territory and current legislation. I also devote other parts of the work to specific means of sanctioning young people, especially protective upbringing and imprisonment in its unconditional form. I am also subjecting the current legal regulation of these institutes to a comparison with other European regulations, from which we could be inspired when regulating the system of criminal justice over young people. I supplement the theoretical basis with statistics on juvenile delinquency and the administration of juvenile justice in the years 2016-2020 in order to provide an overview of not only the theoretical side, but also current practice. Czech prison system and its ability to meet the public interest

Diploma thesis "The Czech prison system and its ability to meet the public interest" deals with the public interest in the selected area from the perspective of key stakeholders, election programmes, policy statements of governments and (changes in) legislation between 2000-2013. For determination of what is the public interest has been used as a tool a scheme of four dimensions of definition of public interest. First, there is the public interest as defined by experts, which is determined on the basis of content analysis of the journal the České vězeňství published by Prison Service of the Czech Republic. Second, the public interest determined by the preferences of citizens, which are collected from content analysis of articles from Newton Media Search and from reproduced findings of public opinion polls. To analyze the third dimension of public interests, which are generated by functional needs of the community, content analysis of election programmes of the parliamentary parties of the period is used as well as policy statements of the government and also the study of changes in legislation. Vyplatí se trest odnětí svobody?

Tato bakalářská práce je zaměřena na vývoj teorií v oblasti páchání zločinu. Rovněž je zde uveden vývoj pojetí funkcí trestu a způsobu trestání. V teoretické části je dále poukázáno na výkon trestu odnětí svobody jako na neefektivní z hlediska působení na vývoj kriminální recidivy. Analýza ekonomické efektivnosti potlačování zločinu ukazuje, že náklady na jednoho uvězněného zločince jsou až čtyřikrát vyšší než výnosy z jeho uvěznění. V praktické části je dále uvedeno, od jaké výše by se trest peněžní pokuty vyplatil více než trest odnětí svobody.
