Building Legal Awareness Among Children Living in Children's Homes With the Support of a Social Worker

The bachelor thesis deals with building legal awareness among children living in children's homes with the support of a social worker. The aim of the bachelor thesis is to determine the situation of legal awareness among children living in children's homes and to find out what role the social worker plays in building legal awareness among children in a selected children's home. The practical part is based on a combined type of research, the interviewing technique. First, legal awareness among children living in orphanages was investigated using prof. Gary Melton's international questionnaire. The method used was the guided interview, which was conducted individually with each child. The data collected was analyzed using the statistical program SPSS. The second research tool was a semi-structured interview which was conducted with social workers in children's homes. Coding in the subtext of the interview conducted was chosen to evaluate the data. The evaluation of the collected data was done by pencil-paper method and subsequent clustering. The research population consisted of a total of 63 people. From the research investigation, it was found that age does not affect children's attitudes towards granting rights in model situations. In terms of gender, only one situation showed that girls were more inclined to grant rights than boys. In the case of social workers and legal awareness building among children from children's homes, it was found that children's rights are primarily the concern of educators, but social workers also contribute to legal awareness building, especially before the child leaves the home. The findings of this bachelor thesis can serve all those who encounter children living in children's homes in their practice and the public who are interested in this topic.

Constitutional aspects of the Protection of the Rights of the Child Abstract This thesis is concerned with the protection of the children's rights from the perspective of constitutional law and human right. The thesis aims to evaluate constitutional guatantees for the protection of children. Children are considered vulnerable persons worthy of special protection, however, the developlment of their rights and the move out of a paternalistic approach has only recently begun. Thus, there is a need to adapt children's rights to today's society and current scientific knowledge to avoid unnecessary discrimination and non- involvement of childen in the processes. The text is divided into a theoretical part in whicch the history of the view of the child the history of children's rights, the organization and instituition, both national and international, concerned with the protection of children's rights are presented. The most important of these documents is the Convention on the Rights of the Child, whis is then dealt with in the practical part and which is considered part of the constitutuional order. Cochem model as an option in the use of childrens participation rights

My diploma thesis focuses on the active role of a child in the process of decision-making about custodial care and its conditions. This thesis describes what is known as Cochem's model, how this model treats a child's participation and how a child uses that participation when its family is going through divorce. Cochem's model is based on interdisciplinary collaboration, which is also mentioned. There are also particular cases from real life supported by views from a psychologic point of view.

68 Constitutional Aspects of Imprisonment Focusing on the Protection of Family Life Abstract This thesis aim is to analyze some constitutional aspects of imprisonment relating to the fundamental rights and freedoms of convicts. The thesis is divided into two parts - the general part and the special part, which is aimed specifically at protecting family life. The general part theoretically deals with the definition of the meaning and purpose of imprisonment and its execution, the status of convicts as holders of fundamental rights and freedoms, constitutional limits of restrictions on their fundamental rights and freedoms, and the means of their judicial and other legal protection. Except for the third chapter dealing with the role of protection of family life when imposing a prison sentence, the special part focuses on the protection of family life during the period of imprisonment. This diploma thesis deals with contemporary family, in particular by ensuring the best interests of the child during the parents' divorce and post-divorce in care. The theoretical part introduces the characteristics of the contemporary family, as a result of socio-cultural development of society, and then attempts to put forward the concept of the current healthy family, as the possibility of a positive direction. It deals with the causes and manifestations of families at risk to stability, the question of divorce of parents in relation to a child after divorce and child care. It introduces the possibility of using supportive and protective services social and legal protection of children under current legislation. The subject of the practical work is still continuing casuistry's growing conflict divorce of parents, which resulted in threatening condition child's healthy development. The research focuses primarily on the way to fulfilling the practice of social and legal protection. Legal position of a child with regard to the right of participation (comparative study)

The thesis concentrates on the topic of legal position of a child and his or her participation rights. It is drawn as a comparative study and focuses on comparing the legislation concerning participation rights of the child in the Russian Federation and the Czech Republic. The main goal of the thesis is to find identical or similar elements in the legislation regarding the child's legal position and his/her participation rights. Adoption of the Convention on the Rights of the Child in 1989 was followed by a changed approach of its member states towards the legal position of the child. States enlisted provisions into their legislation that held a child not only as a passive holder of rights but an active subject that is able to exercise those rights after fulfilling legal conditions. The important aspect on which the thesis also focuses is assessing whether the participation rights of a child are really being applied in practice or they are up to the present day rather a theoretical construction. The patient's right to third person presence in healthcare facility

Resumé This thesis discusses the problematics of third person presence alongside a patient in a healthcare facility. Despite this subject having been relevant for tens of years, it has only recently been brought to public attention due to the COVID-19 pandemic. In practice, the right to third person presence in accordance with the provisions of Article 28(3e) of the Health Services Act is commonly misinterpreted as the right to receiving visitors in accordance with the provisions of Article 28(3i) of the Health Services Act. Due in part to this fact, the main goal of this thesis is establishing legal clarity in this domain of healthcare law. The bulk of this paper consists of introduction and analysis of legislation, notably the Health Services Act, in light of international pacts and laws of the Czech Republic, on constitutional level but not limited to it. The most crucial, however, is Chapter 3, which discusses specific provisions of the Healthcare Services Act concerning the right to presence, specifically the provisions of Article 28 of this Act. The best interest of a child in the context of biopsychosocial aspects of health

The rigorous work can be considered as a response to the issue of child health promotion, which is currently still focused mainly on somatic health, while there is a long-term deficit and underestimation of psychosocial health promotion. The systematically conceived theoretical part of the thesis is based on the existing health status of the population and presents the biopsychosocial concept of health and its legislative anchoring in relation to ensuring the best interests of the child. The work also includes reflections on health and illness as the ability to cope with life stress and maintain homeostasis. The fundamental concept is the recognition of a living organism as a self-regulatory system with the ability to create symptoms at all levels of existence. In the viewpoint of the rigorous work, symptomatology can be seen as a specific language that allows to find a way for the organism to stop producing the symptoms of the illness and to cure it. The thesis entirely respects current health services, which are extended to support the psychosocial aspects of health in such a way that its individual aspects are given comparable attention. The Best Interest of the Child (especially in connection with Interim injunction) Abstract The topic of this thesis is the issues of minor children, who must enjoy increased legal protection due to their age, immaturity, dependence on parents, etc. For this reason, the topic of this thesis will focus on the principle of the best interests of the child. This issue of minors is explained not only in terms of constitutional order and legal regulations in the Civil Code, but also in terms of civil procedural law, the Act on Special Judicial Procedures and the Act on the Social and Legal Protection of Children. Legal status of adopter and the best interests of the child

This rigorosum thesis focuses on the analysis of the current legislation of the institute of adoption in Act No. 89/2012 Coll., the Czech Civil Code, focusing on specific requirements for the person of a potential adopter. Criteria related to the legal status of the adoptive parent are critically examined in this work primarily through the prism of the equality principle and the principle of the best interests of the child as a paramount principle of adoption enshrined in international conventions by which the Czech Republic is bound. The main goal of this work is to draw attention to the conservative approach of the national legislator to issues related to the adoption of the child, in which the strong roots of historical views and traditions are still evident. The evaluation of the suitability of the adopter's marriage as a basic condition for the adoption of a child is realized by comparison with foreign legislation, by analysis of relevant provisions of international treaties governing family and child rights and foreign case law and by research in sociology and law. The final part of the thesis is devoted to reasoning about the legal regulation of the requirements for the legal status of the adopter de lege ferenda.
