Basic principles of activities of administrative bodies

The bachelor thesis deals with the basic principles of activities of administrative bodies in the legal system of the Czech Republic. It also deals with the functioning of the domestic public administration as a whole. The thesis is primarily focused on the essence of functioning and compliance with the basic principles of administrative bodies contained in Act No. 500/2004 Coll., Administrative Procedure Code, and is suitably supplemented by an analysis of the case law of the Supreme Administrative Court and the work of the Public Defender of Rights. All with a focus on administrative law. Knowledge, appropriate application, interpretation and observance of the basic principles of activities of administrative bodies are a prerequisite for fulfilling the right to a fair trial and the basis for the proper functioning of a democratic state governed by the rule of law, which the Czech Republic undoubtedly is. The thesis not only analyzes these principles, but also factually describes and evaluates the role of the ombudsman in the field of enforcement of these principles.

The Skiing of pre-school and basic school children

9.RESUMÉ The goal of this paper is the analysis of pedagogical activity within skiing tuition of children of preschool and school age with determination of suitable methods of skiing education of children regarding their age. Within the submitted work I put all my effort into introduction of skiing as not only an ideal educational tool with maximum positive impact on personal development of a child, but also as perfect tool for putting the pedagogical methods education and guidance of children into real life practice.

Serbian minority in Croatia: Development of the Legal Status During the Integration to the European Union, 2000-2011

This bachelor thesis concerns with the development of the legal status of the Serbian minority in Croatia during the period of the integration of Croatia to the European union in years 2000- 2011. This thesis uses the historical approach to research the attitude of Croatian governments towards Serbs. The research of this attitude is based on enacted laws connected to national minorities, the implementation of guaranteed rights and the willingness of ruling politicians to maintain interests of the Serbian minority. These mentioned points belong to domestic political affairs, however the position of the national minorities was significantly affected by the EU because of an ambition of every single government to join the union. Since the year 2000 the legal position of Serbs has improved in comparison to 90's when anti-Serbian mood, which was fostered by the governing Croatian democratic community, was spread through whole Croatian society. Significant part of the Serbian issue represents property rights of refugees who left the country during a war in 90's. The normalization of Serbian position formally ended in 2011 when Croatia fulfilled all EU conditions liked to the protection of national minorities and finished accession talks. Obecnost právní normy je nezbytnou vlastností každého právního předpisu. Pokud není v právním předpisu zachována, upravuje tento předpis jedinečný případ. Vzhledem k tomu, že předpis upravuje jedinečný případ jinak, než je tomu u ostatních případů, dochází tímto způsobem k diskriminačnímu postupu. Kromě toho v případě, že má jedinečný případ rozhodovat správní orgán nebo soud, a tento případ je místo toho upraven zákonem, není dodržena zásada dělby moci. Práce vybírá relevantní judikaturu Ústavního soudu ČR ve věci obecnosti zákona.

Court Decisions Making on Upbringing on Minors in Civil Procedure

The rigorous thesis deals with the judicial treatment of the administration of parental responsibility, from the point of view of entrusting of minors into care after brake-up of the parents of the minor, whether it is an unmarried or divorcing couple. The first part of the work summarizes briefly the historical development of this issue, the second and third parts describes the current legislation in detail, that has included the Family law back in the Civil Code and that has specified the non-contentious suit by separate procedural laws. The conclusion contains a brief summary and recommendations.

Issues of criminal liability of legal entities

Hudáková, J. Criminal liability of legal persons Criminal liability of legal persons is a significant change to the continental European law. It is a sensible breakthrough into the core principle of an individual criminal responsibility of individuals. In connection with the adoption of Act No. 418/2011 Coll., on the criminal liability of legal persons and proceedings against them, the thesis deals with main aspects of the criminal liability of legal persons in the Czech Republic. After defining of legal grounds of the criminal responsibility author subsequently discusses sanctioning of legal persons. At the same time, the author discusses legal regulation of moral person criminal liability in France. She outlines the principles of criminal liability of legal persons, as well as the conditions for imposing sanctions. The author tries to demonstrate, by means of the attached statistical surveys, the numerous application of this institute in the French legal practice. Finally, the author tries to compare Czech and French legislation in selected aspects.
