Political Reform in the Writings of Bao Tong

(in English): This bachelor thesis deals with the topic of political reform, democratisation and the monopol of Communist Party of China. Political reform and democratisation are two main topics that have been discussed in chinese academical and political discourse since the reforms started in 1978 and are still being discussed nowadays. A main representative who contributes to this discussion is Bao Tong, former member of the highest structures of Communist Party of China who was imprisoned and persecuted after the year 1989 for his liberal political opinions. At the same time Bao Tong still expresses his opinions in the form of political commentaries, essays and interviews. In the bachelor thesis I have analysed Bao Tong's essays related to political reform in contemporary PRC. His essays were printed in a collection published in 2012. I have been working with his texts in Chinese, the outcomes of my analysis are interpreted with relevant literature in English published throughout the last two decades. This topic is very popular also among western scholars. One of the possible contributions to the current discourse could be that my thesis is taking into account Bao Tong who maintained the job as a political consultant to Zhao Ziyang (then general party secretary) and was assigned to draft a plan...
Concept of the Rule of Law in the People's Republic of China

The objective of this Master's thesis is to analyse the term of "rule of law" and its Chinese variations (fazhi 法治 , fazhi 法制 , yifazhiguo 依法治国 ) since establishment of the People's Republic of China until present, with the emphasis on contemporary understanding of the concept, affected by political environment. The concept of the rule of law is presented throughout analysis of collected works of influential political leaders, namely Mao Zedong, Deng Xiaoping, Jiang Zemin and Xi Jinping, reflected in official documents crucial to the legal system, such as the Constitution. Each historical period represents a different stance on the conception of rule of law and position of legal system, which results in analysis of current situation with a prospective future attitude to this issue. The Constitution of the People's Republic of China de iure and de facto

Résumé - anglický jazyk Název diplomové práce v anglickém jazyce: The Constitution of the People's Republic of China de iure and de facto This thesis deals with the issue of the Constitution of the People's Republic of China de iure and de facto. As presumed, the Chinese Constitution de iure does not meet all the requirements for effective constitution of the modern state and that between the Constitution of the PRC de iure and de facto exists a discrepancy relationship, the thesis aims to individually identify and analyze common constitutional and political elements which collectively create a real form of the Chinese Constitution de facto ("living" Constitution), upon which constitutional mechanisms of Chinese political life are based on. The work consists of three chapters, whereupon the work can be divided into two parts. The first part is the theoretical part, where the first chapter deals with defining the term of Constitution itself, whether from a purely normative point of view, as well as from other approaches, especially those from sociological and political science, which are crucial to properly understand the content of the Constitution de facto. Afterwards there is the categorization of various concepts of the Constitution, followed by the classification of different types of the Constiution....
Human Rights in the People's Republic of China under the CCP Chairmanship of Hu Jintao

This work concerns with legislative changes which had direct influence on guarantee of human rights in PRC in the period of Hu Jintao's party chairmanship. Firstly the theoretic base of conception of human rights in PRC and in the world, which has been already compiled by specialists of humanrights and sinologists, is outlined. The specifics of humanright conception in dependency of historical conditions are explained. Then the method of research is introduced and concrete historical connections in given period, which is the basis for evaluation of legislative changes, are explained. These legal changes are analyzed in following chapter. Final summary sums up results, confronts them with initial expectations and presents general principles which are asserted during the formation of a new humanright legislative nowadays.
Comparison of cross-strait relations under the Democratic Progressive Party and after the elections in 2008

The aim of the thesis is to compare the relationship between the People's Republic of China and Taiwan in two consecutive seasons. In the first period from 2000 to 2008, when the Democratic Progressive Party was in power, is Taiwan in constitutional crisis, which has a major impact on mutual relations. Beijing's distrust towards the new president is the cause of the strong cooling of relations especially at the political level. Economic and cultural cooperation is not affected by the political events and develops very positively. After Kuomintang toke over the power after elections in 2008, relations improved rapidly, cooperation between the Kuomintang and the Communist Party of China contributes to that. The dialogue between government agencies for mutual relations is established again, based on the actions of these agencies is concluded many agreements that allow the deepening of cooperation mainly on economic and cultural level. At this time there is a historic improvement in relations.
