Tato bakalářská práce pojednává o formě počítačové kriminality, která využívá škodlivý software zvaný malware. Nastiňuje základy počítačových bezpečnostních hrozeb a vysvětluje relevantní pojmy a koncepty. Poté práce postupuje přes nejběžnější a nejnebezpečnější typy malwaru, přičemž každý z nich popisuje a zároveň začleňuje informace o tom, jak konkrétní druh malwaru ovlivnil svět. Práce se dále zabývá základy detekce malwaru a popisuje, jak se uživatelé mohou chránit pomocí preventivních technik. Cílem práce je vytvořit manuál, který by mohli použít běžní uživatelé počítačů ke své vlastní ochraně před malwarem.

NÁZEV DIPLOMOVÉ PRÁCE V ANGLICKÉM JAZYCE The Criminalization of Cyberattacks on Information Systems ABSTRACT This master thesis deals with the issue of criminalization of attacks on information systems. The topicality of the topic is supported by the rapid development of information and communication technologies and the shift of everyday activities to the virtual environment. Nowadays, cybercrime poses a growing danger not only to individuals but also to the state. The aim of this thesis is to introduce cyberattacks and to classify them criminally. Furthermore, attention is concentrated on the procedural aspect of attacks, in particular on their detection, investigation and the procedure of international cooperation. The transnational and international framework in the fight against cybercrime is not omitted. The thesis seeks to identify what problematic aspects domestic legislation faces and what future developments in the field of cybercrime can be expected. The introductory section explains the basic terms that are used extensively in the thesis. Subsequently, key international instruments in the fight against cybercrime are introduced. Legal Aspects of Fighting Cybercrime

The thesis deals with the topic of computer crime. Foremost, it demonstrates on an example of the operation of a medical image information processing system some selected aspects of this issue. It shows that it is always necessary to monitor the current state of the technical knowledge at the time, but also the need of addressing the issue within the corresponding legal limits. The thesis presents criminal law reality as a complex system. The links between different parts of the system are examined, and possible shortcomings are considered. The legal instruments and legal limits of the procedures that can be used against cybercrime are evaluated. The thesis focuses especially on the issue of obtaining evidence under the Czech Criminal Procedure Code. It presents a proposal on how to understand individual procedural legal institutes and for what purposes and how to use them. Consequently it suggests legal procedures for specific selected practical situations.

Cílem této bakalářské práce je zanalyzovat fenomén zvaný hacktivismus, jeho význam, dopady na společnost a motivaci jeho aktérů. Termín hacktivismus se skládá ze dvou následujících termínů; aktivismus, který bývá ve většině případů politicky motivovaný a hacking, jenž se jedná o kriminální činnost za účelem zneužití chyby nebo nedokonalosti výpočetního systému. Za účelem efektivního dosažení svého cíle, se aktéři hacktivismu, stejně jako jiní aktivisté, většinou organizují do skupin. Práce je též zaměřena na motivaci a následky konání těchto organizovaných skupin, zejména na skupinu s názvem Anonymous, s exemplárními příklady jejich akcí z minulosti.

This bachelor thesis deals with cybercrime in the European Union at present time. It begins with a description of the most well-known historical cybercrimes, which has helped to create cybercrime as a separate branch of crime. Subsequently, the work describes the changes that have occurred in the development of cybercrime, describes the practical problems in prosecuting cybercrime and its current trends. At the same time, it outlines the problems that arise in producing adequate statistics. The practical part of the work then describes the basic function of the application, which was created to work for the purpose of providing information on cybercrime and clear mediation of available statistical information.

Tato bakalářská práce se zabývá koncepcí kybernetické kriminality. Začíná popisem historického vývoje kybernetické kriminality a s ní související počítačové technologie. Práce dále uvádí důvody, proč ke kybernetické kriminalitě dochází, a popisuje kybernetickou kriminalitu z praktičtějšího hlediska, přičemž analyzuje různé typy útoků a útočníků včetně názorných příkladů. Teoretická část práce je zakončena kapitolou věnující se prevenci a detekci kybernetických hrozeb. Účelem praktické části je ukázka jednoduchého Denial of Service útoku.

This thesis is focused on cybercrime, acquisition of evidence and development of a platform for retrieval, analysis and archiving web site data. The goal is to satisfy the investigators and security experts of the Czech police. The aim is to provide an open source platform that will be freely disseminable and in compliance with the requirements of legal institutions. The output of the thesis is two platform versions - full-fledged, fulfilling all the requirements set out in the diploma thesis and a light version for the police investigators of the Czech Republic.

101 Criminal offence of fraud under Section 209 of the Criminal Code, abstract, key words Abstract The subject of the thesis is the criminal offense of fraud under Section § 209 of the Criminal Code. The thesis focuses on the analysis of the relevant legal regulation, the systematic classification of the criminal offense of fraud, analysis of the constituent elements of the criminal offense, the comparison of the criminal offense of fraud with other criminal offenses against property, and the presentation of proposals de lege ferenda responding to the current regulation of the criminal offense of fraud. The thesis also examines the criminal offense of fraud from a criminological and forensic perspective and further from the perspective of cybercrime. The thesis is divided into 6 sections and which are further subdivided into individual chapters, sub-chapters, sections, and subsections. In the first section of the thesis, the criminal offense of fraud is systematically incorporated into the Criminal Code among other criminal offenses against property. Criminal and criminological aspects of the phishing Abstract Present thesis is aimed on analysis of criminal and criminological aspects of phishing. While gathering the literature resources lack of studies systematically describing the problematic of phishing was discovered even though phishing is one of the most common cybernetical crimes and represents a significant thread for users of cyberspace. Czech literature is especially lacking studies concerning criminological aspects of phishing. This thesis is divided to two parts - criminological and criminal. This thesis presents complex description of phishing including its evolution and process of refinement. In the first part phishing as a phenomenon and also its history and types evolving with time are described. The aim of this thesis is to evaluate the trend of number of phishing attacks and to determine whether its increasing, decreasing or level. Given the human interactions in cyberspace increasing trend is expected. In the next part characteristics and motivation of offender, characteristics of the victim and possibilities of prevention are discussed.
