Criminalistic theory of victims of crime
Kallabová, Markéta ; Musil, Jan (advisor) ; Krupička, Jiří (referee)
1 Criminalistic theory of victims of crime Abstract The diploma thesis focused on Criminalization of Crime Victims deals with the issue of victims from the perspective of criminalistic victimology, which is a relatively young field examining the victim in terms of its impact on the crime investigation process, in connection with victimology findings. The thesis is divided into introduction, conclusion and four chapters, which provide insight into the issues of criminalistic victimology. The first chapter is devoted to the primary characteristics of the concerned field, including the definition of basic terms. In particular, the work deals with the victim of crime, its legal basis and description of rights that are guaranteed by Victims of Crime Act. Furthermore, the work discusses the concept of vulnerability and the process of victimization, where the thesis focuses mainly on secondary victimization, its sources and impacts. The second chapter in all its subchapters focuses on the subject of criminalistic victimology. Firstly, the thesis deals with the role of the victim in the genesis of the offense and with the importance of the victim's relationship with the perpetrator. The work also deals with material and memory traces of which the victim is the originator and the holder, and which are a valuable...
Methods of investigation of murders (selected issues)
Polívková, Lucie ; Štourač, Petr (advisor) ; Krupička, Jiří (referee)
in English The topic of the thesis is the " The Methodology of Investigation of Murders (selected issues)". The topic is too broad for the limited capacity of the dissertation. While writing the thesis, after the necessary theoretical introduction (which contains the definition of crimes against life, medical definition of death, etc.), I focused only on the initial stage of the investigation of the crime of murder. I specifically focused on the discovery of the body, on securing the crime scene, on autopsy and on the demarcation of investigative versions. Next stage of the investigation is only briefly summarized in the ninth chapter. The thesis is divided into ten chapters. The first chapter explains basic terms, especially murder, murder of a newborn baby by its mother and other crimes against life, such as manslaughter, negligent homicide and assistance to suicide. This chapter also includes medical definition of death, and a brief description of the post-mortem changes. The second chapter consists of brief statistics on the number of murders in the Czech Republic between the periods 2000 to 2012. It contains two graphs; the first graph shows the evolution of the total number of murders each year and their solving. The second graph divides murders according to the specific motives. The third...
Crimes of murder and manslaughter under sections 140 and 141 of the Czech criminal code
Honzík, Jakub ; Hořák, Jaromír (advisor) ; Krupička, Jiří (referee)
(ENG) Crimes of murder and manslaughter under sections 140 and 141 of the Czech criminal code The main objective of this work is to provide a comprehensive analysis of the codification of crimes of murder and manslaughter. The last recodification from the year of 2009 brought some significant changes into the area of intentional killings, the most important of which is an increased differentiation in the typology of these crimes. The Czech criminal code now differentiates between murder, premeditated murder and manslaughter. These changes can be seen as part of an effort by the Czech legislature to modernize the criminal law along the lines of legal systems typical in Western Europe. On the other hand, it can also be argued that the new Czech codification preserves its unique approach to certain problems. This thesis analyzes individual parts of sections of the Czech criminal code concerned with murder and manslaughter in a systematic manner. The first chapter deals with the historical context of intentional killings as well as providing an analysis of the new arrangement. Chapter two follows by introducing features common along all three types of intentional killings, specifically the actus reus of the crime. The following chapters then describe the different approaches towards intentional...
Identification of cadavers and skeleton findings
Voráčová, Kateřina ; Krupička, Jiří (advisor) ; Konrád, Zdeněk (referee)
Abstract/Summary The discovery of a cadaver or skeletal remains (hereinafter the "Remains") raises a number of questions, one of which is the matter of the identity of the remains. The answer to this particular question can be found through forensic identification and utilization of one of the methods thereof. The aim of my thesis is to provide a brief overview of the methods which are currently most commonly used for the purposes of identifying Remains and introduce the reader to their basics, options and limitations. In order to ensure a better understanding of the subject, I have included a section concerning the Remains and the post-mortem changes thereof. In this thesis, I will focus only on those parts of scientific fields, which are relevant for identification of the Remains, and, similarly with respect to information systems, I target only the information being collected and analyzed by such systems in cases of Remains whose identity is not know. In this thesis, I have chosen to proceed from general terms, division of forensic identification, activities being carried out upon the discovery of the Remains, to the individual methods of identification, information system and practical case studies. The thesis is divided into ten chapters. In the first chapter, I address the subject of general terms...
Analysis of essentiality of glmM gene coding for phosphoglucosamine mutase of Streptococcus pneumoniae.
Krupička, Jiří ; Branny, Pavel (advisor) ; Čáp, Michal (referee)
Phosphoglucosamine mutase (GlmM) is an enzyme of bacterial cell wall biosynthesis. The main aim of this thesis was to find out, whether gene glmM is essential for viability of Streptococcus pneumoniae. Therefore, we prepared merodiploid strain containing two copies of glmM; the genomic gene and ectopic copy under control of zinc inducible promoter. Subsequently, depletion strain was prepared by deletion of genomic copy of glmM. This strain was further used for analysis of viability and phenotype features in the medium containing various concentrations of zinc ions, an inducer of ectopic glmM expression. We found out, that the viability of this strain was strictly dependent on the concentration of inducer and further, that depletion of GlmM resulted in remarkable morphological defects. The rescue of mutant strain was observed after addition of inducer up to the level of the control sample. These results have provided the evidence of glmM essentiality for S. pneumoniae viability. Furthermore, we analyzed, whether phosphorylation of key amino acid residues, S99 and S101, is essential for GlmM functionality. Four different strains were prepared by means of site-directed mutagenesis expressing glmM with substitutions of key serine residues for alanine or glutamic acid. Since deletion of chromosomal locus in...
Non-conventional bacterial signaling pathways
Krupička, Jiří ; Branny, Pavel (advisor) ; Beranová, Jana (referee)
Two component systems were traditionally considered as main phosphorylation systems of bacteria involved in cell signalling. Recently, attention focuses increasingly on bacterial eukaryote-like Ser/Thr protein kinases (eSTKs). These protein kinases are structurally similar to their eukaryotic counterparts. Some eSTKs possess additional domains such as extracellular PASTA domains that were discovered in a variety of gram-positive bacteria. It has been proved that these domains can act as sensors for unlinked peptidoglycan fragments. However, majority of environmental signal molecules still remains unknown. eSTKs phosphorylate a broad spectrum of substrates including proteins involved in various cell processes such as virulence, cell wall biosynthesis, cell division, and central and secondary metabolism. Cross talk between eSTKs and two component systems also occurs. In this thesis, the current knowledge about eSTKs and their significant substrates in different bacterial species is discussed.
The Scope of the Prosecutor in the Preliminary Criminal Proceedings
Petr, Milan ; Říha, Jiří (advisor) ; Krupička, Jiří (referee)
Resumé This thesis titled The Scope of the Prosecutor in the Preliminary Criminal Proceedings presents a compact view on the prosecutor's role and activities in the preliminary proceedings. At this stage, the prosecutor has a vital role and is regarded as the master of the preliminary proceedings (dominus litis), for he carries the ultimate responsibility for its results. In the court proceedings, where he is accorded the party status, the prosecutor represents the public prosecution. In relation to the police authorities, the prosecutor has a number of privileges that enable him to supervise the adherence of legality in the preliminary proceedings. The work is divided into four main chapters. The first chapter discusses the legal base of prosecution as a body of public prosecution in the criminal proceedings. This chapter also characterizes the institute of external and internal supervision within the system of prosecution. The second chapter defines the preliminary proceedings as an obligatory, pre-trial part of every criminal proceeding. Furthermore, this chapter elaborates individual functions of the preliminary proceedings, including its forms and stages. The core of the thesis is the third chapter, which defines the actual scope of the prosecutor. First, this part deals with the prosecutor's...
The use of psychology in crime investigation with a focus on criminal profiling psychology of interrogation
Rychetská, Anna-Marie ; Čírtková, Ludmila (advisor) ; Krupička, Jiří (referee)
The use of psychology in crime investigation with a focus on criminal profiling psychology of interrogation. Abstract This paper deals with some forms of usage of forensic psychology in investigative practice. Forensic psychology is subfield of psychology that deals with its usage in law practice. This paper describes historical milestones in this field. Furthermore, this thesis describes legal institutes that enable the use of forensic psychology in practice. After this introduction, the remaining part of the thesis is dedicated to selected forms of practical usage of forensic psychology. Specifically, these forms are criminal profiling and psychology of interviewing. Criminal profiling is a newer method that, based on the evidence found, creates presume profile of the offender. This profile usually contains data on the offender's age, gender, possible employment, and social integration of the offender. The profile can also focus on geographical distribution of crime scenes and based on them the profile can determine the area of probable home residence of the offender. Both these variants are described in section dedicated to criminal profiling. Historical development of this field is also described along with some of the studies devoted to this field that have taken place over the years. The thesis points...
Methodology of investigation of the criminal act of robbery
Vrkotová, Alice ; Jelínek, Jiří (advisor) ; Krupička, Jiří (referee)
My thesis entitled "Methodology of investigation of the criminal act of robbery" focuses on the individual steps undertaken by the police from the moment the offence is reported until the prosecution is filed with the state attorney. The main focus of my work is to describe, in the greatest detail possible and with attention to the given practice and formal faultlessness, the most important procedural steps, both in the verification phase, i.e. prior to the commencement of the criminal prosecution, and in the phase of investigation. A particular emphasis is placed on the examination of the crime scene and subsequent criminological evaluation thereof. The thesis comprises six chapters; the therd chapter discusses initial verification acts, from the commencement of the criminal procedure according to section 158, paragraph 3 of the penal code, treatment of the victims, particularly the above mentioned examination of the crime scene. The fourth chapter that discusses investigation is crucial. The chapter outlines the individual steps of the investigator in logical sequence, i.e. decision about the commencement of the criminal prosecution (section 160 of the penal code, interview with the accused and witnesses, criminological examination of the tracks collected at the crime scene or uncovered as part...
Fingerprinting - Past, Present and Future
Semera, Lukáš ; Krupička, Jiří (advisor) ; Konrád, Zdeněk (referee)
FINGERPRINTING - PAST, PRESENT AND FUTURE The objective of this thesis is to present the forensic fingerprinting as a scientific method which, although in comparison with other forensic sciences being one of the oldest, is not out-dated at all, quite to the contrary - it presents an ever-changing and continuously developing field of science. The objective is approached through three distinctive and yet intertwined chapters corresponding with the title of the thesis - past, present and future of the fingerprinting. They are also designed, at least in part, to capture this constant forward motion. Accordingly, the first chapter aims to describe briefly scientific roots of the method, the way it drew in its beginnings from various scientific discoveries, inspired by the rise of Darwinism. Particular emphasis is put on the description of the formulation and empirical confirmation of three physiological laws of fingerprinting that even today serve as its grounds. The second chapter deals with and tries to describe the current state of knowledge and particular methods used in detection, development and preservation of fingerprints, especially latent ones. To do this it seems to be necessary to describe briefly the anatomy and physiology of friction ridge skin, as it enables to fully comprehend the way in...
