Forced Labour in the Czech Republic

Forced Labour in the Czech Republic Abstract The submitted dissertation thesis examines so far neglected issue of forced labour in the Czech Republic in its complexity, i.e. both its lawful (e.g. work performed by imprisoned persons) and unlawful forms. It seeks to discover whether the present law (and extra-legal regulation) on this topic is sufficient. For this purpose it examines not only the corresponding law across individual branches of law, but also its place in the historical and moral- philosophical context. In the first parts, the submitted thesis deals with the existence of free will as a precondition of considering a work freely chosen and with the existence and content of objective morality as a precondition of considering anything morally right. Special attention is dedicated to forced labour during Protectorate and communist regime in Czechoslovakia. The core parts of the submitted thesis consist of an analysis of corresponding international, European and national law. 1 "Social assistance for seniors" Abstract The rigorous thesis aims at the theme of social services and care allowance in connection to care towards specific social services clients who are the elderly. The aging of population is the very actual topic not only in the Czech Republic but also abroad. The Czech population grows. However, the growth within the group of elderly is considerable compared to others. According to the forecasts, the population will still be getting older, and that will result in a greater need for care of the elderly. The rigorous thesis consists of six parts. The first chapter deals with the aging and old age, including the ageism phenomenon, and outlines social assistance for the elderly as a part of the social security system of the Czech Republic. The second chapter aims at social services not only from the view of users (the elderly) but also of social services providers. The author has tried to analyse the potential difficulties of social work. The system of social services financing is also mentioned. The third chapter describes care allowance, eligibility for it, its control, and use. Social care for the elderly Abstract The thesis deals with the issue of social care in the Czech Republic with regard to persons in retirement age. The main aim of this diploma thesis was to summarize the basic facts about this care and to provide the reader with a clear list of possible improvements or alternatives of social care for the elderly in various social security areas. In the introductory part, the paper first examines whether there is a need to address this topic and whether the Czech population is really getting old. These hypotheses have been confirmed on the basis of statistical data. This analysis also showed that resolving aging in the Czech Republic can solve support for family care. This form of care is the cheapest and easiest form of care in the Czech cultural and social environment. For this reason, the second chapter examines specifically family care in the Czech Republic. It deals first with the advantages and disadvantages of family care, then mentions the issue of gender imbalance in providing this care and the contemporary phenomenon of the sandwich generation. Legislation of the women's position on labor market Abstract The aim of this thesis called "Legislation of the women's situation on labor market" is to describe not only current situation but also historic progression of women's position in employment relations. It is focused on the regulation of equal treatment and the prohibition of discrimination in international law, European law and Czech law and also on special working conditions of women, which are established for protection of female employees during pregnancy and maternity. I also try to acquaint readers with judicial decisions in this area. Women's situation on labor market was not always great and they had to fought for better position. Traditional arrangement where house keeping and raising kids is naturally considered as women's responsibility is still common in most families. That is why lots of women have to learn how to coordinate mother's role and their job. My thesis is divided into five chapters. First chapter is dedicated to evolution of women's position in society and on labor market from 19th century to the period after Velvet revolution in 1989. Social services for persons dependent on care in the light of the Czech legislation Abstract The diploma thesis deals with the issue of social services in the Czech Republic especially for persons with disabilities. The thesis focuses on current issues that arise due to partial amendments to the Social Services Act and the Act on the Provision of Benefits for Persons with Disabilities. In particular, the thesis is concerned with the topicality and sufficiency of social services and the benefits provided to disabled people. The thesis itself is divided into 10 chapters and further subchapters. Firstly, the topic is set in the historical context and the history of social services from their first occurrences to the present is approached. Further, the division of social security and the inclusion of social services into this system are described in more detail. As the thesis is primarily focused on people with disabilities, the following chapter defines disability and presents different views on it. Following issues include benefits for people with disabilities as well as other related non-financial benefits for them. The possibility of measuring social exclusion of homeless

The thesis (rigorous work) is engaged in possibilities of displaced persons social exclusion measurement and was created on the recommendation of the Examination Board by extending and supplementing the diploma thesis. The first chapter contains definitions of terms used in the thesis. The following chapter comprises abriged and modified translation of methodology manual of Indicators of poverty and social exclusion, so-called Laeken indicators. In the third chapter there is described role of the Czech Statistical Office from the perspective of Law on State Statistic Service and in relation with homelessness. The next chapter describes history of homelessness, its typology and several aspects of different social science disciplines. The thesis is supplemented by the approach to homelessness in the 70s of the last century in the context of the crime of subsistence. The last chapter describes selected social transfers provided in the Czech Republic and designed tool for measurement of social exclusion resulting in an index of relative social exclusion.
Equal treatment and prohibited discrimination against employees

The aim of my thesis entitled Equal treatment and prohibited discrimination against employees is to provide a complete view of international, European and Czech legislation on this topic and inform about how to protect oneself against discrimination. The thesis is divided into four chapters. The first chapter is general. It deals with basic concepts relevant to this area, such as equality, equal treatment, discrimination and its types and others. The second chapter focuses on the most important international treaties regulating equal treatment and discrimination in labour-management relations. It has three parts and each part consists of conventions adopted by one international organization - The United Nations, International Labour Organization and Council of Europe. The third chapter concentrates on the legislation of European Union, both primary and secondary legislation and also deals with judgements of European Court of Justice. The fourth chapter is concentrated on Czech legislation which deals with the principles of equal treatment and prohibition of discrimination of employees, at first place on Anti - discrimination Act. This chapter also treats with various means of protection available to victims of discrimination.
The formation and development of social security law in the territory of the Czech state

The main theme of this thesis is to capture formation and development of the social security system that provides hedging of individuals against illness, invalidity and old age. The first modern form of the social security within the area of Czech state appeared at the end of 18th century in the form of so called Theresian and Josephinian pension normals. These normals were designed to secure retired state officers against poverty. In the late 19th century were adopted two important norms - law concerning accident insurance and law about sickness insurance for workers. Pension insurance program for workers, the largest social group, was established as late as 1924. The Social security system was split among several offices, also insufficiently hedged by steady incomes in wage-workers and miners insurance; as a consequence it led to indebtedness of the system. During the occupation period, the financial funds were devaluated, appeared some organization changes and the new way of conviction about suitability of whole-society pension and sickness insurance was applied. Modern law about national insurance from year 1948 was canceled during the totality era. The reason was to apply soviet model of social security. Discrimination against certain groups of employees This diploma thesis deals with problems of discrimination and its legislation in labour relations in national, european and international law. At first, I describe discrimination in general, than I focus on discrimination based on age. The thesis is composed of seven chapters. The first chapter briefly defines basic terminology used in the thesis such as term "discrimination", describes prohibited reasons for discrimination, explains forms and types of discrimination, deals with the term "equality" and concentrates on various types of equality. Chapter Two examines relevant Czech legislation of this legal area. In the Czech republic, the prohibition of discrimination is contained in many legal standards. The third chapter concentrates on relevant international legislation of discrimination. It is subdivided into several parts and each part describes one important international act for protection against discrimination. Relevant european legislation is analyzed in chapter Four. Primary and secondary legislation are described in this chapter.
