Offender-victim settlement in criminal procedure

S ohledem na dosud uvedene je patrne, že zavedeni institutu narovnani představuje novou strategii zpracovani konfliktu z pohledu trestniho prava. Standardni trestni řizeni se odehrava zejmena ve znameni rozsahleho dokazovani za účelem prokazani viny a nasledneho odsouzeni a potrestani pachatele trestneho činu a často v jeho ramci dochazi pouze ke zohledňovani naroků poškozenych namisto jejich realneho odškodněni. Naproti tomu v řizeni o schvaleni narovnani jde především o vzajemnou komunikaci obviněneho a poškozeneho za učelem znovunastoleni smirnych socialnich podminek, převzeti osobni odpovědnosti ze strany obviněného a v jehož ramci tež dochazi k uplnemu a realnemu odškodněni poškozeneho. I přes pravě zminěne vyhody je institut narovnani od sameho počatku jeho zavedeni v praxi využivan minimalně. Ve skutečnosti je tedy zaměr zakonodarce zjednodušit, zrychlit a zhospodarnit trestni řizeni daleko od sveho naplněni, alespoň pokud jde o institut narovnani. Odbornou veřejnosti vytykany nedostatek v upravě tohoto institutu, tedy nemožnost schvaleni narovnani v připravnem řizeni statnim zastupcem, byl odstraněn novelou trestniho řadu provedenou zakonem č. 265/2001 Sb. Ovšem ani v následujícím obdobi se četnost využiti tohoto institutu v praxi nikterak nezvyšila a stale zůstava zanedbatelna oproti druhemu typu...

Women artists in Bohemia in the nineteenth century

The thesis consists of three chapters, which aim to describe and summarize the pivotal themes, important for the history of female art in Bohemia, i. e. questions of their origin, art education, placement and reception of their art in the temporary criticism. The first chapter inquires into forms of the artistic education according to the kinds of the social origin of the women. Separately it describes the issues of education for professional women artists and women of noble birth. A special attention is paid to the theme of an organized training in visual arts, which was provided by private arts schools at first. An important position among them had the school of drawing for ladies, founded by the painter Amalia Manes in 1853. The essay suggests some circumstances realting to this private school. In the 1860's the art education went through a considerable progress, when a new forms of art teaching were created, based mostly on arts and crafts aims. Considering the fact they arouse about twenty years before establishment the Arts and crafts school in Prague, where they on a relative high level. On the New Definition of Injured Party’s Fiduciary

Regarding adoption of the Act No. 45/2013 Coll., Victim of Crime Act, was also conducted extensive amendments to the Code of Criminal Procedure, which among others significantly affected the position of the injured party in the criminal proceedings. The most significant changes, however, were made in regulating of the legal status of the representative of the injured. The purpose of this paper is not only to give information with respect to the changes in the legislation, but also to stimulate discussion on some particular issues which will be probably the subject of interest in the future of the courts and subsequently other possible legislative changes.
