V souvislosti s přijetím zákona č. 45/2013 Sb., o obětech trestných činů a o změně některých zákonů, byla provedena také poměrně rozsáhlá novelizace trestního řádu, která se mimo jiné významně dotkla postavení poškozeného. Nejvýznamnější změny však byly provedeny v úpravě postavení a práv zmocněnce poškozeného. Smyslem tohoto příspěvku je nejen podat informaci o předmětných změnách v právní úpravě, ale také podnítit diskusi zejména k některým v něm naznačeným problémům, které budou zřejmě v budoucnosti předmětem zájmu soudní judikatury a následně i dalších možných legislativních změn. Regarding adoption of the Act No. 45/2013 Coll., Victim of Crime Act, was also conducted extensive amendments to the Code of Criminal Procedure, which among others significantly affected the position of the injured party in the criminal proceedings. The most significant changes, however, were made in regulating of the legal status of the representative of the injured. The purpose of this paper is not only to give information with respect to the changes in the legislation, but also to stimulate discussion on some particular issues which will be probably the subject of interest in the future of the courts and subsequently other possible legislative changes.
