Debt Security and Recovery from Business Relations

The thesis deals with the debt security and recovery from business relations. The main purpose was to explain the issue of debts, to compare classic judicial proceedings with arbitration and to analyse particular legal cases of the company XY in terms of security and recovery. The result is the evaluation of company's legal steps and efficiency of used security instruments, the summary of advantages and disadvantages of the arbitration and the overview of the most frequent practical problems with potential solution proposal.
Solutions of disputes in the area of consumer contracts

The aim of this work with a title Solution of disputes in the area of customers contracts was desribed, analyzed and compared economic a legal aspects, advantages and disadvantages by the solution of customers contract in the arbitration and in the lawsuit. Next aim was comparison the czech law with the law in Slovakia, when it was turned to the arbitration and disputes in the area of customers contracts. Then there was desribed and analyzed the problems of the arbitration centre position and the custumers contrancts with arbitration clause, according to the law effective before and after the day of the 1 st April 2012. In conclusion there was defined some changes in legislation.
Alternative Dispute Resolution

The aim of the thesis is an analysis of ADR among Czech consumers and consumer Czech and Czech dealer. ADR System Analysis is performed using a questionnaire survey among respondents - consumers and controlled depth interviews with the staff of ADR. Based on analysis of collected data will be provided suggestions for improvement.
Alternative Dispute Resolution

The project of ?Alternative dispute resolution? imports an innovative and effective instrument of consumer protection to the Czech Republic. The ADR works in Czech Republic since 2008. The whole procedure is easy and it is not obligatory for adverse parties. There are three methods of disputes resolution: qualified counsel, mediation and arbitration. Concerning mediation, the problem is the willingness of the procedure. That is the reason, why more than 80 % of delivered suggestions end with non-cooperation from the adverse party. Even if an agreement were found during the mediation, this agreement is not binding. Arbitration is on payment and most of the consumers identify it with the juridical process. But in case of arbitration, the resulting arbitration award is binding for both adverse parties. The fee is paid by the party who has lost the dispute. The work focuses above all on the awareness of ADR and on consumers´ rights. The work revealed that a quarter of all respondents don´t know their rights. The awareness of ADR is very poor also. The research results showed that only 14.4 % of respondents know what ADR is. Nevertheless, the results from the period of 1st April 2011 to 31st January 2012 show, that the project has a future, because the statistics of registered cases have a rising tendency. But without an effective publicity, it will take a long time before the consumers´ awareness of this possibility extends. The Ministry of industry and commerce issued an informative leaflet within the pilot period of the project. However, it was not distributed to the consumers in the right way. In the Czech Republic, there is a lack of consumers´ education due to a difficult access to legal regulation. The legislation is for a Czech consumer hardly findable but above all, it is incomprehensible. Nowadays, fortunately there exist a lot of web sites where all needed information can be found rapidly and in a shorter version. Due to my own experience I know, that an overwhelming majority of consumers looks for advices only after they did not succeed with a claim or after another problem with a vendor occurred.

Defines the various types of derivatives, their history and development of currency futures and forward contracts in the CR and in the world. Another part is devoted to the use of currency futures and forwards in the business in the Czech Republic. The thesis is to evaluate the evolution of exchange rates EUR/CZK and USD/CZK.
Alternative dispute resolution with emphasis on consumer protection

The thesis describes the concept of alternative dispute resolution (ADR) and it's various methods in the theoretical introduction. It describes the new draft law on mediation and the amendment to the Arbitration Code. Then it focuses on the methods of ADR concerning consumer disputes, and finds that not all of them are actually used. For example the ADR Project run by the Ministry of Industry and Trade has never been used much and is currently in decline. Neither the institute of the Financial Arbiter is a key venue for consumer disputes resolution. In the practical part relatively frequent use of the arbitration proceedings is found. The thesis provides practical analysis of several factual contracts, interviews with judges and practitioners as well as other findings from the scientific debate concerning the appropriateness and dangers of arbitration in consumer disputes.
Comparision of legal regulation of arbitration in the Czech Republic and Spain

The bachelor thesis deals with legal regulation of arbitration. The main aim of the work is to explain the concept of arbitration and compare legal regulation of arbitration in the Czech Republic and Spain. The work is divided into three chapters. The first chapter acquaint reader with actual legislation in selected countries. The second chapter describes basic institutes of arbitration such as arbitration agreement, arbitrator, arbitration proceedings itself, arbitral award and his review. The last part of the work is focused on the use of arbitration in consumer disputes.

In second part of thesis are mentioned most frequent consumer problems in common life and an offer of their solutions.
The use of arbitration in consumer disputes

First, the mechanism of arbitration in the Czech Republic is described, then the way how consumers can be protected in case they conclude an arbitration contract. Finally, it is explained how the arbitration is used in some of the European countries and what approach to consumer protection they apply in this field.
