The institution of obstacles at work under Czech labour law

in English Obstacles to work as a set of legal facts have fundamental influence on employment relations and concern each and every employee as well as employer (correlatively). The goal of this thesis was to explore this area of employment law thoroughly and to indicate individual rights and duties of both parties in employment relations, including those which surpass the Labour Code and its implementing legislation. This was to be accomplished by providing a comprehensive treatise on the subject with solutions to possible unexpected situations not covered in the Labour Code. Obstacles to work are defined as legally acknowledged circumstances that - on the part of the employee - impede or forbid the performance of work, and - on the part of the employer - impede or forbid the assignment of work, in cases when the employee"s absence from work is excused by the employer in compliance with the terms stated by employment laws, internal regulations or employment contract. Compensatory wage or salary and conditions of payment to idle workers are determined by the above-mentioned documents. Social security and legal protection connected to maternity in the Czech Republic and the European Union The thesis gives an updated overview of the current situation for pregnant women, women on maternity leave and parents on parental leave, including the protection of their rights provided by the employment laws in the Czech Republic and the European Union. It aims to reflect the changed situation due to current crucial changes in the law. The thesis is composed of an introduction, the main text and a general summary. The main text is divided into two parts, first part deals with the Czech legislation and the second part with the European law and its impact on the national laws of the member states. It covers the development of social policy issues both in the Czech Republic and at the European level and continues discussing current legislation concerning maternity leave and benefits, parental leave and benefits, paternity leave, maternity grants and also the labour protection of pregnant women, breastfeeding women and parents with young children. It also compares national legislation of member states regarding maternity and parental issues.
The conditions of university - educated mothers of little children re-entering the labour market in the Czech republic.

Diploma thesis "The conditions of university - educated mothers of little children re- entering the labour market in the Czech republic" deals with reasons of long term interruption of qualified womens' career. The most frequently, they stay at home taking care of children three years, inspite of the fact, that they are motivated by their human capital and their need of self fulfillment to get back to their job as soon as possible. The thesis is based on the assumption that there is a substantial tension between work and family life of university - educated women. The thesis identifies which factors influence the period these women stay away the labour market. Besides a human capital, there is a frame of the family and institutional policy, a kind of household division of labour and culture context. The thesis focuses on tertiary - educated mothers' preference on their professional and household engagement. It also focuses on structural conditions in the labour market, institutional policy and the role of employer in reconciliation of work and family life. The thesis brings a contribution for its focus on university - educated women with their specific characteristics, and for its focus on employers' family - friendly activities.
Involvement of fathers in child care

This thesis deals with issue of involvement fathers in child care and their institutional support by the family policy of the Czech Republic - especially maternity, paternity and parental leave as arrangements allowing parents to harmonize work and family. The text is focused on forms of these arrangements with emphasis on the role of father, and their influence on the distribution of gender roles within family. The paper introduces the reader to the current setting of the Czech family policy. The text analyzes the reason why to promote active fatherhood and according to analysis of documents is pointed out to the general ways, which may lead to increase in the percentage of men taking a parental leave. After that the phenomenon of active fatherhood is situated into the context of the European Union and current trends in this area. The paper implies, that the current adjustments of family policy in the Czech Republic does not provide sufficient motivation for the fathers and highlights the key issues in this area. Based on the findings of expert interviews recommendations for the Czech Republic are formulated.
The fathers on parental leave in the Czech Republic

This diploma work is focused on the situation of fathers on parental leave in the Czech Republic. The aim of research is to find out how fathers feel on their parental leave, what is positive or negative for them and how they evaluate this experience. The theoretical part describes the legislative framework of parental leave and parental allowance and explains the concepts such as femininity, masculinity, maternity and paternity. Then I deal with gender stereotypes and situation on the labour market, and their influences on the decision for starting parental leave. Then I formulate arguments for more father's participation in taking care of children. The empirical part is focused on a qualitative research. The research was realized by interviews done with 10 fathers on parental leaves, and analyzed by coding. Then I made a connection between new data and theoretical resources which are described in the first part. At the end I indicate the posibility of doins some other research, for example with both parents.
Educational attainment as a factor enabling flexible working arrangements for women on maternity leave in the Czech Republic

Presented work analyzes the influence of educational attainment in comparison with other factors that enable women on maternity or parental leave in the Czech Republic to actively participate in the labour market using flexible working arrangements. There are subjective and objective factors that may influence decisions of women active in the labour market. The work describes in detail following: selected tools of the social politics, cultural influence, preferences of individual women, need of another income in the household or division of labour with the partner. These influences are examined on examples of particular women using a method of semistructured interviews in qualitative survey. This work is compared with statistical data and relevant results of existing surveys. An assumption of presented work is the fact, that women with a higher education are better equipped to use possible options of available flexible working arrangements. The results of this survey confirm the assumption to a certain level, however it points also to other factors that are at least of the same importance as the level of attained education.
Family policy in the Czech Republic and services of care about children in the pre-school age

v anglickém jazyce Family policy in the Czech Republic and services of childcare for children of pre-school age This master's degree thesis deals with family policy, in particular with the institutional provisions of childcare services for children of pre-school age, their legislative framework and potential future development. The goal is to find out whether the current legislation of childcare services sufficiently reflects the needs of parents, given demographic developments and the existing socio-cultural and economic context. The first chapter characterizes the current context of family policy in the Czech Republic: We are experiencing rising fertility rates, while people realize parenthood at later stages of their lives. In addition, opinion polls show that 50% of families desire an egalitarian family model with an equal distribution of childcare responsibilities between both parents, thus allowing for the professional development of each. In reality, however, women usually lower their professional ambitions and stay at home taking care of the children. The second chapter suggests that the discrepancy between the desired and the actually practiced family model is a result of existing family policies in the Czech Republic, which prefer the model of the father as the breadwinner and the mother...
Welfare of women during maternity and parental leave

This thesis focuses on the welfare system of women during maternity and parental leave, primarily for specific benefits, which are in maternity and parenthood provided. System of state social support to women subject to conditions childbirth, child benefits and parental pay. For the childbirth, the work highlights specific situations that may arise in life. They are taking a child into permanent parental care, surrogate motherhood and the death of a child. For child benefits is given consideration above its level and subsequently at the parental pay instance of fraudulent conduct involving the unauthorized receipt of benefits or readers are informed on the progress of the amendment to the law on state social support. Sickness insurance system is provided benefit maternity pay, for example, which analysed the possible claim women on maternity benefits in specific situations (pregnant student, pregnant person exercising custodial sentence, etc.). For each benefit is each explained the general conditions for entitlement to, and also its amount. Although the work is devoted mainly to women, and a separate section of this paper deals with the men and their opportunities to take the place of women and care for the child.
