Consumer protection in area of banking services

The thesis analyses contractual relations between bank clients and banks with detailed focusing on discretions and duties with regard to type of banking products, and also identifies potential risks rising from contractual relations. Based on conclusions formed in theoretical and praktical part of the thesis it forms general recommendations and summary view on comsumer protection in area of banking services.

Educational support in employment sphere of persons with mild mental disability

Nowadays people with light mental disability are preparing for their future career mainly in apprentice vocational schools and in two-year remedial practical schools. Competence which should be gained during studies is defined in Curriculum which is in obedience to Law No.561/2004 of Legal Code, Education Law, Ministry of Education System, Youth and Sports. Acquired output competence could help graduates to find employment in a protected labour market or ideally in an open labour market. However, people with light mental disability count among the group of people that is strongly endangered by unemployment. The reason of that fact could be, like in case of other groups endangered by unemployment, an insufficient personality or vocational training. Purposeful educational activities, for example retraining courses or job clubs financed or organized by job centres, are the solution to this situation. The group of disabled people is very specific, that is why we have to follow special educational methods and it is necessary to adapt a content and organization. These activities should be realized by remedial teachers. The goal of the thesis is to suggest ways of remedial teaching support in the area of employment of light mental disabled people. To reach the goal of the thesis, it is necessary to define the target group and characterize its specific in the area of education and social integration that is connected with opportunity and ability of finding employment. The specific feature of mental development is slower data processing, insufficiently developed logical thinking, worsened memory, short-term attention, worsened ability of analysis and synthesis, difficulties with understanding of expressive part of speech, emotional instability, insufficient willingness. In social area there are difficulties with making and maintaining social contacts, problems with understanding of social roles, complicated building of own identity and social status, danger of stigma of disabled people. To meet the goal of the thesis - to suggest ways of remedial teaching support in the area of employment of light mental disabled people, the further part of the thesis deals with vocational training of the target group, which is mainly educated in apprentice vocational schools and two-year remedial practical schools. Both types of schools are briefly characterized and then the key and vocational competence defined in Curriculum, which should be gained by graduates, is specified. There is competence of learning, competence of solving problems, communicative, social and personal competence, civic competence, work (employment) competence, in apprentice vocational schools also mathematical competence and competence of information and communication technology and dealing with information. Vocational competence is defined according to the type of school and in apprentice vocational schools the vocational competence is defined in according to the branch of study. The third part of the thesis is focused on importance of employment as the main motivational element for the light mental disabled people. The present forms of specific employment support, which deepen competence and follow in competence gained in mentioned schools and so it is important in the system of vocational training, are described. It is about supported employment, transit program and job clubs.

Práce obsahuje rozbor části zákona č. 218/2002 Sb., ve znění pozdějších předpisů a komparaci se slovenským zákonem č. 312/2001 Z.z., ve znění pozdějších předpisů. Práce nastiňuje vývoj právní úpravy služebních poměrů v ČR do budoucna.

Sanctions for Breaching the Obligations within Employment Law Relationships

The author conceives the presented thesis partly as a case study, when she illustrates different aspects of sanctions on a practical example defined for the purposes of this work. Furthermore, she maps different kinds of aspects related to analyzed sanctions. The thesis is divided into the introduction, five main chapters and the conclusion. Overall, the work has two parts, the first one is the introduction and the first chapter, second part consists of the definition of the practical example, from which it derives, then the second, the third, the fourth and the fifth chapter and the conclusion. In a brief introduction, the author has a think about the meaning of general terms such an obligation, a legal obligation and sanctions for breaching duties. The first chapter contains a definition of terms that are analyzed further in the work. Furthermore, the chapter continues with the general definition of sanctions, particularly from the perspective of legal theory, including the attempt on the author's own definition of sanctions. As an introduction to another part of the work is defined a model case from which the work (partially processed as a case study) further unfolds. Settlement in criminal proceedings

The topic of this diploma thesis is the settlement in criminal proceedings, one of diversions, or also alternatives to typical course and outcome of criminal proceedings. The settlement was incorporated into the Czech Criminal Procedure Code by the amendment n. 152/1995 Sb. with the effect on 1st September 1995. The settlement is an institute of criminal procedure law originating in restorative justice principles and its goal is to restore affected relationship between the defendant and the victim. Then proceedings of the settlement should not serve only to compensate the victim, as is sometimes perceived by the public, but also to clarify causes of the conflict during the active participation of both parties and to assume personal responsibility for the crime committed which may have significant effects in terms of criminal prevention. Despite the fact that the settlement is a form of diversion beneficial to the defendant (it leads to cessation of prosecution), victim (it is faster to obtain the compensation) and society (prevention from committing other crimes, relieving courts in favour of complex and serious crimes), it is rarely used in practice. Evaluation of the consumer's creditworthiness in terms of the stability of credit contracts

The theme of this bachelor thesis is an evaluation of consumer's creditworthiness. The work examines present tools which are used by banking institution according to their credit policy and factors which influenced the final interest rate. It also sets client's rights and duties in view of the new Consumer Credit Act. The main goal is to prove that both sides of the contract are responsible for ensuring the problem-free way of this relationship.

EU fight against terrorism - "cyberterrorism" as a new security threat

This diploma thesis deals with European Union and current security threats, concretely with Cyberterrorism. Cyberspace and internet became essential parts of our living over the last decades due to rapid development of information and communication technology. The increased dependency on cyberspace is visible in all governmental operations, public-private sector, financial and business operations, as well as communications between individuals and groups. As a result our society is facing new threats. On one hand cyberspace is a place for economic growth and innovation, on the other hand criminals, spies and terrorist use cyberspace as a place for their activities. Our society should be aware of these negative impacts as well. Cyberterrorism by its nature is considered to be a very dynamic phenomenon. Regarding this fact this thesis provides a dynamic way how to define Cyberterrorism and reveals main perspectives of Cyberterrorism. Tracking the European Unions Convention on Cybercrime and main means to fight Cyberterrorism, this thesis analysis whether European Union disposes of appropriate means to engulf the dynamic nature of this phenomenon.

Abuse of a Dominant Position in the Czech and EC Law

Práce srovnává platnou právní úpravu ČR a ES jedné z oblastí ochrany hospodářské soutěže - dominantního postavení na trhu a jeho zneužití. Vysvětluje zákonem používané pojmy a zaměřuje se na rozbor jednotlivých skutkových podstat zneužití dominantního postavení ve vztahu k právu komunitárnímu. Dále jsou v práci navrženy některé změny českého zákona o ochraně hospodářské soutěže, aby lépe odpovídal právu ES.

Legalizace výnosu z trestné činnosti- mikroekonomická a makroekonomická perspektiva

The primary objective of this diploma thesis is to comprehensively present the issue of money laundering not only on a macro level but also in terms of commercial bank and its microeconomic response to it. The main contribution of this diploma thesis is to identify the global indicators, which should be considered when drafting strategies in the fight against the legalization of proceeds from crimes. This diploma thesis addresses the changes caused by current globalization and highlights the dangerous effects it has on evolution of this consequent criminal activity together with evaluation of its potential in the future. Due to the tense situation in Europe caused by the series of terrorist attacks, part of the work is dedicated to the explanation of the relationship between terrorist financing and money laundering.

Building credit scoring models using selected statistical methods in R

Credit scoring is important and rapidly developing discipline. The aim of this thesis is to describe basic methods used for building and interpretation of the credit scoring models with an example of application of these methods for designing such models using statistical software R. This thesis is organized into five chapters. In chapter one, the term of credit scoring is explained with main examples of its application and motivation for studying this topic. In the next chapters, three in financial practice most often used methods for building credit scoring models are introduced. In chapter two, the most developed one, logistic regression is discussed. The main emphasis is put on the logistic regression model, which is characterized from a mathematical point of view and also various ways to assess the quality of the model are presented. The other two methods presented in this thesis are decision trees and Random forests, these methods are covered by chapters three and four. An important part of this thesis is a detailed application of the described models to a specific data set Default using the R program. The final fifth chapter is a practical demonstration of building credit scoring models, their diagnostics and subsequent evaluation of their applicability in practice using R. The appendices include used R code and also functions developed for testing of the final model and code used through the thesis. The key aspect of the work is to provide enough theoretical knowledge and practical skills for a reader to fully understand the mentioned models and to be able to apply them in practice.
