Contractual and non-contractuall obligations in private international Law
Čejková, Martina ; Brodec, Jan (advisor) ; Růžička, Květoslav (referee)
Contractual and Non-contractual Obligations in Private International Law This doctorate thesis deals with the European international private law and discusses the current law-crash modification of contractual and non-contractual obligations. Characteristic of the European community is the absence of unification of the substantive law, which is compensated, by the unification of conflict standards. The unification of conflict standards, as an instrument of the international private law, can be understood as a certain sign of unification of direct standards. Conflict standards do not govern directly the rights and obligations of the parties to a contract in international private law but they answer the question by which legal order the given relationship should be abided and therefore they provide certain degree of foreseeability and safety. The first (general) part called "European international private law - from conventions to regulations" is dedicated to development of the unification of conflict standards within the European community. At present, the unification of the conflict issue is represented by two new-adopted Roman regulations concurring to the Roman convention on the law applicable to contractual obligations. Analysis of the first Roman regulation on the law applicable to contractual...

The effekt of accreditation on the quality of health care providet in selected medical facilites.
SOMROVÁ, Jana
The quality of nursing care is becoming an increasingly important concept in contemporary nursing. The most effective means of achieving quality of nursing care and the means of proof is the accreditation of medical facilities. It is a significant appreciation of professionalism, the work of health professionals and an important signal for the patients. Quality of care, security of supply and preventing potential risks for health care priority. The main aim of the thesis "The influence of accreditation on quality of care in selected health facilities" was to map the set of quality management and impact monitoring and evaluation of quality indicators in hospitals accredited by the Czech Republic. To determine whether accreditation has become an instrument to ensure comparable quality, and time has changed from an unpopular instrument into an instrument for continuous quality improvement. The survey took place from November 2010 to March 2011 in the form of quantitative data collection using an anonymous questionnaire survey in selected hospitals accredited by the Czech Republic. In the research study were asked managers of nursing care, main, upper station and sisters. The thesis has been established 6 goals. The first objective was to determine what indicators of quality nursing care in accredited hospitals pursue. Interested in us as quality indicators that were studied before accreditation, and quality indicators to setting up medical facilities in preparation for accreditation. The second objective was determine how frequently watched indicator of quality is monitored in hospital. The third objective was to determine whether there was in accredited hospitals to reduce adverse events - falls. The fourth objective was to determine whether there was in accredited hospitals to reduce the incidence of nosocomial infections in complying with barrier nursing regime. The fifth objective was to identify the biggest problems arose during the implementation of audits, completeness and comprehensiveness of nursing documentation management into practice. " The sixth objective was to determine whether there was during the preparation of an increase in hospital nursing staff. The thesis then was examined six hypotheses. First hypothesis Accredited hospitals monitor the quality of care provided by at least ten quality indicators - were confirmed. Hypothesis 2 The most frequently monitored indicator of the quality of nursing care, the prevalence of pressure ulcers - was confirmed. All respondents said they monitor the prevalence of pressure ulcers as an indicator of quality nursing care. Hypothesis 3 gaining accreditation to reduce the incidence of falls - was confirmed. Hypothesis 4 obtaining accreditation decreased nosocomial infections - was confirmed. Hypothesis 5 The biggest problem in implementing the audit, management complexity and completeness of nursing documentation in practice "has been an increase in paperwork for nursing staff - were confirmed. Hypothesis 6 During the preparation for accreditation has been an increase in nursing staff - has not been confirmed. Accreditation is perceived by respondents as beneficial for the hospital. Due to accreditation standards and developing quality indicators were identified risk areas in the provision of hospital care and detail can be paid to the prevention of adverse events, nosocomial infections and other risks. The results of work will be to provide medical facilities where the research was conducted investigation, the presentation of the research will be presented at a conference, the South Bohemian nursing days "and also gives the United Accreditation Commission of the Czech Republic as a presentation at the conference to be held early next year (spring ) 2012th Nursing standards were created.

Evolution of instrumentation in radiotherapy. (e-learning program)
STOLBENKO, Pavel
The first experiments with therapeutical applications of X-rays were carried out as early as after Wilhelm Conrad Rontgen{\crq}s discovery. This period was rather an experimental stage of irradiation, full of errors. Due to primitive technical equipment, lack of knowledge of X-rays biological effects and zero protection these early experiments had mostly fatal consequences both for doctors and their patients. After natural radioactivity had been discovered and radium was used in medicine, the results were similar. The beginning of the 20th century saw a growing interest in radiotherapy. First books were published summarising the knowledge in the field of X-ray therapy and radiotherapy. The technical equipment, however, was not good enough to enable irradiation of an appropriate quality, mainly in the case of deep tumours. Later, after the First World War, efficient power sources being developed, the era of deep irradiation therapy took off. Also in the field of radiotherapy rapid progress was recorded. Radium being available, first {\clq}qradium`` bombs came into existence for external irradiation. During the 20s of the 20th century, the efficiency of therapeutical appliances was gradually improved. This process was later limited by their design. The 30s brought progress in particles accelerators and megavoltaic therapy. During this period radioactive elements began to be used after artificial radioactivity had been discovered. The Second World War and nuclear weapons brought unexpected possibilities in the field of radiotherapy {--} many new radioisotops, accelerators and computer technology {--} this is what remained after the most terrible conflict in the history and what modern radiotherapy is technically based on.

Herrmannová, Michaela ; Křivánková, Ludmila ; Vytřas, K.
Beginning of capillary isotachophoresis is in seventieth years last century. Theory of the isotachophoretic separation process has been elaborated during twentieth years, the instrumentations were developed and considerable number of applications were publicated in articles. ITP-CZE enables in the first step to inject a relatively large sample volume, to separate sample components and to remove undesirable components. In the second step a simplified and defined part of the sample is analysed. Real samples of sweeteners, human serum and urine were analysed.

Main Consequences of Violation of EU Law by Member States
Neubauer, Jindřich ; Král, Richard (advisor) ; Smolek, Martin (referee) ; Scheu, Harald Christian (referee)
Ph.D. Thesis Abstract Title: Main Consequences of Violation of EU Law by Member States Author: Jindřich Neubauer Supervisor: doc. JUDr. Richard Král LL. M. This Ph.D. Thesis deals with the main consequences of violations of EU law by Member states of European Union. It focuses mainly on the two most important instruments foreseen by EU law for ensuring proper application of EU norms. The first is the principle of state responsibility for breach of EU law. The second is infringement procedure based on articles 258 - 260 of the Treaty on the functioning of the European Union (hereinafter "TFEU"). The aim of this Thesis is to describe and analyze two relatively independent but linked tools which ensure fulfillment of obligations arising from EU law. The importance of such analysis is clear from the high number of infringement proceedings initiated every year against the Czech Republic and current discussions about how to transpose the principle of member-state liability for breach of EU law into the national legal order. The understanding of such tools is necessary for the successful professional defence of member states' interests before the Court of justice of the European Union (hereinafter "CJEU"). It is also necessary to reflect on and examine major changes in European law which have occurred through...

Topical issues of the regulation of international air carriage: the liability of an air carrier with respect to passengers
Ajgl, Tomáš ; Pauknerová, Monika (advisor) ; Brodec, Jan (referee)
This thesis deals with those issues in regulation of international air carriage, which are in the centre of interest of passengers. Author focuses on two key legal instruments establishing different regimes of air carrier's liability. The first one is the Convention for the Unification of Certain Rules for International Carriage by Air, also known as the Montreal Convention. The second is European regulation no. 261/2004, also known as the Air Passengers' Rights Regulation. The key question is whether these liability regimes are completely separate or they overlap. After introductory chapter, Chapter 2 follows, dealing with historical development of legal regulation in the field of air carriage liability. Evolution of the so called Warsaw system is described and the Montreal Convention and some of the most important European regulations are presented. Next chapter focuses on theoretical aspects of air carrier's liability in the light of Czech civil law jurisprudence. These findings are applied both to the Montreal Convention and to the regulation no. 261/2004. Provisions of the Montreal Convention are examined in Chapter 4. Scope of application as well as the most problematic terms such as "accident" or "bodily injury" are discussed. Some well known courts' findings are presented to demonstrate how...
