Basic procedural rights of parties to administrative procedure

This diploma thesis deals with basic procedural rights of parties to administrative procedure. The aim of the thesis is to analyze and evaluate their current legal regulation particularly contained in the Act No. 500/2004 Coll., administrative code, as amended. The thesis is divided into an introductory chapter, five chapters and a conclusion. The aim of the introductory chapter is to introduce a reader to the issue of fair trial and basic procedural rights of parties to Czech administrative procedure. The first chapter deals with definiton of basic terms related to administrative procedure. The second chapter focuses on more detailed explanation of participation of parties to administrative procedure. The aim of the third chapter is to summarize different approaches towards the concept of fair trial and to bring a list of analyzed basic procedural rights of parties to administrative procedure. The fourth chapter deals individually with each of the fourteen analyzed basic procedural rights. The fifth chapter concentrates on the application of basic procedural rights incorporated in administrative code to special administrative proceedings, which is demonstrated on the case of two proceedings regulated by the Act No. 111/1998 Coll., as amended. The bachelor thesis deals with the new Insolvency Act, which changes the legal environment in a significant way. The aim of the thesis is to describe the claims, rights and motivation of the creditors, the debtor and individual concerned persons of an enterprise during insolvency, to compare the new Act on Insolvency and Its Resolution with the old Bankruptcy and Composition Act, to describe the course of the insolvency proceedings in a time sequence and every possibility of solving the bankruptcy of an enterprise. The practical part of the thesis analyses in detail the course of the reorganization of the company CBPS, s.r.o.



Legal aspects of the nursing profession

This title of the thesis is "Legal aspects of the nursing profession". The theoretical part of the thesis describes legal liability, nurse's rights and duties arising from the practise of the nurse profession determined by legislation. This part of the thesis is also focused on the Law about nonmedical care professions. The empirical part of the thesis target the survey of knowledge and adoption of the legislation in practise. At the conclusion there is an evalution of the concrete findings arising from the empirical part.


The Institution of the Right to Build and its Occurrence in the Czech Legal System

Právo stavby je právním institutem se zajímavou historií. Jeho počátky nacházíme již v římském právu, do našeho právního řádu byl po pozitivních zkušenostech v okolních zemích zaveden zákonem č. 86/1912 říšského zákoníku. Právo stavby rozšířilo okruh věcných práv k nemovitostem, přineslo zcela novou možnost zřídit trvalou stavbu na cizím pozemku v období, kdy v právním řádu byla plně zakořeněná zásada jednoty pozemku a stavby. Diplomová práce postihuje vývoj tohoto institutu v našem právním řádu a za pomoci výkladu jednotlivých ustanovení zákona přispět k jeho lepšímu pochopení. Zachycuje také dobové souvislosti a jejich vliv na využití institutu a s ohledem na postupný vývoj občanského práva v průběhu minulého století poukazují na vzájemné souvislosti věcných práv k nemovitostem.


A Translation of the Canadian Constitution and a Comparison of Selected Sections of the Constitution of the Czech Republic

Several parts of Constitution of Canada and Constitution of Czech republic are compared in this work - legislative power, Charters of Rights and Freedoms and conditions for constitutional amendments. Authorial translation of Constitution of Canada (never translated to Czech before) is a part of the work. There's an introduction to the theme and a brief history of Canada and both Constitutions in the work as well. The work tries to show some legal problems of Canada to Czech people.

Liquidation of business corporations in the Czech republic

This thesis deals with the liquidation of business corporations in the Czech Republic. The whole course of the liquidation from voluntary decision itself to deletion from the Commercial Register is considered from the financial, tax and legal perspective. There are descripted the duties and rights of the liquidator and the possibility of transition from liquidation in insolvency proceedings. The findings are in the practical part demonstrated on concrete examples selected from the Commercial Register.
