Práca sa zaoberá novým insolvenčným zákonom, ktorý zásadným spôsobom mení právne prostredie, v ktorom sa rieši situácia dlžníka, ktorý sa ocitol v úpadku. Cieľom práce je popísať nároky, práva a motiváciu veriteľov, dlžníka a jednotlivých zainteresovaných osôb podniku mimo aj počas insolvencie, porovnať nový zákon o úpadku a způsobech jeho řešení so starým zákonom o konkursu a vyrovnání, v časovom slede popísať priebeh insolvenčného riadenia, popísať každú možnosť riešenia úpadku firmy. V praktickej časti práce je detailne rozobratý priebeh reorganizácie firmy CBPS, s.r.o. Práce se zaobírá novým insolvenčním zákonem, který zásadným způsobem mění právní prostředí, v kterém se řeší situace dlužníka, který se ocitl v úpadku. Cílem práce je popsat nároky, práva a motivaci věřitelů, dlužníka a jednotlivých zainteresovaných osob podniku mimo i v čase insolvence, porovnat nový zákon o úpadku a způsobech jeho řešení se starým zákonem o konkursu a vyrovnání, v časovém sledu popsat průběh insolvenčního řízení, popsat každou možnost řešení úpadku firmy. V praktické části práce je detailně rozebrán průběh reorganizace firmy CBPS, s.r.o. The bachelor thesis deals with the new Insolvency Act, which changes the legal environment in a significant way. The aim of the thesis is to describe the claims, rights and motivation of the creditors, the debtor and individual concerned persons of an enterprise during insolvency, to compare the new Act on Insolvency and Its Resolution with the old Bankruptcy and Composition Act, to describe the course of the insolvency proceedings in a time sequence and every possibility of solving the bankruptcy of an enterprise. The practical part of the thesis analyses in detail the course of the reorganization of the company CBPS, s.r.o.
