The role of the mediation in pre-divorce and post-divorce care in the Czech Republic

The dissertation thesis "The role of mediation in pre-divorce and post-divorce care in the Czech Republic" is about identification possibilities that the mediation brings to families, husbands and wives, and partners with solving difficult life situations like a divorce or a break up between partners. After it describes the impact of these interpersonal conflicts. Theoretical base of this thesis is: family crisis theory, individualized society theory, theory of gender inequality, but for all concept of harmonizing working and family life and changes on labor market. Main source of information was qualitative research of mediation clients and interviews with experts. In my thesis I analyze causes and consequences of conflicts in a partner life and through mediation I suggest a solution of consequences in the incurred situation, which seems like desired in wide society context.

This bachelor's thesis attends to the phenomenon of workplace mediation and related aspects. In the first part the notion of conflict is theoretically defined, together with a brief study of the historical development of this term and its understanding. The typology of conflict is offered, and, consequently, the question is raised whether every conflict has to be perceived as implicitly negative. Second part deals with the possible approaches to conflict resolution. Third part studies the history of mediation in the Czech Republic and abroad, enumerates the common techniques of mediation, its guiding principles and constituting phases, and focuses on mediation as a form of alternative dispute resolution. Following chapter of the thesis examines the role of parties concerned in the process of mediation. Final chapter concludes by suggesting possible solutions to a workplace conflict between two individuals, or between and within teams. The aim of this thesis is to present the reader with a detailed overview of the technique of mediation and suggest it as an efficient tool of conflict resolution.
Mediation as an alternative dispute resolution method

This thesis is dedicated to mediation as an alternative dispute resolution method and as a possibility to prevent long lasting court disputes which occur more than necessary. The aim of this thesis is to point out the advantages of mediation and the possibilities of its wider implementation in Czech Republic, while comparing with the Australian system, where mediation is widely used. The thesis is separated into six parts. The first part is focused on a brief introduction of some ADR methods, in particular renegotiation, mediation, pre-arbitration settlement methods, arbitration and hybrid ADR methods. Furthermore, this part focuses on the history of mediation around the world and in the Czech Republic. The end of the first part focuses on a detail analysis of various forms of mediation based on several criteria of division. The second part compares mediation to court proceedings from three different points of view. These are the ability of each method to fulfil the aims and needs of the parties, the aspects of the dispute and of the parties which affect the suitability of each method and lastly the ability of each method to eliminate the barriers to an effective resolution of the dispute. The Specifics of Social Work with Families in Mediation

This thesis deals with the issue of family mediation and its utilization within social work with families, where the mediation is one of the appropriate means to settle family disputes, which belong to the most emotionally demanding for a solution. Despite all this, mediation enables to settle disputes in a cultivated manner with the help of an intermediary mediator, who does not make a decision in the dispute but helps both sides to find the most acceptable solution. The aim of this thesis is to describe a method of utilization of family mediation and what is its potential. Partial objectives are identification of problems and benefits which mediation brings to the work with a family. It is also finding out the popularity of mediation and why is not used as much as it could be. Through research questions, I also wanted to find out, how are on mediation looking and familiarized workers of Authority for Social and Legal Protection of Children and mediators performing services for family mediation. I was also interested in the cooperation between these two subjects. The whole research was focused on the South Bohemian Region. To gain the necessary data has been used qualitative research, and as data collection technique I chose semi-structured interview with open questions. The research sample was composed of 4 workers of Authority for Social and Legal Protection of Children and of 5 mediators, where I asked both groups questions which have been divided into several areas. So I totally conducted 9 interviews. The research showed that mediation nowadays is not used as it could be, which means that its potential is unfulfilled. Primarily I blame very low awareness of mediation in general, but sometimes even in the professional public, where the mediation is not well-known yet, but on the other hand it is still a relatively new institute which needs to establish in our awareness and gain the confidence of professional and non-professional public. Not to be only negative, the situation has rapidly improved since the acceptance of the Act no. 202/2012 Coll., on Mediation, so I suppose that mediation in a future period will have its place in the sphere of solving interpersonal problems and it just needs a time, which also arise from experiences from abroad, where mediation has already its place.
Mediation as an Alternative Dispute Resolution

The submitted thesis deals with Alternative Dispute Resolution (ADR), particularly mediation activities. The aim of this thesis is to introduce mediation as an alternative method of conflict resolution, that is still relatively neglected in the Czech Republic, through a summary of theoretical knowledge in terms of its practical operation. Particular attention is paid to the recent regulation relating to mediation in civil matters and certain essential institutes that are affected by the new Mediation Act. The work is divided into five chapters. The first chapter defines the general concept of ADR and outlines the different types of ADR. The next part of the thesis presents in detail the mediation, a mediator and requirements for the performance of this function. There is also clearly described the course of mediation process. The third chapter deals with the regulation of mediation in the EU, which is the starting point for each national system. The fourth chapter is devoted to the regulation of mediation in the Czech Republic. It describes the situation that prevailed during the period without comprehensive regulation of mediation in civil matters, the legislative process of preparation and adoption of the Mediation Act, newly enshrined institutes and there is also a definition of the obstacles that could hinder penetration of mediation into wider practice. Finally, there is a comparison of the situation in the Czech Republic with the application of mediation activities in the USA and in some EU countries.

This bachelor thesis provides comperhensive view on one of the alternative dispute resolution methods - mediation. The aim is to clarify the existing legislation regarding mediation in Czech and Slovak republic and to explain major similarities and differencies in both legislations. In addition, the thesis includes the practical aspects of mediation which enables better understanding of whole issue. The thesis also answers the question whether the current legislation of mediation meets the requirements, which are placed upon it.

Abstract: The purpose of this thesis is to provide a complex overview of selection of toll system fees for the usage of charged sections of highways and first class roads in countries Poland, Slovakia, Hungary and Czech Republic in present time. Familiarization with various types of toll systems used in Europe, with legislative preconditions for pricing of road infrastructure in European Union and with basic principles of freight and road transport. A part of thesis is a description of companies' functioning which intermediate payments for the usage of charged road communications. Followed by a proposal of common toll system for countries of Visegrad Four, its technical aspect, price calculation and legislative requirements for its introduction into practice. At the end of thesis there are recommendations and possibilities of this system implementation into commom european toll system.
