Protection of personal rights in continental system and common law

With the increased global infringement of personal rights, it is necessary to be aware of the protection in the different legal systems, especially Anglo-American. Even if the consequences are to be felt in the domestic legal order, the enforceability is recognized under the foreign legal order. The protection is worldwide and through the case law from the European Court of Human Rights the two legal systems - Common law and the Civil Law are penetrating the legislation and the case law in respect of the institute of the protection of personal rights. The doctorate thesis presents the complex introduction to the area of protection of personal rights in the Common law, especially in English law, Commonwealth countries and USA that has not been presented yet for the Czech legal professionals. The thesis explains theoretical concept of the Common law and its background for the purpose of explanation of differences of examined legal orders. The institute is explained on the key historical case law that led to establish the Common law principles. The thesis uses the current and topical legal cases and problems that the orders face in the 21st Century.

Irish political parties euroscepticism analysis

Ireland is generally seen as one of the biggest supporters of the European Union. Irish public opinion researches have been showing long-term and extremely positive attitudes to the European integration. The pro-European consensus is also known among the local political parties. Moreover, at the end of the 20th century, a strong economic growth had started and the Ireland quickly became a model example of how positive impact the European integration may have on its Member states. European issues therefore did not attract too much attention in the local political discourse. This changed in the early 21st century, when the increasing public euroscepticism began observable. The thesis examines whether selected Irish political parties adapted their rhetoric and actions to ever more critical mood of voters. These are Fianna Fáil, Fine Gael and the Green Party. The thesis covers three critical moments of the Irish European integration, namely the Nice Treaty, the Lisbon Treaty and the Irish debt crisis. It searches for negative comments about the EU and European integration of examined political parties in the campaigns before the referendum on European issues, as well as in their election statements to the Irish parliamentary elections, also taking place in the selected period. Financial Crisis in Economies with External Imbalances: A Comparative Analysis of Ireland and Spain

The financial crisis of 2007-08 has had momentous consequences for most developed countries and triggered recession on the global financial markets. Consequently, economies with pre- existing deficiencies were hit in particular. In the European Union, especially two groups of member states with specific imbalances could be discerned. This thesis is intended to discuss the impacts on economies with external imbalances, where the crisis was not rooted in public finance profligacy. The main protagonists, Ireland and Spain, experienced resembling economic boom prior to the crisis, later accompanied by accumulation of foreign debt and real estate bubbles. Nonetheless, despite the strong similarities in their economic development their paths diverged after the bust, and Ireland has been given as an example for successful austerity. This thesis presents key determinative factors which differentiated Spain from Ireland in the reviving processes to discuss the hypothesis that the Irish recovery was generated solely by the implemented countermeasures and that it can therefore be considered a model for future crisis management. The First and Second Referendum on the Treaty of Lisabon

Master thesis "The First and Second Referendum on the Treaty of Lisbon in Ireland" is a comparative case study, which - using the concept of europeanization - analyses causes, which led to the opinion shift of Irish citizens on the Treaty of Lisbon between years 2008 and 2009. Whereas during the first poll in June 2008 Irish rejected the Treaty, 16 months later it was accepted by an expressive majority, when almost half a million people more voted for it. The thesis clarifies, which elements caused a totally different course and result, explores opinions of individual players such as political parties, government, trade unions, associations of interest or significant companies, observes course of the campaign before the referendum, summarizes and analyses outcomes and subsequent reactions both on national and Union level. From the discovered facts the thesis concludes, that behind the change of attitude of the Irish stood especially external effects. On one side pressure of the other member states of the Union and even the EU as a whole to finalize the process of institutional reform and also explicit refusal of repeating the scenario from 2005, when ratification of the Treaty establishing a Constitution for Europe was terminated after disagreement of France and the Netherlands. The Comparison of Attitudes of Ireland and Great Britain in Selected Aspects of the European Integration

The diploma thesis "Komparace postojů Irska a Velké Británie u vybraných aspektů Evropské integrace" deals with attitudes of Great Britain and Ireland to the politics of the European Union. Based on the available literature (using the descriptive and analytical method), the thesis proves how divergent or vice versa accordance are particular policies and approaches of these two states, whose past is completely different and has fundamental influence on contemporary access of these members to the European Union. In the history of Great Britain's and the European Union's relation it is always possible to find a certain fact that distinguished Britain from other partners in the European Union. It is then also different from the neighbouring Ireland. The diploma thesis analyses first of all the financial framework of the European Union, its regional and foreign policy. It is divided into five chapters - besides already mentioned regional, economic and foreign policy, the diploma thesis delas with the access of Ireland and Great Britain to European referendums, accentuated is first of all the referendum on the Treaty of Nice and the contemporary debate on the rejected Treaty of Lisbon. Alternative food networks in a post-communist context:: Farmers' markets and farm shops in Czechia Marie Syrovátková ABSTRACT The emergence of farmers' markets (FMs) and farm shops (FSs) in Czechia is a follow-up of the expansion of alternative food networks (AFNs) from Western Europe and North America where they have been developing for several decades. AFNs are an up-to-date topic as they respond to the growing concerns about the negative effects of the globalized conventional food system on social, economic and environmental aspects of food production, distribution and consumption. Each form of AFNs emphasizes a different aspect of the food system sustainability. FMs and FSs should primarily enable direct selling of quality local products made by small producers to support local economy, rural development, environmental protection and to improve quality of life. Based on a combination of quantitative and qualitative methods, the aim of the dissertation is to explore the emergence and development of AFNs in Central Europe.
