The International Sales Contract

The essay focuses on the issue of the international sales contract, primarily on its basic legislation -- the United Nations Convention for the International Sale of Goods. This Convention considers just the question of the conclusion of the international sales contract and discretions and duties of buyer and seller nevertheless the essay contains the chapter about terms of the international sales contract. While analysing the Convention the essay shows the inaccurate definitions which the Convention harbours.

Comparative advertisemenet - the development of its regulation in Czech law

Resumé The aim of the thesis "Comparative advertising - the development of its regulation in Czech law" is to analyze the development of comparative advertising in the Czech legislation, to make a comparison with the EU legislation and to examine development trends in comparative advertising. The thesis is divided into four key parts. First part discusses general issues of comparative advertising, ways of comparison in advertising, understanding of comparative advertising in the past and general regulation of advertising. Second part of the thesis analyses development trends in the Czech regulation of comparative advertising. This part analyzes two key phases - understanding of comparative advertising before and after accepting the amendment of the Commercial Code (1st January 2001) that introduced explicit regulation of comparative advertising. The thesis evaluates compatibility of conditions of permeability in the Commercial Code to the ones in the EU directive, assesses strictness of the conditions and examines the relationship of comparative advertising to other explicitly regulated types of the unfair competition in the Commercial Code. Role of nanny in family and her status in contemporary society

This work is theoretical-and-research in its essence, with the purpose of providing the reader with a complex view of the au-pair or nanny issues in the Czech Republic. It would like to call attention to the issues not dealt with in a complex, clear and complete manner in the Czech legislation and makes an attempt to present a solution by professionalizing this occupation. The first half of the theoretical part deals with the noninstitutional care for children in two forms - with the care for children provided by a babysitter or nanny in her own home and by an au-pair in the family of the child. It describes selected forms of these services in the EU countries (Germany, Austria, France, Great Britain) and then covers the conditions of providing the same services on the territory of the Czech Republic and deals with the work of the agencies providing and arranging the services of the babysitters, nannies and au-pairs. The second half of the theoretical part of the work explores the individual areas describing the needs, motivations and reasons of the families searching for and using the services of an au-pair/nanny. Racist legislation of Nazi Germany

Tema moji diplomove prace je rasisticke zakonodarstvi nacistickeho Německa. Toto tema jsem zvolila, protože si myslim, že je třeba si připominat i stinne stranky pravnich dějin, abychom se z historie poučili a předešle chyby neopakovali. Diplomovou praci jsem rozdělila do osmi zakladnich kapitol. V prvni kapitole vymezuji zakladni pojmy rasismus a antisemitismus, rasove teorie a vůdcovsky princip, neboť tvořily integralni součast nacisticke ideologie. Druha kapitola obsahuje nastin politicke a ekonomicke situace v povalečnem Německu, postupny vzestup Nacionalněsocialisticke německe dělnicke strany v čele s Adolfem Hitlerem, převzeti moci nacisty a prvni fazi protižidovských opatřeni. Třeti kapitola se věnuje nejvyznamnějšim rasistickym zakonům, tedy tzv. norimberskym zakonům, a dvěma zakonům, jež se tykaly dědičneho zatiženi. V dalšich kapitolach jsem se zabyvala dvěma důležitými mezniky protižidovske politiky Německa. Prvnim je celonarodni pogrom z 9. a 10. listopadu 1938, tzv. křišťalova noc, kterou bych označila za předehru holocaustu. Druhy meznik představuje porada na tema "konečne řešeni evropske židovske otazky" znama jako konference ve Wannsee. 1

The debate on illegal migration legislation in the Czech Republic and Federal Republic of Germany

Tématem práce je fenomén nelegální migrace, a to v Česku a Německu, dvou sousedních zemích a členských státech Evropské unie. Konkrétně práce zpracovává debatu o právní úpravě fenoménu nelegální migrace, tedy návrhy a postoje jednotlivých aktérů zapojených do diskuze o stávajících i chybějících právních normách upravujících oblast nelegální migrace v Česku a Německu. Práce si neklade za cíl vyčerpávající zmapování diskuze k tématu v uvedených zemích, ale soustředí se na nalezení příspěvků pro debatu podstatných. Podstatné jsou příspěvky, které jsou charakteristické pro jednotlivé účastníky debaty a mají schopnost ilustrovat postoje a motivy, s nimiž tito aktéři do debaty vstupují.

The aim of my bachelor thesis was to describe clearly and comprehensibly chosen aspects of customs policy in EU, so that the work could be valuable for other readers as well. The work itself is divided into four main chapters. First chapter is about common commercial policy of EU. Second chapter deals with main documents and regulations that represent a legislative frame for EU customs policy. Third chapter describes bilateral and multilateral relations of EU with chosen countries and regional organizations. Last chapter is devoted to the topic of origin of goods.

Competition and the national champions in globalization primarily in terms of the situation in the Czech Republic

This thesis defines and analyzes the existing rules of procedure and legislation to protect competition in the principle of de lege lata in the Czech Republic with regard to the operation of national champions and marginally in terms of policy, national champions in Europe, analyze the status of the principle of national champions and classified in the context of existing conditions with global effects in the field, arguments concerning the existence and status of national champions in the competition (de lege lata versus de lege ferenda) in terms of various aspects of their responsibilities. With regard to the objective of work was dealing with the issue of regulation of irregular acquisition of electric power in the context of the possible advantage of champion and the emergence of any injury to other competitors or consumers as a result of this advantage. The aim of this work is to describe the regulation of de lege lata in the Czech Republic on irregular acquisition of electric power and showing a solution and to answer the question of whether the change de lege ferenda may remove any harm other competitors or consumers.

Strategic Analysis of an Enterprise

The goal of this thesis was designed a complete strategic analysis, both internal and external form of the selected firm LACMAN s. r. o. LACMAN s. r. o. is a small, emerging company, the subject of its business is the distribution of connectors. Thesis is divided into five main blocks: In the first part, called Introduction, describes the basic building blocks for the preparation of the strategy, it is mission, vision and a fundamental target of LACMAN s. r. o. The second part is quite theoretical, it is known as a theoretical-methodological basis and discusses and describes the theoretical facts that I need to apply in practice. The third part is the name and the pictor of the company, how society see the company. This section describes the basic characteristic of information, cultural, sports, and mainly social sponsoring company and the overall culture, norms and standards which govern the company staff. The fourth part is called Practical and is divided into external analysis where I work with macro-economic company's data, policy and legislative factors, and mapping analysis of supplier-customer relationships and existing competition in the market with the connectors material. Internal analysis me serve to evaluace how are the company's resources (material, inmaterial, human and financial) in sufficient quantity, the quality and whether it is used effectively. In this part of thesis, I also included a detailed financial analysis, there I solve the financial health of the company. And the SWOT analysis, which, in my view, contains a large number of strengths, but on the other hand, contains numerous threats from outside the company. The last part is called the Finish, here summarizes the findings from the all analysis. I believe that this thesis is to analyze the company of great benefit and a council, how to overcome difficult times and stay on the market at the time of global economic crisis.
