PERSONAL DATA PROTECTION UNDER THE GDPR WITH FOCUS ON EMPLOYMENT RELATIONSHIP AND BIOMETRICS ABSTRACT This thesis focuses on the very complex and legally complicated issue of personal data protection in the period since the GDPR Directive came into force, i.e. from May 2018 onwards. The adoption of this data protection regulation can certainly be described as one of the most pivotal moments in the history of European legislation, as there has never before been a unifying regulation so extensive that it forced all Member States to regulate such a peculiar area in exactly the same way. For this reason alone, both before and after the GDPR came into force, the topic of data protection has been the subject of numerous debates, as the regulation in question has brought about many significant changes that were previously unprecedented in the field of data protection. The purpose of this work was not to comprehensively discuss all these new institutes, rights and obligations and other parameters of the GDPR, but to describe only the most important ones in detail and then to focus on their specifics in employment relations, with a focus on biometrics. Personal data protection in labour law relationships and protection of whistleblowers Abstract With the development of new technologies at the turn of the millennium came an increase in the number of personal data processing, which required more detailed legislation. This is especially important with regards to labour law relationships in which the employer has to process the personal data of their employees due to legal obligations, or may decide to process them by their own decision and base this processing of personal data on their legitimate interest or consent of the employee, which the employee can hardly resist due to their weaker position. The aim of this thesis is to analyze the basic legal terms, principles and legal grounds of personal data processing and to point out some aspects of their application in labour law relationships. To achieve this goal, the author uses international, European and national legislation and a wealth of literature, articles, internet resources, documents of the Office for Personal Data Protection and documents of WP29 and the European Data Protection Board. The theme of the dissertation is surveillance. Its aim is to answer the following question: up to what extend do we live in a society, which may be described as a surveillance society. For this purpose it defines, what is meant by surveillance, how surveillance evolved through history, which theories relevantly describe this phenomenon and in which spheres surveillance is notable. The dissertation introduces the main theories of the multi-disciplinary field of surveillance studies, which has been developing over the last twenty years. Special attention is focused on CCTV systems. At the same time, the thesis focuses on ethical problems of surveillance, i.e. privacy, discrimination, social exclusion, transparency and responsibility.

Personal Data Protection with Focus on Processing and Protection in Civil Aviation This diploma thesis focuses on the matter of EU legal regulation of personal data protection and reflects it in the field of civil aviation with focus on commercial air transport, as commercial air transport is at this moment the area of civil aviation where most of the personal data processing and operations with them are made. The goals of this diploma thesis are mainly to describe respective personal data processing in civil aviation and finding out whether GDPR represents an insurmountable legal obstacle for air carriers and civil aviation to operate or whether it is just another complicated act of legislation that air carriers and other entities in civil aviation must reflect. The first chapter of the thesis briefly introduces the history of personal data protection while presenting some of its past and current sources of legislation. The primary aim of this dissertation thesis is to present a comprehensive analysis of the issue of personal data protection in the Czech Republic with regard to the regulation in the EU. The secondary goal of this work is to explore the historical genesis and material sources of the issue in question. The core information sources from which the thesis draws represent laws, judicial decisions, official documents and Czech/foreign expert literature. In order to achieve the objectives of the work, the methods that are generally applicable in the field of legal science were used. Therefore the method of description (including classification), analysis and synthesis is mostly applied. The dissertation consists of seven chapters. After a short introduction, it begins with a sociological treatise on the importance of the protection of personal data in the 21st century. Privacy is currently an important topic in the light of the rapid development of information and communication technologies which have been developing since the second half of the 20th century and burgeoned since the turn of the century. Transparency and Consent Framework Data Listing and Editing

This thesis deals with the development of multilingual for web browsers Mozilla Firefox and Google Chrome. The purpose of the extension is to enable the automated management of provided consents to the processing of personal data on websites using the Transparency and Consent Framework. Extension was developed on the basis of knowledge about this framework and about legal norms GDPR and ePrivacy Directive, which deal with the protection of personal data. Knowledge of the method of developing extensions for web browsers using WebExtensions was also used during the implementation. During testing, consent was successfully enforced in 96,2 % of tested websites in Mozilla Firefox. In Google Chrome, success has been achieved in 82,1 % of tested websites. The banner requiring consent was not displayed in 33 % of websites in Mozilla Firefox and in 31,1 % of websites in Google Chrome.
Risk Management in Personal Data Protection

The bachelor thesis focuses on the issue of the risk management in the context of personal data protection in the course of the implementation of their processing. Concerning the theoretical background, based on the explanation of relevant parts of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), the own methodology for risk management in personal data protection is presented. The thesis also attempts at interpretation of some general expressions, understanding of which is indispensable for the specification of the main issue, such as a risk and the process of risk management itself. The practical output of this bachelor thesis is a web application providing the determination of the severity of the risk to the rights and freedoms of data subjects in the process of the general risk assessment for personal data processing operations.

The objective of this thesis is to outline the personal data protection in the context of the employment relationship establishment, to give a comprehensive overview of its legislation in particular, describe the basic terms and principles relating to this subject matter and specify the most important rights and obligations regarding both stages of the employment relationship establishment. The basis for the thesis is primarily the legislation of the General Data Protection Regulation and Personal Data Processing Act 2019 (No. 110/2019 Coll.). The diploma thesis is divided into four chapters. The historical events with a significant influence on the personal data protection development are described in the first chapter. Employer monitoring of employees - Monitoring of Flexible Work Arrangements Abstract This thesis focuses on three areas of interconnected legal issues, institutes, and topics that all come together within the scope of labour law and the actual industrial relations. The first area covers the protection of privacy and integrity of the individual as stipulated by the constitutional standards, general legal regulations, European standards, and binding international treaties and conventions. The second area covers the industrial relations as such; however, special emphasis is put on the protection of privacy and integrity of employees. Finally, thethird area covers the employee monitoring by the employer - at theusual workplace as well as when working remotely, usually from the employee's home. In the introductory part, the above mentioned sources of law are analysed and the normative framework is described, setting the limits of legitimacy and legality of employee monitoring by the employer. 1 Monitoring of employees in context of General Data Protection Regulation Abstract This diploma thesis focuses on the supervision and monitoring of employees from multiple perspectives. Based on the relevant European and national caselaw the thesis specifies whether employees shall have right to the protection of their privacy and integrity at the workplace. Thesis also analyses selected aspects of personal data protection with emphasis on personal data of employees as data subjects processed by employers as controllers. In particular attention is devoted to selected obligations, which arises from General Data Protection Regulation for such personal data processing in the light of relevant statements and guidelines provided by the European Data Protection Board, Article 29 Data Protection Working Party and the Office for Personal Data Protection. Thesis in detail addresses the supervision of employees carried out by § 316 of the Labour code, whereas interprets its provisions as well as conditions for establishing the supervision of employees arising from such interpretation.
