Rekodifikace občanského práva a její dopad na podnikatele v oblasti cestovního ruchu

This paper deals with the recodification of civil law and its impact on tourism entrepreneurs in particular the tour operators and travel agencies. The theoretical part focuses on explaining the concepts that relate to the new Civil Code and the description of the biggest changes that this amendment brings. In the practical part, the survey was designed to determine how entrepreneurs in tourism are familiar with the changes that occurred in tourism after January 2014, and also what financial costs these changes brought.

Tato práce pojednává o právní úpravě přípustnosti adopce dětí osobami s homosexuální orientací v evropských státech. V úvodu je vymezena moderní terminologie vztahující se k jiné než k heterosexuální orientaci a k adopcím obecně. Další části jsou zaměřeny na relevantní dokumenty mezinárodního práva a na judikaturu Evropského soudu pro lidská práva v této oblasti. Z poslední věcné kapitoly této práce vyplývá, že individuální a společnou adopci dětí homosexuálně orientovanými osobami umožňují Belgie, Dánsko, Island, Nizozemí, Norsko, Španělsko, Švédsko, Velká Británie, a dále, že adopce dětí pouze svobodnými osobami s homosexuální orientací je přípustná v Rakousku. Z evropských států, ve kterých je přípustná pouze adopce biologických dětí homosexuálně orientovaného partnera, jsou uvedeny Finsko a Německo.

Choice of law in European context

The aim of the thesis was to analyse the institute of the choice of law in european context and to indicate related pros and cons. Because of the fact that rootes for party autonomy are deepest in contractual obligations, special attention is paid to the choice of law in contractual obligations and differences between the adjustment of questions connected with choice of law in Rome Convention and Rome I regulation. The thesis itself is composed of seven chapters. Chapter One is introductory. Chapter Two is devoted to description of choice of law generally and determination of this legal institut. Chapter Three deals with adjustment of choice of law in legal resources and attention is given to their mutual relations and application. Chapter Four, which deals with contractual obligations, explores the basic principle for choice of law - party autonomy, range of this principle, limitations on choice of law, the opportunity of parties to choose non-state legal system or CISG, aspects connected with choice of law, possibilities to make explicit, implicit or hypothetical choice of law, aspects related to agreement of choice of law (such as form, validity and interpretation) and the relationship between choice of law na choice of court. Transfer of ownership right to land

1 Abstract Transfers of land ownership This thesis provides a clear and comprehensive explanation on the transfer of land ownership and institutions associated with this issue. Land from other things in the legal sense is so different that it raises the need to create specific legal regulations, which contain the basic institutions and principles of land law. The special nature of the land is determined by its specific characteristics that distinguish it from all other things. Although it has a long tradition of land ownership, it has still not developed it's uniform and comprehensive legislation. General law for the transfer of land ownership is a civil code. Special regulations are cadastral law and the law on registration of ownership and other rights in real estate, the law on transfers of agricultural and forest land, Land Act and others. Due to the adoption of a new civil code, there are some places to identify and compare to the current legal system, and possible adjustment for the future. The thesis is divided into four parts. Processing Differencies in Matters of Juvenile Perpetrators

My bachelor thesis will concern criminal procedural law of juvenile offenders, focusing on the specifics of proceedings with juvenile offenders, which I shall compare to proceedings with adult offenders. In the introduction I will mention the history of criminal law with juvenile offenders, which has undergone significant changes. At first criminal law was only regulated by the penal code and by the criminal procedure, which only included provisions concerning juvenile offenders. This regulation was insufficient as it did not allow to reflect juvenile criminality. There were tries to enforce a new code of law, which would contain only juvenile justice. Quite recently, in the year 2004, because of growing juvenile criminality and the need to solve juvenile criminal cases differently, a new independent law n. 218/2003 Sb. on juvenile justice was created, with the full name of law n. 218/2003 on the liability of youth for unlawful acts and on juvenile justice and on change of some laws. This law brought many changes and represents a positive contribution in juvenile justice. In my work I will introduce the juvenile justice law and I will point out the facts resulting from it. At the beginning of my thesis I will shortly define the basic concepts dealing with substantive criminal law of juvenile offenders, which are distinct from the criminal law of adults, and the knowledge of which I consider necessary for full understanding of my work. The aim of my work is to highlight the differences in procedural criminal law, in criminal proceedings with juveniles. I will compare criminal proceedings with juveniles to those with adults, which differ in significant terms. I will focus on certain specifics, which I will describe, compare to general regulations and evaluate. To conclude, I will evaluate the current state of juvenile justice and provide my own opinion on this topic. I will describe certain drawbacks in the law and suggest their change. I will describe my own ideas about juvenile law.

Terminology of the new Civil Code regarding to property rights and analysis of equivalent expression in French

This bachelor thesis is focused on the introduction of the new Czech terminology of the new Civil Code regarding to the property rights. The main aim of this work is to analyse the selected terminology in the field of the law of property and search for possible legal equivalents in French. The secondary aim is to describe the basics of property rights in the Czech Republic and in France. The work is divided in a theoretical and a practical part. The theoretical part consists of two chapters. The first one, which was prepared with the expert sources, deals with legal language. It describes its attributes and pays great attention to lexical and syntactic characteristics of Czech and French legal language. The second chapter of the theoretical part focuses on traditional translation methods which are used in the translation of legal texts and on the problems associated with them. The practical part presents, in its first chapter, the new Civil Code and focuses especially on changes in property rights. The last chapter contains an analysis of relevant terms from the area of property rights and search for their equivalents in French legal language. Supplementary to this part is a Czech-French glossary and résumé in French.

The private prison in Czech republic- reality or fiction?

Úvodem se práce zaměřuje na působení soukromého sektoru v oblasti výkonu práva včetně podstaty soukromých věznic. Hlavním cílem práce je zjistit, zda věznici, která se má otvírat u nás jako první soukromá věznice v ČR, skutečně můžeme považovat za soukromou. V rámci řešení této otázky se práce zaměřuje nejdříve na projekty Public Private Partnership (PPP) obecně, na jejich charakteristiku a implementaci. Dále se práce zabývá konkrétním projektem věznice, která má vzniknout v roce 2009 v Rapoticích u Brna. Zaměřuje se především na rozložení rizik mezi soukromým a veřejným sektorem a na provoz věznice v praxi. V neposlední řadě práce porovnává soukromou věznici v Rapoticích se zařízením Bay correctional Facility na Floridě a dochází k závěrům, že věznici v Rapoticích za zcela soukromou považovat nemůžeme a že má oproti americké věznici určité odlišnosti.

The chapter deals with economic aspects of law, that is with the issue concerning the transaction costs of Private Law recodification. It specifies the costs on the part of private persons and divides them into direct and indirect. In conclusion, the author shapes a proposition that new Private Law presupposes a functionalist and interdisciplinary approach which allows for human freedom and its limits.

Aspects of free movement of persons in Community law

Táto diplomová práca sa zaoberá právnou úpravou voľného pohybu osôb v komunitárnom práve, jej vývojom a súčasným stavom. Konkrétne sa zameriava najmä na zmeny v právnej úprave, ktoré nastali po prijatí smernice 2004/38/ES, ktorá zrušila predchádzajúce smernice upravujúce túto oblasť. Práca sa zaoberá prínosmi tejto smernice v oblasti slobody pohybu, ktoré spočívajú najmä v zjednodušení úpravy a rozšírení oprávnených subjektov. Rozbor smernice sa zameriava na práva plynúce z voľného pohybu a na možné obmedzenia tejto slobody. Práca porovnáva aj českú právnu úpravu, ktorá smernicu implementovala a jej súlad s požiadavkami smernice.
