Kapitola se zabývá ekonomickými aspekty práva, a to otázkou transakčních nákladů rekodifikace soukromého práva. Specifikuje náklady na straně soukromých osob, které rozděluje na přímé a nepřímé. Závěrem autor formuluje tezi, že nové soukromé právo předpokládá funkcionalistický a interdisciplinární přístup, který bude zohledňovat lidskou svobodu a její limity. The chapter deals with economic aspects of law, that is with the issue concerning the transaction costs of Private Law recodification. It specifies the costs on the part of private persons and divides them into direct and indirect. In conclusion, the author shapes a proposition that new Private Law presupposes a functionalist and interdisciplinary approach which allows for human freedom and its limits.
