The legal regulation of hunting and gamekeeping This diploma work deals with legal regulation of hunting and gamekeeping which is possible to characterize as an economic, special-interest, scholastic and organizational activity. This activity is performed by hunters who being professionally educated practise this activity in their free time and on their costs. The activity is aimed at wild game with purpose of preservation of all species of game, but also of keeping hunting customs. The diploma work contains the paper about valid law regulation of hunting and gamekeeping, which is represented by the basic law about hunting and gamekeeping and then the laws concerning nature and animals (veterinary law, law for tyranny of animals, law for nature and countryside preservation). The diploma work also goes back to the history of law regulations, which are the background for the present law. Some law regulations were of such quality that they might be inspiration in future. One part of diploma work is about environment in international context. This area is full of problems with worsening of environment, which influences game and hunting and gamekeeping as well. in English The present Master's thesis deals with the hunting legislation in the Czech Republic. The thesis is divided into 4 chapters, some of which are further subdivided into subchapters. The first chapter contemplates the history of hunting. The second chapter provides a detailed overview of the sources of the hunting legislation. The analysis covers the sources of the Czech legislation, the European legislation and international treaties. The third chapter is the key chapter of the thesis. It encompasses a detailed analysis of the applicable Czech hunting law. The fourth and last chapter contains the hunting legislation of the Slovak Republic. A part of this chapter is a comparative analysis of the Czech and Slovak hunting legislation. The main objective of this thesis is to analyse in detail the current hunting legislation, to emphasise the major deficiencies and to propose appropriate solutions.

The goal of the submitted thesis: "The legal regulation of hunting and gamekeeping" is to evaluate the hunting legislation in the Czech Republic and to propose possible solutions leading to eliminate their lacks. The thesis describes the development of hunting law from 16th century up to the present, including EU legislation and international conventions on the environment related to hunting. It compares also hunting legislation in the Czech Republic and the Slovak Republic.

The diploma thesis focuses on the legal regulation of hunting and gamekeeping. The aim of the diploma thesis entitled "Legal regulation of hunting" is a broad summarization of the historical development and the correlated alterations of the legislative framework in gamekeeping. In order to gain a deeper understanding of the historical context, the thesis focuses on the development of gamekeeping legislation from the early Middle Ages to presently effective legal regulation. The implicit part of the thesis is the evaluation and the reflection of the legislation applied in practice. The overall conclusion contains a proposal for possible legislative changes de lege ferenda. The first part of the thesis gives an overview of the historical development and the early legal regulations of gamekeeping, utilizing the important legal acts, which presented fundamental changes to the legal framework of gamekeeping. The following part of the diploma thesis is devoted to the current state of the Czech legal regulation of gamekeeping, including related and subordinate legislation, by which, in summary, the legal framework of gamekeeping and determination of the rules for hunting and game management are represented. Use of Historical Hunting Statistics for Collecting Zoological Data

This works investigates zoological findings, especially the species and quantity of game, preserved in gamekeeper statistics of the second half of the 19th century. The information is sorted by the year of the shooting and by the kind of animal; and further by the location of the shooting. The relevant locations here are the three great regions: Kingdom of Bohemia, Moravia, and Duchy of Silesia; which, with minor territorial changes, constitute present Czech Republic. The data used in this work were gathered from the corresponding regions' archives, that is from the National Archives of Czech Republic, the Moravian regional archive in Brno and the Regional archive in Opava. One of the introductory chapters depicts the territorial development of these regions. The acquired data are organized into tables and graphs. The focus of the theoretical portion of this work is to systematize and clarify the data about game-shooting during a specific time in our history for selected game species. Hunting law as a tool for environmental protection In the scope of three main chapters, introduction and conclusion, the thesis attempts to capture the relationship between the Czech hunting legislation and nature conservation. The question is whether we can consider the current concept of the Hunting Act (449/2001 Sb.) as one of the tools of environmental protection. For the elaboration I based the research, among other things, on my personal experience with pro-landscape hunting in the vicinity of the village Vinaře, Central Bohemia. Furthermore, I elaborated on interesting cases of judicial and administrative practice and, last but not least, I took into account the relevant legal norms and appropriate literature or professional texts. The first chapter deals in more detail with the very concept of hunting, including various interpretations and therefore also meanings. The second part of the first chapter describes - rather briefly - the history of hunting predominantly in the Czech territory. In this context, greater emphasis is placed primarily on the first signs of nature protection. The next chapter follows the very essence of the monography, namely the role of hunting in environmental protection. I pay special attention to the hunting ground and game in this regard. Development of legal regulation of gamekeeping in the Czech Republic and its further perspectives The topic of this diploma thesis is the development of legal regulation of gamekeeping in the Czech Republic and its further perspectives. Its main goal is to describe and evaluate the development of legislation of gamekeeping in the Czech Republic, to point out the most important milestones in its history, which are also reflected in current legislation and whose knowledge is necessary to understand today's gamekeeping. Next, to critically evaluate the current legal regulation of gamekeeping especially in terms of legal theory and hunting practice, link its wording with valid case law and other legislation, warn against its deficiencies and, last but not least, in selected areas to determine the direction in which Czech gamekeeping legislation should be further developed in order to preserve wild animals as a renewable natural resource and gamekeeping tradition for future generations. 75 Abstract This diploma thesis deals with Legal Adjustment of Gamekeeping. Gamekeeping is perceived not only as a hobby, but it is a phenomenon which became a lifestyle of many people. The main purpose of hunting is to protect and maintain freely living game for the future generations but at the same time ensure the environment protection. According to the importance of the environment protection and the game there is no doubt, that this issue requires its own legal adjustment. The adjustment has evolved over years and these days it is influenced by the globalization, membership in multinational communities and organizations and many others. In the introduction the term Gamekeeping is presented together with the reasons which make this topic current. In the first chapter the history of hunting is analysed heading towards the development of gamekeeping including the role of poaching during over the years. The second chapter is an important part of the thesis, it processes sources of the gamekeeping legislation. The international legislation related to many international contracts focused on component aspects of the environment protection is mentioned first.It is also necessary to deal with the legislation of the European Union, of which the Czech Republic is a member, in which the legislation is included...
