Sexually motivated cybercrime

1 Thesis title, keywords and abstract Thesis title: Sexually motivated cybercrime Keywords: cybercrime, virtual child pornography, sexting, pornographic performances, cyber grooming, sexual solicitation of children This master thesis deals with the issue of cybercrime against persons more specifically with sexually motivated crimes. The thesis is divided into five separate chapters. The first chapter deals with cybercrime in general, its taxonomy and the necessary terminology, it also describes some of the criminogenic factors of cybercrime relevant for the issue. The second chapter presents the most important applicable international legal instruments. The third chapter describes the issue of illicit pornography especially child pornography. For the subsequent chapters the author's own taxonomy was used and they overlap in part. The fourth chapter explores the phenomenon of sexting and the use of web cameras for sexual purposes as a consensual activity. In the fifth chapter the misuse of these activities for the purposes of child grooming, extortion and commercial sexual exploitation of children is examined. Criminological aspects of cybercrime Abstract (EN) This thesis is a study of specific aspects of cybercrime in regards to banking and non- banking financial institutions in Czech republic. By comparing results of third-party analytical resources and own findings obtained by strategically performed interviews with personnel in leading positions in cyber-security careers, the thesis describes causes and results of cyber-attacks and related preventive measures with emphasis on their respective place and priority in the cybersecurity policy of the organization. The main finding is that the biggest risk to the organization seems to be its own employees. That is why the entity cannot simply trust in the security of its perimeter by protecting only its border, but has to also consider its internal part. An equally important finding is the fact that mechanisms for the prevention of cybercrime take a large number of non-mutually exclusive forms, and in order to maintain the highest possible level of security, it is appropriate to layer these measures into complex units. Criminological and criminal law aspects of the ransomware spread

The subject of this diploma thesis is the ransomware spread, which is currently one of the most prominent global cybernetic threats. Ransomware is malicious code that, when activated on a computer system, usually blocks access to that system or encrypts the data contained in it, which is then used to blackmail the user. This thesis deals with criminological and criminal aspects of this phenomenon. In its criminological part, this thesis deals with the issue of the etiology of the ransomware spread and its criminogenic factors, while examining, among other things, the applicability of cybercriminological theory named space transition theory to a given phenomenon. It also deals with the victimological aspect of the matter, listing the most fundamental factors influencing victimization, both in the case of widespread non-targeted ransomware attacks and in the case of specifically targeted attacks. It also examines the issue of the high latency of this phenomenon and cybercrime in general and the possibility of prevention, which it considers to be the best way to defend against a ransomware attack. Today, the phenomenon of cybercrime can no longer be considered something obscured or unknown to the general public. Yet the majority of general population is aware of only a fraction of the offenses committed in cyberspace. As a result, a substantial proportion of Internet users act in violation of valid legislation in cyberspace, whether they do so knowingly or not. Cybercrime cannot be considered less dangerous than other forms of crime. On the contrary, due to its availability, globality and possible distance of the offender from the crime itself, this kind of criminal behaviour is on the rise year by year and its effects are becoming more severe, mainly due to the dependence of today's society on information and communication technologies. The aim of this thesis is to provide an introduction to the cybernetic world crime and offer a general view of the various aspects of this criminal activity. 1 Latent criminality Abstract This submitted diploma thesis deals with the phenomenon of latent criminality. Latent criminality is the part of criminality that is for some reason not registered by the law enforcement authorities. The thesis itself consists of four consecutive chapters. The first chapter deals with the concept of crime. It discusses the different approaches to concept of crime in criminology and the indicators that are used to describe it. Furthermore, this chapter is dedicated to the division of crime into latent and registered crime and the sources of information about registered crime. In particular, it focuses on official crime statistics. In the second chapter, the issue of latent crime is discussed in more detail. It defines the concept of latency, in which cases it is considered being latent criminality and what its types are. Furthermore, the ratio of latent and registered crime, the rate and extent of latency are described. At the end the possible causes of its existence are presented, one of the main reasons being the failure to report the crime by its victims. Violation of Authors' Rights Using Cyberspace Abstract This diploma thesis describes violation of authors' rights in cyberspace, especially the most common ways of committing this crime. The thesis is divided into five parts. The first chapter contains a general introduction to the topic, it defines the basic concepts (such as computer and related terms of hardware and software, internet, cyberspace and cybercrime), which serve as a basis for other parts of the work. The second chapter deals with copyright as such. It explains the concept of copyright work and describes the individual rights of the author. Given the nature of this criminal activity, it is not possible to limit the interpretation to the criminal law regulation. The second chapter thus indicates what rights of the author are affected, which works are subject to copyright infringement, which works are excluded from copyright protection and, finally, what are the limitations and exceptions to copyright. The third part is followed by a brief overview of the legislation that can be applied to the area of copyright (or generally to cybercrime). The master thesis is divided into five separate chapters. The first chapter deals with the general definition of cyberbullying as a new phenomenon and its comparison with the traditional form of bullying, defines other key terms and defines the victim and perpetrators of this behavior, including these types and typology. The second chapter introduces cyberstalking, which is compared to stalking, following the example of the first chapter, again defines and defines the basic concepts that are characteristic of this issue, as well as the perpetrator and victim, considering their patterns of behavior, typology, and motives, which lead the aggressor to commit an infringement. Legal provisions on cybercrime in the European Union Abstract This thesis deals with a complex phenomenon of cybercrime from the perspective of legal provisions of the European Union. Therefore, the thesis presents the fundamental features of cybercrime and presents the fundamental typology of this crime, which is supplemented by examples of the most common crimes. This general framework describing cybercrime is followed by an analysis of the legal provisions of the international law and Union law. Witihin the framework of the international legal provisions the thesis presents the activities of the universal organizations, in particular the Council of Europe, whose international convention on cybercrime is also subject to the analysis, and of the regional organizations.The legal regulation of cybercrime in the European Union is examined from the point of view of both primary and secondary law, outlining the fundamental orientation of the Union's policies concerning information technology. Following the clarification of the EU legal provisions on cybercirme, the thesis also presents the legal framework of such area within the Canadian law. Internet and computer criminality Summary This thesis, as its name indicates, deals with the problems of our times associated with computers and the Internet, which make it possible to commit all sorts of crimes. Computers are part of our daily life and the sphere of information and communication technologies are constantly and rapidly developing, which gives space to potential perpetrators to find new approaches. The thesis is composed of eight chapters. The opening chapter of this thesis describes the basic concepts related to computer and Internet criminality. It includes the definitions of computer criminality, cybercrime, cyberspace, as well as basic technical concepts such as computer, hardware or software. Approximation of this terminology is essential to understanding the issue. Next chapter is devoted to some illegal activities in cyberspace, which are then legally assessed.
