This bachelor’s thesis is focused on the analysis of environmental tax reform planed in the Czech Republic. First part contains theoretical definition of environmental related taxes. In next parts there are described basic principles and recourses of environmental tax reform and analysed proposals of environmental tax reform in the Czech Republic. As a practical model environmental tax reform in Germany is analysed. Its progress, consequences and general effects are appraised.

1 Abstract Protection of property rights and the enviroment In this diploma thesis I deal with the relationship between environmental protection and property law. I divide it into four parts. In the first one, I describe the right to property, the limits of the right to property, expropriation for environmental protection, the ownership of individual components of the environment, environmental protection and the conflict between the right to property and the protection of the environment. In it, I deal specifically with the ownership of waters, wildlife, mineral wealth and caves. The second part focuses on the types of restrictions on property rights for environmental protection and their typology. It is a division into internal and external, according to the method of origin and according to the obligations imposed on the addressee. In it, I also define the public and general interest. In the third part, I discuss the limitations for the protection of agricultural land, forest protection, water protection, and the protection of nature and landscape. Status and role of public guards in environmental protection Abstract The thesis deals with the status of public guards within the legal system of the CZE and the role of public guards in environmental protection. The aim of this thesis is to provide a relatively comprehensive analysis of the current legal regulation of individual public guards operating in the relevant sections of environmental protection, and to make de lege ferenda proposals leading to the improvement of the effectiveness of public guards, based on the confrontation of the current legal regulation with the shortcomings that public guards face in the performance of their activities in practice. According to the current legislation, there are four types of public guards. Public guards are divided into hunting guards, fishing guards, forest guards and nature guards, which are further divided into wardens and correspondents. Furthermore, the public guards themselves can be either voluntary, who perform their duties on a voluntary and honest basis, i.e. in their own time and without remuneration, or professional, who perform their duties in the context of an employment relationship. Protection of owl species living on the territory of the Czech Republic in international, EU and national European law Abstract There are ten species of owls in the territory of the Czech Republic. The once widespread order of carnivorous birds has faced unprecedented pressures as result of landscape change and civilizational demands in recent decades, as a result of which their European populations are shrinking. For these reasons, a need has risen to protect owls at the level of individual national legal systems, at the level of EU legislation and in the sphere of international conventions. In the first part of this thesis, the biological specifications of owls as well as their ecological and agricultural importance are explained. The thesis also follows the legal mechanisms, the overall level of legal protection of owls and the application of standards for the protection of owls in international law, European Union law and nationals' law, all of which is reserved for the second part of the thesis. The international legal protection of owls is emphasized due to the large fluctuation of bird species across countries and continents. 1 Expropriation in environmental protection Abstract This diploma thesis deals with the issue of the institute of expropriation and its possible use in the context of environmental protection. Expropriation is a legal instrument that interferes with the property right to achieve a specific purpose in the public interest. It is the instrument ultima ratio, which is only used subsidiarily, unless other tools lead to achieve the desired purpose. The aim of this work is to analyze the legal regulation of expropriation and answer the question of whether the czech law provides legal support for the use of this institute for environmental protection. In addition to the introduction and conclusion, the diploma thesis is divided into two main parts. The first part is paid to the definition of the concept of expropriation and its general regulation contained in the Expropriation Act. Greater attention is dedicated to the constitutional and legal conditions of expropriation, which must be fulfilled for the possible interference with the right of property. The constitutional conditions are the public interest, legal basis and compensation. It specifies the theoretical requirements related to environmental management and the ISO 14 001 standard, along with theoretical concepts related to carbon footprint. It includes an analysis of the environmental system in place and a calculation of the overall carbon footprint of the company. The paper concludes with suggestions and measures to reduce the overall carbon footprint of the company in order to have a lower environmental impact.
