Postavení a úloha veřejných stráží při ochraně životního prostředí Abstrakt Daná diplomová práce se věnuje tématu postavení veřejných stráží v rámci právního řádu ČR a úloze, kterou veřejné stráže plní při ochraně životního prostředí. Cílem této diplomové práce je jednak podat relativně komplexní analýzu platné právní úpravy jednotlivých veřejných stráží, působících na příslušných úsecích ochrany životního prostředí, jednak učinit návrhy de lege ferenda, vedoucí ke zlepšení efektivity veřejných stráží, a to na základě konfrontace platné právní úpravy s nedostatky, s nimiž se veřejné stráže potýkají při výkonu své působnosti v praxi. Dle současné právní úpravy rozlišujeme mezi čtyřmi druhy veřejných stráží. Veřejné stráže se člení na mysliveckou stráž, rybářskou stráž, lesní stráž a stráž přírody, která se dále člení na strážce a zpravodaje. Dále samotné veřejné stráže mohou být buď dobrovolné, které vykonávají svou funkci na bázi dobrovolnosti a čestnosti, tedy ve svém volném čase a bez nároku na odměnu, nebo profesionální, které vykonávají svou funkci v rámci pracovního poměru. Jako zajímavost lze uvést, že inspektoři České inspekce životního prostředí jsou rovněž lesní stráží. Do funkce veřejné stráže může být ustanovena toliko fyzická osoba, nikoliv právnická osoba, přičemž veřejné stráže při výkonu své... Status and role of public guards in environmental protection Abstract The thesis deals with the status of public guards within the legal system of the CZE and the role of public guards in environmental protection. The aim of this thesis is to provide a relatively comprehensive analysis of the current legal regulation of individual public guards operating in the relevant sections of environmental protection, and to make de lege ferenda proposals leading to the improvement of the effectiveness of public guards, based on the confrontation of the current legal regulation with the shortcomings that public guards face in the performance of their activities in practice. According to the current legislation, there are four types of public guards. Public guards are divided into hunting guards, fishing guards, forest guards and nature guards, which are further divided into wardens and correspondents. Furthermore, the public guards themselves can be either voluntary, who perform their duties on a voluntary and honest basis, i.e. in their own time and without remuneration, or professional, who perform their duties in the context of an employment relationship.
