103 Resumé / English summary Title of the thesis: Legal aspects of implementing Creative Commons project in the Czech Republic Summary: The main topics of this master thesis are Creative Commons public licenses and legal questions arising in connection with their porting to the Czech legal system, i.e. creating Czech versions of these licenses that mirror the spirit of the original licenses while reflecting the particularities of Czech copyright and Czech law in general. Since public licenses are not yet an established concept in the Czech Republic, the first part of this paper (Chapter 2) introduces several public licenses (presented license) to create a sufficient background. Beside the main goals and features of the Creative Commons (CC) license system, GNU General Public License (GPL), GNU Free Documentation License (FDL) and Creative Archive License (CA) are presented in a similar way and a comparison of these licenses follows on the level of license elements, i.e. the main characteristics that determine the scope of the individual licenses. The aim of Chapter 3 is to produce a legal definition of public licenses. 69 Software Piracy As this thesis suggests, it is possible to only speculate about further development in the sphere of software piracy. While in the past households were proud of Internet access whose connectivity hardly exceeded 56kbps, information technology now develops at an incredible pace and organisations such as BSA can hardly measure up with it. Nowadays, downloading files via the Internet is quite an easy job for any average user and in my opinion it is beyond the capacity of any organisation to call on all these Internet users and frighten them, or to conduct with them expensive legal proceedings with uncertain and vague results. In my thesis I try to explain that the result of efforts in this respect should be, above all, co-operation amongst the relevant organisations, the government, software piracy specialists and software producers and that all these stakeholders should in particular focus on public education, trying to explain the basics of this problem, and on psychological prevention. As the use of the Internet expands, so does software piracy. It is better to change this situation by precise legislative provisions, on which the authors will be able to rely firmly, rather than by repression. The scope of liability to damages under the Commercial Code

Extend of liability for damage in the Commercial Code The general private legal regulation of liability for damage is stipulated in the Civil Code (hereinafter referred to as "ObčZ"). The Commercial Code (hereinafter referred to as "ObchZ") also contains some provisions regulating damages, mainly those for breach of contractual obligations and obligations prescribed by the Commercial Code. This regulation of damages shall be used in relations governed by it as a matter of priority. In order to claim damages according to the Commercial Code, all the following basic preconditions shall be met: - occurrence of damage - breach of legal obligation - causal relation between occurrence of damage and breach of legal obligation And at the same time - there are no circumstances excluding liability for breach of obligations The Commercial Code stipulates the liability for damage as no-fault liability. It means that the liability relation is not conditioned by fault and occurrence of the above presumptions is enough. Pursuant to s. 379 of ObchZ, "damage" means actual damage and loss profit. Both judicial practice and legal theory consider actual damage as damage to property in the form of reduction of property of an injured party as a result of an event causing damage. Marketing and business ethics in branches protected by copyright

The thesis is focused on an analysis of marketing tools and business policies, applied on the field of commercial publishing. First part is dedicated to an analysis of the copyright law that affects the activity of this sort of companies. It includes an explanation of the most important parts of the copyright law that is valid in the Czech Republic. There is a display of important international standards, considering the issues of intellectual property. The second chapter relates to the theory of marketing and ethical issues of commercial and business activities. It includes a definition of basic terms, marketing tools, and a step-by-step clarification related to developing a marketing strategy. The end of this chapter summarizes the options of using marketing tools in publishing. Eventually, the thesis deals with pieces of knowledge, gained during its writing. Two different ways of creating a marketing strategy for the Knižní klub publishing company are considered in the end of the thesis. Both ways are described in detail, and compared to each other.

The sale of the enterprise and of it's part

The main topic of this project is the sale of the enterprise or of it's part, from the point of view of taxes, law and accounting mainly. The main point is to explain fundamentals of the enterprise as the object of business-law relations, analyze the selling-transaction and it's image in financial accounting, from the point of view of the accounting and also in tax evidence of each participated part. With using the knowledge of financial accounting, I explained these questions at one complex example. This project shows, that the sale of the enterprise as the Equity acquisition is complex topic, in which to observe come specific rules, laws, clauses, public notices not only czech, but also international law is necessary, that could lead to a successful conclusion of this kind of trade.

Ivan Houfek ak. rok: 2011/2012 2 Abstract in English This work deals with issues of trusts and open ended investment companies with regard to the legislation of countries with common law legal system. Trusts are specific common law legal concepts which have no equivalent in legislation of countries with continental legal system. They are based on different features of ownership and on other specific legal concepts. Among these concepts for example belongs common law and equitable ownership or joint tenancy. Trusts have evolved from the medieval concept called "uses", therefore no legal definition of trusts is provided. Trust has no legal personality but neither is it just an obligation. Trust is used to be defined as "an equitable obligation, binding a person (who is called a trustee) to deal with property over which he has control (which is called the trust property) for the benefit of persons (who are called beneficiaries) of whom he himself may be one and any one of them whom may enforce the obligation". New media in the art world

This work creates a unique view into the world of new media. It focuses primarily on artists of their sphere of production and usage of new media. At first, there is specification of a connections between technology and arts from a historical periods. Then the work focuses on the newly created artistic movements, which are closely related to new media. Due to the consistency of new media and Web 2.0 is here and list of the specific media used by artistic community. It describes in detail the problem of distribution of works on the Web under copyright law. There is an empirical research that find literacy work with audiovisual equipment and use of digital illegal way to get an art.

Retail concept analysis of the IKEA Company

The aim of this diploma thesis is to analyse the retail concept of the IKEA Group. The theoretical part focuses on retail concepts in general, trends which are currently having a significant influence on retail concepts and the country of company's origin -- Sweden. The practical part analyses three main pillars of its retail concept -- catalogue, store and web site. Further it analyses Company's marketing tools, IKEA's trademark, copyright and its activities related to environmental sustainability and corporate social responsibility.
