Declaratory principle in contentious and non-contentious proceedings

The topic of this diploma thesis is the declaratory principle in contentious and non- contentious proceedings. The aim of this thesis is to describe how the declaratory principle is applied in both forms of Czech civil proceedings, contentious and non-contentious. There are some differences between application of the declaratory principle in a contentious proceedings and application of this principle in a non-contentious proceedings. Parties are much more free to dispose of their claims in contentious proceedings, because the declaratory principle is one of the main principles of this form of civil proceedings. It is necessary to say that legal system in the Czech Republic is the continental legal system and the declaratory principle is traditional for continental legal system. The declaratory principle also means that the court is limited in its decision making. It is not possible to decide more than it has been asked to. The major part of this thesis is about disposition acts. How it was mentioned before, parties are free to dispose their claims in contentious proceedings and the reason for it is that they are able to use many disposition acts. Principles of private law

Principles of private law The reason of choosing "Principles of private law" for my thesis is that private law is built on untouchable values. For example, basic values like freedom and equality, which are represented by these principles. Many of them are indispensable in the relation of functionality of the whole system of law. Most of them have Roman law origin. The purpose of my thesis is to describe and summarize the main principles of private law that mostly appear in Czech law, especially in civil law. It also examines the influence of re-codification of private law on these principles and relationship between them. The thesis is composed of two parts. Part one, named general part, is introductory and defines different meanings of principles of law in Czech jurisprudence. It deals with historical perspective (Roman law connections to principles of law) and philosophical context (represented by concepts of legal positivism, theory of natural rights and sociological concept of law) of principles of law. It also describes the theory of principles of law by Ronald Dworkin. Part two, named specific part, focuses on principles of private law and contains the overview of them. Testing of Surge Arresters

This bachelor's thesis is devoted to metal oxide surge arresters. After historical and theoretical introduction, which explains their principles and describes their characteristical properties, analysis of the standard IEC 60099-4 and testing according to the standard with focus on the type tests follows. This chapter is also amended with review of the standard's imperfections and with its most probable future development. The work concludes with a market survey, a review of the largest manufacturers and a comparison of their products.

Electric microdrive with ultrasonic motor

This thesis is focused on selected kinds of piezoengines and their ability to control and follows the separate semester project. It mainly deals with technnology called Piezo LEGS and Piezowaves. Attention is paid to their structure, principles, parameters, characteristics, but also to field of their application. Next section is laboratory measurement of those species of piezoengines (demo-kits). At the end thesis contains three laboratory task, each type of engine is dedicated toone task. The contents of the work is focused on innovation activities in the learning process.

To calculation methodology of baseless enrichment

The issue of determining the amount of unjust enrichment in the construction lies in the fact that there is no legislation or other methodological tool that would assist for example legal experts in building above unjust enrichment. Through the analysis of individual problems, their evaluation and subsequent proposal for a potential solution procedure, to create a methodology that would facilitate the work. Within this article will explain the problem situation, are sampled possible division of examples at unjust enrichment in the construction and subsequent application of the problem in the example.

Ranque-Hilsh vortex tube

Ranque-Hilsch vortex tube is thermally-fluid device in which there is a conversion of the pressure energy of the incoming fluid stream to heat energy of two exiting streams without any mechanical parts. The first part of this paper deal with the basic distribution, applications and principle of the vortex tube, which is not fully understood. In the second part there has been carried out a search about performed experimental measurements. Based on this research is designed optimized experiment. The last part of work is the evaluation of the measurement, which was carried out on an industrial vortex tube.

Principals of tax administration and tax law

This thesis deals with main principals of tax administration and tax law, their compliance or violating in particular situations. Presenting of their content and real meaning is provided by description and explanation of their (wrong) application under various circumstances. The Supreme Administrative Court´s case laws and jurisprudence of the Constitutional Court are significant sources of information in this part. Along with accompanying effects arising from violating the principles this thesis continues with analysis of Working pensioners affair, especially the case n. Pl. ÚS 31/13. Here the provision of § 35ba art. 1 l. a) Income Tax Act has been contested according to which the tax of a taxpayer, who is a recipient of an old-age pension benefits from statutory pension insurance scheme or similar abroad one at 1st January of the taxable period, shall not be reduced by the basic amount of 24 840 CZK. There are not omitted demographical, legal and economic aspects of the affair in this thesis as well as relevant regulatory development for the years 2000 to 2015. The thesis brings evaluation of compliance or violating of the principles of tax administration and tax law through the analysis of key elements in own review.

This work describes selected the technical monuments in South Bohemia and the technical monuments are described in detail. This work technical monuments shows the basic technical functions and the use of known physical phenomena in their construction. These monuments are grouped into thematic groups with respect to mining, transporting and processing of raw materials. Selection specific monuments was carried out on the basis of their importance and uniqueness in the context of South Bohemia.

Práce se v obecné rovině zabývá vztahem mezi legislativní a exekutivní mocí v otázce dělbě moci. Analýza se zaměřuje na neslučitelnost funkcí vykonávání mandátu v zastupitelské instituci s působením ve vládním orgánu. V určitých zemích je výkon vládního postu spojen s dočasným či trvalým pozastavením zastupitelského mandátu. Tato forma neslučitelnosti je upravena Ústavou či příslušným zákonem. Existují rovněž situace, kdy účast ve vládě je přímo podmíněna členstvím v parlamentu.

Experience Pedagogy and it Approach to the Education and Upbringing of Children and Youth

The thesis brings out and analyse pedagogy approach to the education by the experience. The theoretical part characterizes basic concepts of the education and the upbringing, experience pedagogy and its parts. The thesis describes historical evolution of experience pedagogy and analyses the basement of pedagogical approach to the experience education. The thesis provides the summary of activities of experience pedagogy that can be used at school during leisure time. The practical part contains the probe of using experience pedagogy activities at schools during the leisure time. The skiing courses were selected for the probe. Teachers in all three courses used the principals of experience pedagogy but their procedures are not well processed according to unfamiliarity with experience pedagogy. The strongest weakness arose at the feedback phase. I researched that the vocational knowledge is essential for children education though positive pedagogical approach. The personality of the teacher is significant point of view because the personality of the teacher is the basement for everything else. According to my research I presume that experience pedagogy approach has great value and will be used more for the education and the upbringing of children and the youth.
