Analysis of public procurement in chosen municipality

The bachelor's thesis is dedicated to analysis of public procurement in Dacice. Theoretical part is focused on legislation of public procurement in the Czech Republic, the basic concepts and the procurement process. Practical part deals with the analysis of the budget of Dacice and with the analysis of public contracts, which the city enters. Attention is paid to the possibilities of evaluating public contracts, the types of procurement procedures, the expected and final value of the contract, the number of offers and the administrative costs of public procurement. The results of the case studies are compared with the data on public contracts awarded in Trebon and on the public procurement market in the Czech Republic.

This Bachelor's thesis follows up the conditions of participation in procurement procedure for public construction work contracts. The first part characterizes the procedure in the public procurement regime. The particular conditions of participation are described in theory. The second part describes the influence of the conditions of participation on the course of the procurement procedure and the selection of a supplier using practical examples.
Decision-making practice of the Office for the Protection of Competition in cases of proving qualification requirements in public tenders

RESUMÉ AJ "Decision-making practice of the Office for the Protection of Competition in cases of proving qualification requirements in public tenders" The annual report of the Office for the Protection of Competition for the year 2014 comes to a conclusion that the most frequent mistake of a contracting authority is stipulation of disproportional (discriminating) qualification requirements. The objective of my paper is shedding light on selected contentious areas that are dealt with by the Office for the Protection of Competition, by regional courts or by the Supreme Administrative Court respectively, thus illustrating the most frequent mistakes committed by contracting authorities when stipulating qualification requirements. The paper is structured into several chapters for addressing the selected topic. The first part of the paper introduces the basic concepts and the institute of public tenders closely related to subsequent setting of qualification requirements while also referring to elementary judiciary practice. The subsequent chapters describe particular categories of qualification requirements like elementary qualification requirements, vocational qualification requirements, economical and financial qualification requirements, as well as technical qualification requirements. The small-scale public contracts and their legal regulations in the Czech republic The goal of this thesis is to make a brief characteristics of a legal insitut of the small- scale public contracts and its legal regulations in the Czech republic with regard to international law and law of the European Union. The tesis in their openning chapters approaches and explains a term and importance of the small-scale public contracts as applicable law recognizes them recently, whereas does not omit an importance of historical consequences of recent law with rules of the times of the Austria-Hungary. Then this thesis deals with the rules of public procurement in the form of the small-scale public contracts according to the legislation which was contained in a code No. 199/1994 C.l., of commission of public contracts and in a code No. 40/2004 C.l., of public contracts. Budget management by public contracting parties with respect to invitation for public tenders

The subject of the thesis is "The Budgetary Management of Contracting Authorities With Relation To Public Contract Awarding". It attempts to point out some relations between the budgetary law and the law of public procurement on the example of public contract awarding carried out by public contracting authorities. The thesis is composed of six chapters. The first chapter deals with the definition of the budgetary law, it subject matter and its legal sources. The second chapter presents the definition, the subject matter and the legal sources of the law of public contracts. The third chapter follows in which the basic concepts and legal institutions of the budgetary law and the law of public contracts are presented. The fourth chapter describes the main principles by which the budgetary law and the law of public contracts respectively are governed. In the sixth chapter some aspects of the public contract awarding and their impacts on budget management are briefly mentioned. The last chapter shortly discusses the field of a budget management control in connection with the public procurement.
The process of public tenders for the police

The aim of the thesis is evaluation of the public procurement issue in the Police of Czech Republic (Policie České republiky) namely from beginning of the public procurement until its realization. Aim of the thesis is evaluation of the process of public procurement in the Police of the Czech Republic from the theoretical point of view, thus description legislative environment and from practical activities involved subjects the point of view as well. Procedure itself of the public procurement is regulated by the generally regulated legislation, but regarding to the subject of the contract owner like Police of the Czech Republic, is this procedure determinate by the Ministry of the interior regulation. One of the basic presumptions for effective and economical spending of the public funds, not only in the police, but also in the whole public administration, are correct public procurement when buying services, supplies or building operations. In this thesis is described procedure in the realization of the public procurement from its planning until contract concluding. In the thesis are also mentioned subject, which are involved in this process including their rights and responsibilities.

Qualification Prerequisities of Submitters of Public Orders on Construction Works

The master’s thesis is about qualification prerequisities of submitter of public orders on construction works. The first four theoretic chapters discuss the submitters and kinds of public contract. There are analyzed particular selection procedures including open simplified underlimited procedure and small-range contracts, which are related to the second part of the master’s thesis. After that there is presented practical part. The main point of this work is to determine which of the qualification prerequisities are for submitter of public orders the most important. Consequently there is recommended which of the qualification prerequisities is convenient to use. The master’s thesis inculdes prices‘ development of public contracts on construction works in the sphere of traffic in years 2009 – 2011.
