Reflexion of the Effect of Group Work in People after a Divorce

This thesis examines the effect of group programme for clients of marriage counselling, who are going / have gone through a divorce, or disintegration of cohabitation (or possibly through other difficult situations connected with marriage, partnership, family …). The first - theoretical- part consists of a summary of the relevant literature related to the topic focusing on stages of divorce. The second part involves a qualitative analysis of eleven interviews with clients - attendants of two cycles of the programme and an analysis of a focus group. The analysis of the interviews has resulted in an individual reflexion of the effects of the programme and an attempt on formulation of efficient strategies of the help during the divorce process with focus on restoration of social integration during the restructuring stage after the divorce. The obtained results show that the clients consider the programme efficient and helpful during adaptation to divorce/disintegration of cohabitation in terms of changing their perspective on the course of their marriage/ partnership and their divorce/break up crisis. The divorce and its civil-law consequences

My dissertation thesis is concerned with the theme of divorce and its civil-law consequences. It would be difficult to find any other legal concept in the real life that has undergone so many changes as divorce and the associated civil-law consequences. While compiling this thesis I strived to become acquainted primarily with any available theoretical sources, such as commentary literature, specialised books, legal textbooks and, last but not least, also specialised magazines, both printed, such as Právní rozhledy, Soudní rozhledy, Rodinné právo, Právo a rodina and Právní rádce, including magazines published by relevant professional chambers - Bulletin advokacie (Czech Bar Association), Ad Notam (Notary Chamber of the Czech Republic) and Komorní listy (Chamber of Distrainers of the Czech Republic), and the electronic ones, such as epravo.cz or eLAW.cz. Where relevant legal opinions on a particular matter varied, I recorded this plurality of opinions and, at the same time, I formulated my own stance. As the topic of my thesis consisted in studying applicable law, I heavily stressed that account should be taken of any decisions of general courts as well as of the Constitutional Court. The question of divorce in the Czech Republic and Germany in comparison

In this thesis, I primarily deal with the question of divorce in the Czech Republic in comparison to Germany. The objective is to describe the legal regulation of divorce in general and the legal regulation of the visitation and education of children after the divorce and the historical development of the legal regulations. The thesis shows that the German legal regulation of divorce is often more detailed and elaborated. Finally, it is possible to state that both legal regulations are in the main part very similar and have the same principles.
Property consequences of the divorce of marriage

The topic of this thesis is "Property consequences of the divorce of marriage". I have chosen this topic because of the high number of divorces that are filed for. This thesis characterises the two main property consequences of divorce, the settlement of community property of spouses and the settlement of common household of spouses. The purpose of the thesis is to compare the current legislation, contained in the Civil code from 1964 with the proposal of the new Civil code, analyse the advantages and disadvantages of both acts and express my opinion on it. The thesis is composed of eight chapters. Chapter One is introductory and defines the purpose of this thesis. Chapter Two defines the term "divorce", its three types and consequences of divorce. Chapter Three illustrates the conception of property relationships between spouses in the past. Chapter Four defines the term "community property of spouses", its consent, extent and modification. The most important and key chapters are Chapter Five and Chapter Six. Chapter Five is subdivided into seven parts and it deals with the settlement of the community property of spouses. Case study - Divorce and its circumstances

In my thesis I dealt with divorce. The aim was to highlight the circumstances of a real case which a person can be encountered with during divorce proceedings, with special focus on child custody. What has been analyzed is the old legislation of family law as well as view from a perspective of the new Civil Code. In the end of the work, progress of divorce proceeding and approach of responsible authorities has been evaluated.
The social counseling during a divorce in the family

My choice of dissertation subject was influenced by the fact that there is a increasing number of divorces in recent years. This fact is supported by data from the Czech Statistical Office, which imply that every second marriage ends in divorce. It is impossible to define a clear-cut cause of the trend, because the decision to get divorced is influenced by many factors. These include the increasing pace of social changes, different approaches to problem-solving and to life in general, a specific argument between the partners that leads to a deep and lasting disharmony between them and many others. A divorce is a painful matter for all those involved. It influences broad areas of everyday life and has consequences for the adults as well as for the children (in the case of a divorce where children were born during the marriage). When the family situation is so unsettled that a compromise is difficult to find, it is possible to use an institution or a facility, which can offer social counselling according to law no. 108/2006 of the Collection of Laws on social services, in full wording. We differentiate between basic and professional social counselling. In the case of divorce, professional counselling is appropriate and can be accessed for example via counselling units for families, marriages and interpersonal relations which have this service properly registered within their remit. The extent of the use of these services was the research subject of this dissertation. The aim of this dissertation was to ascertain if families going through a divorce are accessing social counselling to resolve their situation and with what effect. To accomplish the stated aim, three investigative questions were chosen. 1.From what sources are the families informed about the possibility to take advantage of social counselling? 2.How does taking advantage of social counselling help families undergoing a divorce to resolve the life situation? 3.What do the families gain as a result of taking advantage of social counselling? A qualitative research strategy was chosen to collect the necessary information, using a survey method. Two techniques were used firstly the questionnaire containing closed questions and secondly the technique of in-depth interviews of selected respondents. The research was split into two phases. During the first phase a questionnaire with closed questions was used to establish which of the families took advantage of social counselling during divorce. During this phase the basic research set S1 was formed by the subset of respondents that went through divorce. This totalled 47 respondents chosen by the "snowball sampling" method. Using this method the chosen subject recommends further respondents that fulfil the conditions of the research. All 47 respondents agreed to fill in the questionnaire. The second phase of the research involved interviews with respondents forming the selective subset S2. This subset was created using quota selection from respondents who answered YES to the first question of the questionnaire.This select set was formed by 5 respondents. The interviews were transcribed into a recording form and the gathered data was further classified based on predefined questions or areas of the research enquiry, followed by analysis and comparison with the answers of other respondents. The purpose of this dissertation was to show, based on research carried out, if and to what extent the service of social counselling is used, which opportunities it offers and how it benefits the people taking advantage of these services. It was clear from the results, that the utilisation of these services is limited by the fact that a significant number of divorcing families, for whatever reason, does not look for this help. Conversely, the respondents that used social counselling benefited from this service whilst solving problems associated with their divorce, often simplifying the process.
Divorce of marriage and its impact on the education of dependent children

Divorce rate in the Czech Republic is high. In 2013 an increase of the number of divorces was recorded in comparison to the previous year 2012. A total of 27 900 marriages were divorced in 2013. Majority of which had underage children. Marriage divorce is one of the most stressful things in the life of a human being and is the consequence of long crisis in the marriage. Common cause of this crisis are different personalities, opinions and interests, cheating, alcoholism or lack of interest in the family. Divorce is a difficult time for parents and thein children and its consequences are manifested in everyday workings of the family. This work is divided into theoretical and practical parts. Theoretical part explains the basic concepts, for example: divorce of a marriage and its causes, legal interventions of divorce and situation of minors after the divorce, for example: exclusive single parent care, both parent care, alternating care. Following this the work deals with children's communication with the second parent, classmates, friends; Their school results and the change in their behaviour and behaviour disorders after the divorce. Practical part consist of determination of main and secondary target, description of chosen research process its methods and technique.The practical part contains a truncated form of reports on the results and the conclusion with recommendations for practical use. Main aim of this work was to find out how parents percieve consequences of divorce on the upbringing of their underage children. Secondary's part aim was to find out which parts of child raising were affected the most by the divorce. Thesis was processed by the qualitative research form. Questioning method was also used with the semi-structured conversation. Research file was created from five divorced marriages with underage children, which lived through divorce proceedings and at least a year passed. In the scope of the research it was found out, that parents perceive the consequences of the divorce on the upbringing of their children and that they try to minimise said consequences. It was also found out which areas of child raising the divorce effects the most. With this the main and secondary goal was fulfilled. This bachelor's thesis could be used as a theme for this subject in the form of quantitative research. The results could then be transferred to the general plane.

Case study - Separation of a matrimony and its terms

The topic of my work is the separation of a matrimony, its influence over property relations and common relationships in the family. I will analyse a real case of a divorcing couple with two children and I will apply appropriate laws to variou situations. Every application of law compares the real status with the theory based on the law. The last part of this work evaluates the work of courts and the police and presents some amendments.
