Tato diplomová práce nese název "Majetkoprávní důsledky rozvodu manželství." Toto téma jsem si zvolila, protože vzhledem k vysokému počtu rozvodů jde o stále aktuální a přínosné téma. Cílem mé diplomové práce je objasnit problematiku dvou významných majetkoprávních důsledků rozvodu manželství, a to vypořádání společného jmění manželů a vypořádání společného bydlení. Práce je členěna do osmi kapitol, z nichž první je úvodem a poslední závěrem; vlastní text práce tedy tvoří kapitola druhá až sedmá. Druhá kapitola je věnovaná pojmu rozvod manželství a jeho důsledkům. Ohledně společného jmění manželů a majetkových vztahů mezi manžely vůbec považuji za nezbytné věnovat pár poznámek historickému vývoji. Další kapitola se tedy zabývá vývojem manželského majetkového práva od roku 1811 do současnosti. Kapitola čtvrtá nastiňuje samotný pojem "společné jmění manželů", jeho obsah, rozsah i modifikaci. Jádrem mé práce a jedním ze dvou okruhů, kterými se podrobně zabývám, je vypořádání společného jmění manželů, kterému je věnována kapitola pátá. Jsou zde podrobně popsány jednotlivé způsoby vypořádání společného jmění tak, jak o nich hovoří literatura i judikatura. Druhým problémem, o kterém pojednávám, je společné bydlení manželů a jeho vypořádání. V kapitole šesté popisuji, jaké způsoby bydlení mohou manželé... The topic of this thesis is "Property consequences of the divorce of marriage". I have chosen this topic because of the high number of divorces that are filed for. This thesis characterises the two main property consequences of divorce, the settlement of community property of spouses and the settlement of common household of spouses. The purpose of the thesis is to compare the current legislation, contained in the Civil code from 1964 with the proposal of the new Civil code, analyse the advantages and disadvantages of both acts and express my opinion on it. The thesis is composed of eight chapters. Chapter One is introductory and defines the purpose of this thesis. Chapter Two defines the term "divorce", its three types and consequences of divorce. Chapter Three illustrates the conception of property relationships between spouses in the past. Chapter Four defines the term "community property of spouses", its consent, extent and modification. The most important and key chapters are Chapter Five and Chapter Six. Chapter Five is subdivided into seven parts and it deals with the settlement of the community property of spouses.
