Prevention in the Civil Code
Prokeš, Martin ; Šustek, Petr (advisor) ; Hendrychová, Michaela (referee)
Prevention in the Civil Code The topic of my thesis is prevention in the Civil Code. This thesis examines the definition of the concept of prevention within the Civil Code as a key aspect in the provision of general rules of mutual coexistence in our main legal code. Prevention is not only understood here as an effort to prevent illegal actions, but is extended to a broader concept of preventing damage or injury to the health and life of individuals in society, when its essence goes beyond the concept of law. The work reflects the development of the concept of prevention and its anchoring in the Civil Code, with an emphasis on various historical concepts and the development of legal regulations. The first chapter of the thesis analyzes various concepts of prevention mainly in a general sense, focusing on its importance in various fields, including medicine, social sciences and criminology. The content of other types of prevention such as primary and secondary or general and specific is also defined here. The second chapter is devoted to a brief summary of the development of the Civil Code as a legal code, with an emphasis on its development in Roman society, the Middle Ages and modern times. This part of the work also traces the transformation of the prevention institute itself in these individual...

State responsibility to prevent and control a pandemic
Mazánková, Zuzana ; Bílková, Veronika (advisor) ; Šturma, Pavel (referee)
1 Abstract State responsibility to prevent and control a pandemic The submitted thesis explores state responsibility under public international law and how it relates to the obligation to prevent, protect against, control and provide a public health response to international spread of disease. Epidemics are hardly a new or unprecedented phenomenon, and the increased incidence of seasonal influenza strains and other viral respiratory infections are a recurring theme every year. However, the issue of state responsibility for international spread of infectious diseases came to the forefront lately due to the events at the beginning of 2020 when a global pandemic of the new coronavirus COVID- 19 appeared, causing over seven million deaths by October 2023 and significant economic losses. The virus was first identified in China, which reported the outbreak to the World Health Organization (WHO) at the end of 2019. Shortly after that, despite public health measures being implemented, the infection began to spread worldwide via international travel, and multiple reports emerged that China had had information about this infectious disease a month before reporting it and deliberately concealed it, which would constitute a violation of International Health Regulations. Given the damage incurred by states, businesses...

Hunal, Jakub ; Sedláček, Miroslav (advisor) ; Pohl, Tomáš (referee)
Liability of the insolvency administrator for damage or other loss The topic of this thesis is the liability of the insolvency administrator for damage or other loss and its aim is to elaborate this topic in detail and to highlight the interpretative issues. The focus of the thesis is the analysis of the division of possible claims for compensation for damage or other loss against the insolvency administrator and the disputes arising from them. In the thesis I divide these claims into individual claims, i.e., claims that arise from the relationship between a particular claimant and the insolvency administrator, and claims that are related to the estate. In the case of these claims, their specificity is explained. The second division of claims is into claims that can be resolved through the application of the general provision on the insolvency administrator's liability for damage or other loss (§ 37 IZ) and claims to which this basic provision cannot be applied. Subsequently, the individual aspects of liability (prerequisites for the obligation to compensate for damage) are discussed, taking into account the specifics of the individual disputes. The nature of the individual prerequisites for liability and their relationship to the other prerequisites are always explained. The procedural aspects are...

Bače, Václav ; Prášková, Helena (advisor) ; Adamec, Martin (referee)
The presented diploma thesis aims to introduce the addressee of the text to the institute of liability of entrepreneurial natural persons for administrative delicts, which was introduced into the Czech legal system as a separate liability regime only with the adoption of Act No. 250/2016 Coll., on Liability for Administrative Delicts and Proceedings. Although an entrepreneurial natural person could, of course, have been the perpetrator of an administrative delict before, it was only with the adoption of the Act that its liability for administrative delicts was completely separated from the liability of a legal person for administrative delict. Therefore, the author of the thesis decided to discuss the regime of liability of an entrepreneurial natural person for administrative delicts in such a way that the addressee of the text would be able to get to know all important aspects of the functioning of the liability regime of an entrepreneurial natural person. The structure of the thesis consists of eight chapters including the conclusion. In the first chapter, the author defined the basic institutes constituting the very concept of liability of an entrepreneurial natural person for administrative delicts. Subsequently, the author portrayed the development of the liability for administrative delicts...
