The Resolution Fund: Is behaviour of the contributing institutions affected by the applied methodology?

Daniel Hykl Bachelor Thesis The Resolution Fund: Is behaviour of the contributing institutions affected by the applied methodology? Abstract The thesis provides theoretical analysis of the Resolution Fund contributions determination policy - the contributions are calculated based on end of year data - and its effects on banks and the financial sector. Several theoretical examples are used to demonstrate the problem of the top-down approach to distribution of the sectoral contributions on the particular institutions. A hypothesis is drawn - do the banks lower their reported liabilities as of end of the year to achieve decreased contributions? Total liabilities of the 7 largest banks in the Czech Republic are analysed and theoretical end of year developments of total liabilities of the banks under no optimisation condition are calculated. Basic annual contributions of the banks are estimated and compared to implied contributions calculated from the theoretical liabilities.
Instruments of banking supervision in European Union

European banking supervision has recently undergone major changes, through mere co-ordination of supervisory instruments, to the full integration of supervisory instruments in one centralized institution; European Central Bank (ECB). This master thesis deals with banking supervision instruments in the European Union while emphasises the instruments entrusted to the ECB under the second pillar of the banking union; the Single Supervisory Mechanism (SSM) and aims to analyse and evaluate their role in preventing potential financial crises. The establishment and development of a banking union is closely linked to the monetary union. Therefore, the first chapter deals with the development of monetary integration. The second chapter of this master thesis deals with the institutional arrangements for supervision at the European Union level, with an emphasis on the description of the organization and functioning of the ECB, which is at the forefront of the supervision of the banking sector within SSM. This bachelor thesis aim to bring near look to development of banking union building, describing single parts, explains under what circumstances was established, examines current state and evaluates its current and potential contribution or the risks which go alongside with banking union. It describes how European Union approaches to bank regulation and supervision and what lessons it has learned from financial crisis. It also predict the future structure of banking union and banking sector in Europe and analyzes the development of values, related to banking supervision and regulation.
Supervision in the banking industry

The aim of the thesis on Supervision in banking industry is to define the nature of banking regulation and banking supervision, including the rationale for their existence and the analysis of their goals. Another task of this work is to explain the ways of functioning of the basic components of banking regulation and supervision encountered in countries with market economies. The work also highlights the different perspectives, as well as some shortcomings of selected issues and outlines possible solutions. Finally, the aim of the thesis is to critically evaluate selected arguments for and against implementation of the European concept of the Single Supervisory Mechanism, including the assessment of the appropriateness of the Banking Union as a whole. The work is divided into three main parts. Supervision over the banking industry in the EU Member States

The goal of my thesis on Supervision over the banking industry in the EU member states is to describe critically and to define newly engendering concept of the banking union. It is a very actual topic because the effective mechanism creation, which should solve problems of the European banking sector, is currently one of the primary goals of the European Union. The study is divided into three chapters. The first chapter is the theoretical one. The definition and differentiation of the essential terms such as supervision and surveillance can be found there. Further the basic theoretical modules can be found there, from which it is possible to stem during the banking supervision implementation in practice. The second and the third chapters are the analytical parts. The introduction of the second chapter glances at the backgrounds of the legislative proposals acceptance in this area. Afterwards the chapter is already focused on four pillars of the proposed Banking union. The first pillar is formed with so called "single rule book", thus the uniform regulatory rules that are the implementation of the requirements expressed in so called Basel III. Das Ziel der gewählten Diplomarbeit zum Thema,,Die Europäische Zentralbank und die Bankenunion" ist es die historischen Entwicklungen, die der Schaffung der Europäischen Zentralbank vorausgegangen sind, sowie die Tätigkeit, den Status, die Funktionsgrundsätze und die Organisation dieses unabhängigen Unionsorgans aufzuzeigen, und schließlich die Entstehung und die Säulen eines neuen Phänomens der Bankenunion, darzustellen. Die Arbeit ist thematisch in vier Kapitel unterteilt. Das erste Kapitel stellt in seinen neun Abschnitten den historischen Hintergrund zu den Ereignissen des letzten Jahrhunderts dar, die die Fachwelt als signifikant für die chaffung der Europäischen Zentralbank angesehen hat. Analysis of participation of the Czech Republic in the Banking Union

The aim of the diploma thesis is to evaluate possible benefits and limits of The Czech Republic participation in the Banking Union. After the global financial crisis, Banking Union concept was undertaken as a response to decline of market confidence in the euro area banking systems. The Czech Republic is a country outside the euro area, therefore has an option to enter to the Banking Union by close cooperation agreement with the ECB. Historic development and structure of the Banking union is presented with the context of bank regulation genesis in European Union. After the theoretical part, thesis provides specific attributes of Czech financial markets and create a comparison of selected data among Czech Republic and European Union member states. Based on the detailed analysis of the relevant aspects, benefits and risks of the Banking union membership are provided.

Analysis of Single Resolution Mechanism

The final thesis follows the effort of the European Union to transfer responsibility for issues in the banking sector from taxpayers to its shareholders and creditors. It adopts many new tools and measures. The first part of the thesis is devoted to the banking union project, which unifies the supervision and procedures for solving the crisis at the European level. Emphasis is placed on the newly adopted Single resolution mechanism. Since the adopted legislation does not apply exclusively to the Eurozone countries the second part of the thesis analyses the implementation of the BRRD into Czech law, and the related amendments concerning the Czech banking sector. The aim of the thesis is to analyse the crisis resolving procedure, which is specified in the third chapter on the example of a fictitious bank. The example monitors tools and measures that can be used in various life stages of a bank. It is mainly based on the rules laid down in BRRD and the Czech legislation ZOPRK.

Thesis pursue defining of substance of financial markets, it is explaining conditions of monetary policy and giving a report on regulation and supervision. Thesis is introducing pillars of concept for integration of financial markets in outline also.
