The Politics of Marijuana Legalisation in a Comparative Perspective

This work focus on the issue of potential legalisation of marijuana for recreational use in Czech Republic in comparison with different experiences from two, foreign states of the European Union - Netherlands and Spain. The work begins with a description of a historical context of cannabis use that is subsequently followed by historic and actual state of legislation in Czech Republic. The chapter regarding the situation in Czech Republic is furthermore composed of different opinions of relevant political parties, experts and public opinion polls. The second part is addressing the historical process and actual state of legalisation in Netherlands and Spain that is afterwards also accompanied by the opinions of political parties, experts and public opinion polls, which are focused on actual problems considering the specific type of legalisation in both countries. This chapter is followed-up by a comparison of the Spanish and Dutch model of legalisation and by general summarization of different political and expert opinions across the chosen countries accompanied by the information from the public opinion polls. Paid sex in Czech Republic - how to solve it by legislation?

Diploma thesis "Paid sex in Czech republic - how to solve it by legislation?" deals with prostitution and the way it is considered by law. In this thesis I first focus on defining the subject by describing different types of prostitution and associated legislative attitudes both in Czech republic and abroad, which makes me understand the complexity of this issue and vast area that is influenced by it. Regarding this I also analyze the stakeholders platform realizing that various groups connected to this subject consider the key problem about prostitution being in different areas and they also demand diverse solutions. My other conclusion is that regarding legislation associated to prostitution we can find a crucial lack of proper cooperation with non governmental organizations that have the closest relationship with sex-workers. This could cause the legislation being disconnected from the reality and not being able to implement its key objectives. In the second part of analysis I focus on analyzing the variety of legislation attitudes towards prostitution - abolition, decriminalization and legalization and evaluate these alternatives by set of criteria regarding technical feasibility, economic possibility, political viability and administrative operability. In the last decade, however, more and more states are moving from restrictive drug policy to milder forms of drug regulation, including their partial legalization. This master's thesis is one of the first Czech studies that comprehensively deals with the prohibition and legalization of drugs from the perspective of law and economics. The main aim of this thesis is to analyze selected economic and legal aspects of current drug prohibition and possible legalization of drugs. Several methods have been used to achieve this objective, with the greatest emphasis being placed on the demand-supply analysis of the drug market, which is present in the economic part of this thesis. This analysis makes it possible to understand how drug market is affected by state interventions, why these interventions often fail or identify benefits of drug legalization. Criminological aspects of drug-related crime Abstract This master`s thesis deals with a number of criminological aspects and issues related to drug-related criminality, in particular with legislation that takes into account the specific impact of selected drugs. In this context the thesis analyzes the drugs` impact on secondary drug-related crime, the death rate and health of their users and additional negative social and economic consequences related to such drugs. Following the evaluation of these harmful effects the thesis proposes potential changes to policy on such drugs and compares it to policies of foreign countries on individual drugs. These changes consist of various proposals including the decriminalization or legalization of certain means of handling of individual drugs. The thesis also examines national legislation currently in force related to selected individual drugs. Its conclusions are reached through a variety of researches and statistical data. The thesis consists of eight chapters which are preceded by a brief introduction to the selected topic. The first chapter lays out basic terminology used in this thesis. The second chapter deals with historical cases of drug policies such as the Chinese policy on opium in 19th and 20th century or the prohibition in the United States between 1920...
Marijuana Regulation in Colombia and Uruguay: A Comparative Policy Analysis

This study uses a Comparative Policy Analysis (CPA) between Colombia and Uruguay using the common analytical framework created by Rogeberg, Bergsvik, Phillips, Amsterdam, Eastwood, Henderson and Nutt (2018) where it can be described, assessed and discussed policy regimes. First, it describes the development of the drug policy towards the marijuana use in Latin-American countries, and secondly, each country is classified according to the characteristics of the Policy Regimes: a) Absolute prohibition regime, b) decriminalization, c) State control, and d) free market. Besides, each country is evaluated according to the seven clusters designed in the common analytical framework. Tomiczek, J. Proposal for Taxation of Legalized Trade of Marijuana in the Czech Republic. Thesis. Brno: Mendelu in Brno, 2019. The thesis deals with the legalization of marijuana trade and consumption in the Czech Republic. The aim of the thesis is to propose a method of taxation of marijuana trade in the Czech Republic. First, the situation of the states that allowed marijuana trade is described. Then international conventions on cannabis, models for marijuana trade, effective tax collection and tax evasion are presented. Thereafter, the costs associated with the legalization of marijuana are estimated and then the excise duty rate is proposed with an estimate of income. Part of the thesis is the rejection or non-rejection of the hypothesis that the legaliza-tion of the marijuana trade is advantageous from the tax point of view.
Czech and Polish legal regulation of criminal liability for drug offenses

The dissertation thesis about Czech and Polish legislation on drug offenses deals with driving under the influence of addictive substances, responsibility for acts committed under the influence of addictive substances, drug possession, cannabis cultivation, production and distribution of drugs, handling of articles for drug production and spreading drug addiction. The aim of this work is to bring a critical view of the current Czech legislation on drug offenses and related issues and then to present specific legislative proposals based on comparison with Polish law. The thesis analyzes the Polish and Czech legal regulations of drug offenses and brings a comparison of the facts of the aforementioned crimes and specific case studies. The work is based on legal regulations and case law of both countries, practical knowledge and also available statistical data. The thesis deals with the legalization of drugs comprehensively, including the arguments for and against legalization, wich are used in the Czech Republic and Poland. It addresses the legalization of cannabis on the example of Holland, the USA and Uruguay, as well as the availability of hard drugs in substitution programs in the Czech Republic and Poland.
