Particle Polymer Composite in structural details of the building envelope
Dostálová, Darina ; Lavický, Miloš (referee) ; Vokoun,, David (referee) ; Matějka, Libor (advisor)
Due to a European energy concept for reducing energy consumption and also the concept of sustainable development, there is a growing demand for reduced energy consumption during the operation of the building and hence increasing demands on the thermal and mechanical properties of the building envelope. For this reason, it is necessary to look for materials that could meet both thermal and mechanical properties, as well as mechanical resistance and loadability, especially for the application for the foundations of the house, the base of the house and for application to structural details for elimination of the thermal bridges between interior and exterior boundaries. The main motivation for choosing the topic of thesis was to find materials derived from recycled or secondary raw materials that would be suitable for manufacturing composite applicable for structural details in the envelope of the building and for insulating in humid environment. An economic and environmental aspect plays an important role in the choice of material. The main theme of the thesis is the laboratory manufacturing of a composite with a thermoplastic matrix derived from recycled plastic materials and waste foam as a phase. Has been developed a unique Waste-based Particle Polymer Composite (WPPC) made from recycled foam and polypropylene. However, before WPPC can be reliably used by construction designers, physical properties of WPPC must be accurately identified. Therefore, it was designed laboratory manufacturing system and sample testing system, it was studied thermal, mechanical, thermomechanical and moisture absorptivity of WPPC. Application of finished composite material with satisfying thermal insulation properties to structural details to eliminate the thermal bridge, was the next step. These are details of the unloaded, prefabricated balconies, windows, atics, as well as basement constructions and the heel of the central load-bearing wall, the terrain flooring and the staircase wall

§ 189 zákona č. 40/2009 Sb. Trestní zákoník - pimping Abstrakt The diploma thesis is devoted to the crime of pimping under Section 189 of Act No. 40/2009 Coll. of the Criminal Code. The first part of the thesis defines the concept of prostitution, the reasons why prostitution is a sociopathological phenomenon and the different types of ways in which the legal systems react to prostitution. Subsequently, the historical development of the legal regulation of prostitution in the Czech Republic since the establishment of the Czechoslovak Republic is described. Then, the facts of the crime of pimping under the current legislation are analysed in detail, where the individual terms used in the basic facts of this crime and in its individual qualified facts are explained with the help of case law and doctrine. Furthermore, the possibilities of a single-act concurrence with other offences contained in the Criminal Code are discussed, namely with the offence of trafficking in human beings under Section 168 of the Criminal Code, the offence of rape under Section 185 of the Criminal Code, the offence of sexual coercion under Section 186 of the Criminal Code, the offence of enticement to sexual intercourse pursuant to Section 202 of the Criminal Code and the offence of endangering the upbringing of a child pursuant to...
The issue of cruelty and other inappropriate treatment of animals and their protection through criminal law
Průcha, David ; Bohuslav, Lukáš (advisor) ; Vokoun, Rudolf (referee)
The issue of cruelty and other inappropriate treatment of animals and their protection through criminal law This thesis is focused on the protection of animals against cruelty and other inappropriate treatment, and its securing through criminal law within the legal order of the Czech Republic. The aim of this work was to evaluate the current level of legislation concerning animal cruelty in the sense that it is possible, especially in criminal law, but also in administrative law, to effectively detect, sanction and prevent its recurrence in the future. The aim of this thesis was also to evaluate the changes in the protection of animals against cruelty, which occurred with the adoption of Act no. 114/2020 Coll., amending Act no. 40/2009 Coll., Penal Code, as amended, and some other laws. The content of this thesis consists of a total of 10 chapters, which are further divided into subchapters. Defining the basic terms, outlining the development of legislation on animal protection and animal Welfare in the world and in the Czech Republic, and insight into supranational legislation in the field of animal protection, both at the international level and at the level of the Council of Europe and the European Union, is the content of the first four chapters, which are not crucial for the purposes of this...
Appeals in criminal proceedings
Staněk, David ; Vokoun, Rudolf (advisor) ; Bohuslav, Lukáš (referee)
APPELS IN CRIMINAL PROCEEDINGS ABSTRACT The goal of this Diploma thesis is to analyse the legal regulation of appeals in criminal proceedings and the issue of this regular remedial measure in general. Author's goal is to present readers with the historical genesis of the institution of appeal since early feudalism until the adoption of current Criminal Procedure Code, considering the most important amendments of this law, and to put the intrastate legal regulation into the context of international law and embedment of the right of appeal in criminal proceedings in international treatises. The author also aims to explain appeal as regular remedial measure together with other remedial measures in Criminal Procedure Code and to introduce basic and specific principles, that impact the legal regulation. In the main chapter the recent regulation of appeals in Criminal Procedure Code is critically analysed. The author further deals with the admissibility and effects of the appeal, by all parties that are legitimate to appeal, the time limit, place and means of filling it, while listing practical examples of abnegation of the right to appeal to a higher court and withdrawal of the appeal, content requirements and possible problems in practice, the operation of the court of first instance after appealing, and also...
The concept and legal consequence of the excessive use of self-defence and necessity
Lenc, David ; Vokoun, Rudolf (advisor) ; Šámal, Pavel (referee)
1 Abstract THE CONCEPT AND LEGAL CONSEQUENCES OF THE TRANSGRESSION OF THE LIMITS OF SELF-DEFENCE AND NECESSITY As the name suggests, this Master's thesis examines the concept and legal consequences of transgression of the limits of self-defence and necessity. Self-defence and necessity, together with other circumstances excluding illegality, belong to the fundamentals of criminal liability. If all their conditions are fulfilled by some action, which would otherwise give raise to criminal liability, then these legal institutions exclude not only criminal liability, but also illegality of such action (i.e. such action is considered lawful). The purpose of the paper is to provide complex and understandable analysis of these two crucial legal institutions. The analysis is mainly focused on conditions of these legal institutions, which form their limits; determination of conditions which, if not met, constitute the transgression of the limits of self-defence or necessity, and content and cases of fulfilment or failure to fulfil these conditions. (Thus, the cases of the transgression of the limits of self-defence and necessity are examined.) After the analysis of such excesses, the thesis addresses specific issues connected with their legal consequences. The thesis is based on Czech legal regulation, namely the...
Collateral proceedings
Vincík, David ; Jelínek, Jiří (advisor) ; Vokoun, Rudolf (referee)
The presented thesis focuses on the topic of adhesive proceedings, ie on a specific part of criminal proceedings, in which the court decides on damages, non-material damage or the issuance of unjust enrichment. It is these negative consequences that may, and in many cases do, result from the commission of crime. This topic is therefore strongly related to the person of the injured party, as the injured party is entitled to damages, non-pecuniary damage and the issue of unjust enrichment, and it is the injured parties who assert these claims in the adhesive proceedings. Therefore, in its introductory part, the thesis deals with the injured party and their individual rights, especially the right of the injured party to claim damages in general. It further clarifies the difference between the injured party and the victim and also deals with the position of the injured party and the victim in international and European law. The next part of the thesis is completely focused on the issue of adhesive proceedings, notably on its importance and specifics, which clarifies some differences from the form of criminal proceedings, and also on subjects of adhesive proceedings, where it deals with both natural persons and legal entities. Furthermore, the thesis deals with particular substantive claims that can be...
Compression of ecaped titanium micro-pillars for two principal orientations
Vokoun, David ; Maňák, Jan ; Tesař, Karel ; Habr, Stanislav
The thermomechanical processing by equal-channel angular pressing (ECAP) is used for certain metals and alloys in order to make their structure fine and to increase material strength. In the previous study done at our institute, grade 2 titanium was successfully processed using four consecutive route A passes via a 90° ECAP die with high backpressure at room temperature. Orientation dependence of compressive and tensile loading of ECAPed titanium samples was demonstrated at macro-scale. However, scarce attention has been paid so far to the mechanical behavior of ECAPed titanium samples at micro-scale. In the present study, compression experiments on titanium micro-pillars, fabricated using focused ion beam, are carried out for two main directions in respect to preceding ECAP pressing (insert and extrusion directions). The purpose of this study is to discuss the orientation dependence of mechanical response during compression of the as-ECAPed titanium micro-pillars.
Crime preparation
Verner, David ; Vokoun, Rudolf (referee)
The master's thesis comprehensively deals with the issue of the preparation of a criminal offence and other disputable questions related with this stage in the commission of a criminal offence. The emphasis is mainly put on its definition in the Czech criminal law, taking account of relevant judicial decisions necessary to interpret the relatively brief statutory provisions. The aim of the thesis is to carry out critical evaluation of the current legislation sanctioning preparation, to identify questionable parts and potential shortcomings that may exist in the practice. On this basis I try to suggest solutions to the identified problems or at least to contribute to the discussion about them. The thesis is divided into five parts, the first generally puts the preparation into the criminal law system, describes its various forms, distinguishes it from the other stages in the commission of the criminal offence and briefly describes the historical development of its sanctioning on our territory. The second part focuses on the problematics of the impossible preparation and issues regarding its criminalization and punishing. The third part deals with a specific reason for extinction of criminal liability for the preparation, namely the voluntary refraining from further preparatory acts. The attention is...
