Workplace violence Abstract Herein presented thesis addresses the problem of workplace violence. The thesis focuses on physical and mental violence, with particular emphasis on bullying (mobbing). The thesis is divided into six main chapters. The aim of the first two chapters is to explain the nature of workplace violence, to draw attention to the danger of this pathological phenomenon and to point out the fact that workplace violence can be successfully prevented. The main objective of the thesis is to present, analyze and critically evaluate the existing legal means of protection against workplace violence. In the introductory chapters, the author presents and puts into context the results of national and foreign psychological research on the matter. Research findings suggest that bullying in the workplace could affect approximately one-fifth of Czech employees. The severity of the consequences of bullying can be fully comparable with PTSD from rape or war experiences. Current research suggests that harassment at work can be successfully prevented by creating safe work environment and working conditions. Notice of termination of employment served by employer for employee's health reasons Abstract The thesis deals with the topic of termination for health reasons, i.e., termination based on the causes contained in Section 52 (d) and (e) of the Czech Labour Code. The author's aim is not only to provide a comprehensive examination of the topic itself but also to provide an overview of the most important challenges associated with the termination grounds in question. This purpose is achieved in particular through a thorough analysis and comparison of the rich case law, which is absolutely crucial to the chosen topic and the rapid development of which has been subject to much critical reflection. The secondary aim is to outline possible solutions according to the designed law, both on the basis of professional literature cited in the thesis as well as the author's own conclusions. These suggestions are presented in a comprehensive way, especially in the final chapter of the thesis, but partial ideas can also be found throughout the whole work. Due to the key position of the medical statement in relation to the examined grounds for termination, the thesis also pays sufficient attention to this legal institute and its development over the years with regard to relevant decisions of higher courts. The bachelor's thesis refers to the official assignment of the management of the school Na Radosti in Žďár nad Sázavou. It is a democratic school where the teaching system is based on freedom of decision and non-archiving of individuals in the community. This school is now located in various locations in the city and needs a new quality space that meets current requirements and standards. The school with a capacity of about 100 pupils should create a pleasant space for teaching and support concentration. The demarcated plot of land directly encourages the direct connection of the school with nature, which is also required by the given system of teaching, as the teaching is also distributed to the outdoor areas.

Title of the thesis: Sport and labour law Abstract This thesis deals with the legal status of professional athletes in team sports in the Czech Republic and primarily focuses on the question of whether the activity of professional athletes in team sports is dependent work and whether the current practice, where contractual relations between sports clubs and players as self-employed persons are mostly other than labour relations, is long-applied and by the public authorities tolerated false self-employment (in Czech the so-called "švarcsystém"). The first chapter initially deals with the definition of sport and its division, as well as the functions that sport has in society. It also provides a brief explanation of sports law, its basic principles and, last but not least, an insight into the current state of the legal regulation of sport in the Czech Republic. The second chapter of the thesis describes the position and activities of some entities with a significant influence on the functioning of the sports sector with the ambition to provide at least a basic insight into the organizational structure and the daily operation of professional sport. Obligations of the employer in terms of occupational health and safety with focus on personal protective equipment Abstract The thesis deals with obligations of the employer in terms of occupational health and safety with focus on personal protective equipment. The main aim of the thesis is to analyse applicable legislation of occupational health and safety that was (and still is) under examination due to COVID-19 pandemic. Further goal is to analyse if the legislation is sufficient, unequivocal or if the pandemic showed some deficiencies which should be amended. The first part primarily introduces the issue of occupational health and safety in terms of labour code. It continues with analysis and summarization of individual obligations of an employer as well as rights and obligations of an employee. This section then also considers the legislation of occupational health and safety in relation to employment agencies and their employees. The second part contains European and domestic legislation of personal protective equipment and subsequent case law. Professional sport and its legislation I choose this topic for its currency and for in my opinion ignored need of solving problems mentioned in the thesis. In scope of this thesis I tried not only to assess legal status of individual and collective professional sportsmen or in other words of performance of their activity on professional level, but I also tried to solve chosen problematic points resulting from the confrontation of professional sport activity and strict provisions of Czech law (in particular Labour Code), by which the performance of sport activity and related legal relations are governed. Thesis is systematically divided into four chapters besides the introduction and conclusion which contains other subchapters. These subchapters specify topics contained in chapters. First chapter is the introduction to the topic devoted to reciprocal relation of sport and law. In this chapter I deal with the term "sport" and its possible definition from the law point of view and its basic organization and division in general. There is also one subchapter dedicated to act on support of sport. In second chapter I deal with the performance of sport activity by individual professional sportsman in detail and with two possible options of its inclusion into law. Zusammenfassung Das Thema dieser Diplomarbeit ist die Beendigung des Arbeitsverhältnisses - Vergleich der Rechtsregelung der Tschechischen Republik und die Bundesrepublik Deutschland. Die Arbeit gliedert sich in fünf Teile, die verschiedene Möglichkeiten der Beendigung des Arbeitsverhältnisses durch den tschechischen und deutschen Gesetzgebung behandelt, und befasst sich detailliert um einzelnen Kündigungsgründe in beiden Rechtsregelungen. Zwischen arbeitsrechtliche Rechtsregelungen beiden Nachbarländern, der Tschechischen Republik und der Bundesrepublik Deutschland gibt es auf einer Seite erhebliche Unterschiede, die sich aus wesentlichen Teil aus der unterschiedlichen rechtlichen und historischen Entwicklung ergeben. Abrégé Cette memoire a pour le but la présentation de la demission et le licenciement dans le droit du travail français et la comparaison de ceux-ci avec le droit du travail tchèque. La partie préliminaire présente en bref le code du travail français et explique aussi le statut du salarié et de l'employeur dans le droit français et mentionne des problèmes qui s'attachent à cette problématique. La partie préliminaire, qui parle du caractère élémentaire de la relation de travail est suivie par la seconde partie, la partie principale, qui disserte sur des conditions dans lesquelles la relation de travail peut être rompue dans le droit français et compare leurs différences avec le droit tchèque. Problematic Aspects of Personal Data Protection

The thesis consists of five chapters, introduction and conclusion. The author of the thesis deals with introduction to the problematics of personal data protection and its relevance in the contemporary world in the introduction of the diploma thesis as well as with demarcation of the aims of the work. In the first chapter, the basic sources of legislation in the area of personal data protection are demarcated, both in Czech and in European and international level. In the second chapter, the attention is paid to the basics of the legislation in the area of personal data protection, whereas the author deals with demarcation of basic concepts, in the second subchapter she gives an overview of basic principles of personal data processing and in the third subchapter she summarizes legal titles for personal data processing. The institute of Data Protection Officer within the meaning of General Regulation is analysed in the third chapter. 1 Resumé Personal data protection in employment formation This thesis is concerned with the questions of personal data protection in connection with labor-law relationships. In the concrete the author focuses on personal data protection in formation of the employment. First the author deals with general legal basis of the issue and, consequently, the author analyses personal data protection in positive law, namely in the Act No. 101/2000 Coll., on the Protection of Personal Data, as amended. The author examines in detail some questionable duties of the employer connected with processing of personal data of his employees and, at the same time, refers to the imperfection of transposition of the Directive 95/46/ES of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of these data. On the basis of given comments the author in the general level presents the scope of personal data that can be requested by the employer from the employee in formation of the employment.
