Community property of spouses with a focus on its termination and settlement

The aim of this work is not only draw attention to current legislation in the field of marital property, with an emphasis on its dissolution and property settlement in the light of current case law. The work also deals with the changes that this issue brings into re-codification of civil law. It also includes a comparison with the legislation in Germany, with whom we are linked by a certain portion of the historical development. All work is completed with current case law.
Selected Problems of Maintenance with Particular Focus on Good Morals

The diploma thesis, Selected Problems of Maintenance with Particular Focus on Good Morals, deals with legal matters of maintenance mainly in connection to the aspect of good morals (boni mores) which represents the principal of equity and is the moral extension of legal provisions under the law of the Czech Republic. The purpose of the thesis is to identify the most frequent issues that are being dealt with and describe their legal solution in accordance with the legislation valid and effective till the end of 2013 and under the new legislation after the recodification of the Czech civil law, effective from the 1st of January 2014. The doctrine of boni mores and legal provisions regarding maintenance have both met some changes in terms of interpretation and application since the recodification. Maintenance and good morals are researched together, they are researched one in connection to the other one, in this diploma thesis because the previous legislation established a special linkage between them which resulted in a considerable amount of case law that needs to be revisited. Titles to inheritance

This diploma thesis is focused on titles to inheritance. The aim of the thesis is to capture their course in the Czech Republic. This thesis is systematically divided into seven chapters. The first one is the introduction, in which the author justifies chosen topic. The second chapter is focused on development of inheritance law. Following chapters are focused on titles to inheritance. Each chapter is divided into several parts. These parts are lined up chronologically. Titles to inheritance are lined up in order to their legal force in recent legislation. At first the author is focused on inheritance contract in the third charter. Before ObčZ 2012, inheritance contract was in legal force at least more than 60 years ago and it returns by ObčZ 2012 to our legal system. The fourth chapter is focused on testament. At its first part there is a brief view into ABGB. In the following part narrowing of legislation under the influence of so called Legal Biennial is visible. The chapter ends with a view into the ObčZ 2012, which is strikingly similar to provisions of ABGB. The fifth chapter deals with intestacy. Zusammenfassung Diese Diplomarbeit behandelt das traditionelle römischrechtliche Institut der Ersitzung und dessen heutige Regelung im tschechischen und deutschen Recht. Der Schwerpunkt liegt in den unterschiedlichen ideologischen Auffassungen beider Regelungen desselben Rechtsinstituts und dessen Wurzeln im römischen Recht. Für die tschechische Rechtsregelung und Rechtswissenschaft bildet das gültige österreichische bürgerliche Gesetzbuch ABGB, das bis zum Jahre 1950 der tschechoslowakische Zivilkodex war, die wichtigste Inspirationsquelle. Deswegen wird auch dem österreichischen ABGB beträchtlicher Raum gegeben. Das Hauptziel dieser Arbeit ist der Vergleich der unterschiedlichen Wertungsauffassungen in der deutschen und tschechischen Rechtswissenschaft, die die Voraussetzungen und Rechtsfolgen der Ersitzung auf vielen Ebenen beeinflussen. Easements with respect to New Civil Code provisions

Easements with respect to New Civil Code provisions Abstract In this thesis, I concentrate on the institute of easements, which are rights to use the real property of another. I study easements from both the theoretical perspective, with respect to their position in the legal system, legal relations and their corresponding implications and the function they fulfill; and the practical perspective, elaborating on their establishment, changes, termination, recordkeeping and protection of the rights they imply. I consistently strive to map all the legislation related to easements, and present the changes that will affect the legal code of the Czech Republic with regards to the ongoing re-codification of private law. These changes affect the context of current legislation related to easements and its interpretation, consisting mainly of court rulings. In the new Civil Code which will come into force at the start of 2014, as opposed to the current Civil Code, legislation related to easements is approached from a very wide perspective, almost casuistically. However, at the time of this thesis's completion, related regulations necessary for proper application of the new Civil Code have not yet been approved.
Protection of personal rights with special focus on right to health

This thesis called "Protection of Personal Rights with Special Focus on Right to Health" deals with a specific part of the area of personal rights, which protects core values, expecially life, health and other human rights. We can find the legislation dealing with protection of personality in regulations of various legal force. This thesis specializes in the analysis of civil law and special regulations, especially the expanding area of medical law. The thesis highlights the dynamic development of the protection of personal rights in the Czech law, especially the expansion of rights and obligations of patients and healthcare staff in connection with the recent recodification of private law. Nowadays there are a lot of specific legal and illegal interventions to someone's personal rights. The thesis analyzes various methods of protection against this specific illegal interference related to historical consequences and the thesis also contains some ideas, how to change the legislation for the future. It also includes a brief analysis of Czech and foreign judicature, which can help with understanding the comprehensive questions in the area of protection of personal rights.
Compensation for non-pecuniar damage caused by the excessive lenght of legal proceedings in Czech law

This thesis deals with the right consequences of violating the right of every participant of judicial proceeding, that in court proceedings on consideration of their cases within a reasonable time and without undue delay. In case of violation of the rights of the formation of the State's liability for harm suffered as a result of maladministration consisting in the excessive length of judicial proceedings. Thesis focuses mainly non-pecuniary damages incurred as a result of maladministration consisting in the excessive length of the proceedings and the forms of compensation, which allows Czech legal order. The lenght of civil proceedings may be considered excessive in case the lenght does not respond to the complexity of the case and its significance for the participants, even if there are no delays in court actions. There is a strong but reputtable presumption that excessively long proceedings causes non-pecuniary damage. Several types of remedy may redress the violation appropriately. The first form of satisfaction is so called pronouncement of excessivelly long proceedings. The pronouncement constitues the basic form of satisfaction. The thesis is focused on institute called right to build and other possibilities to build on somebody else's land in accordance with Civil Code effective since 1. 1. 2014. It also defines important terms connected to the right to build, its history on Czech territory and its foreign form which can be used as source of inspiration for future practice. Part of the thesis deals with unauthorized structures on somebody else's land which are built on the land without a legal reason.
Legal consequences of purchase agreement compared with French legal regulation

Abrégé Cette mémoire est consacrée à la problématique des effets du contrat de vente. Son but est de décrire la législation tchèque et française et de souligner les différences les plus importantes entre elles. La mémoire est divisé en 5 chapitres qui sont encore divisés en souschapitres. Dans l'introduction il est évalué le rôle du phénomène mondiale qui est imputable au contrat de vente. Il est aussi souligné la nécessité de sa réglementation dans les systèmes juridiques différents. En plus, il y a la question de l'intérêt a la comparaison de ces deux législations. Dans le premier chapitre on peut trouver la déscription du premier effet du contrat qui a été mentionné dans cette mémoire - le transfert de propriété. D'abord il faut s'y concentrer a la réglementation du transfert dans la loi et puis aux aménagements des parties dans le contrat qui peuvent modifier ou exclure la réglementation légale du transfert de propriété. Le deuxième chapitre est dédié au transfert des risques sur la chose et son relation avec le transfert de propriété. Purchase of a business undertaking for the purposes of s 502 (private medical practice)

- RESUME This work is concentrated on issue of purchase of medical practices which in this market period gains the importence. Even though today there is bigger and bigger demand for this transaction, legislation is not very well adapted to that. Medical practice can be perceived as undertaking pursuant to § 502 civil code. Because of that, it is possible to sell it (besides other ways) based on legal title business purchase contract pursuant to § 2175 civil code. Legal title business purchase contract is in practice used often, nevertheless whole process of purchase of medical practice based on legal title business purchase contract is not smooth. I would like to highlight the problems which can emerge. It is possible to divide this work into two parts. The first part deals with legal definitions and legal analysis of basic legal terms as undertaking, medical practice, provider of medical assistance services. We can find here also justification why it is possible to perceive medical practice as undertaking. The second part is focused on business purchase contract in general with specifics, which can arise in case of purchase of medical practice based on legal title business purchase contract.
