Banking contracts
Füleová, Adriana ; Liška, Petr (advisor) ; Elek, Štefan (referee)
Resumé - Bank Contracts Bank Contracts are an integral part of our everyday lives. Citizen and bussines entities used bank contracts very often. Despite this fact we can't find legal definition in the Czech law. Banking contracts understand contracts that are signed by banks in their business activities and obligations under these contracts arise. While the banking contracts have been widely used, in Czech law there is not too much literature and judgements abou this issue. Lack of legislation, however, can often lead to real life problems in implementing the obligations under those contracts. The purpose of my thesis is to analyse current legislation of bank contracts contained in Commercial Code (Act No. 513/1991). The thesis is composed of three main parts. First part is introductory and defines basic terminology used in the thesis. First part is consisting of four chapters. In first chapter I am trying to explain, what bank contracts are. Banks often exploit their stronger position as a contracting party and enter into contract, which we call adhesion contract. In second chapter I am trying to explain what adhesion contract is. Then in third chapter I focus on general business conditions and in last chapter I focus on consumer protection legislation in connection with the implementation of the laws of...

Eliášová, Petra ; Pauknerová, Monika (advisor) ; Brodec, Jan (referee)
RESUMÉ (SUMMARY) International civil procedural law in EU - selected issues focusing on jurisdiction according to the Council Regulation (EC) No 44/2001, Brussels I This thesis deals with the jurisdiction according to the Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters, so-called Brussels I Regulation. The reason why I have chosen this topic is that in my opinion the knowledge in this subject is at the present time very important for the practice of every lawyer in the European Union, because the rules of the Brussels I Regulation regulating which courts have jurisdiction in legal disputes of a civil or commercial nature between individuals resident in different member states of the European Union are valid and directly applicable in all Member States. The main purpose of this thesis is to determine particular rules of jurisdiction and their interrelations and to describe in detail the rules of special jurisdiction according to articles 5,6 and 7 of the Brussels I Regulation, above all on the strength of the judicature of the European Court of Justice. The introductory part of the thesis defines basic conceptions of International civil procedural law and its history in EU, sources of law in the Czech...

Kočí, Martin ; Červenková, Denisa (advisor) ; Bouma, David (referee)
The Trinitarian Perspectives of the Theology of Religions. The Outline of the Approache to the Non-christian Religions in Gavin D'Costa. This thesis presents an analysis of the theological work of British Catholic theologian Gavin D'Costa in the field of theology of religions. The goal of this study is the presentation of D'Costa's huge contribution to the theology of religions and critical examination of his constructive theological concept of Trinitarian Theology of Religions. In the first chapter we provide an introduction to the thought of Gavin D'Costa. We point out his philosophical and theological presuppositions, we go through his most important books and above all we introduce preliminary remarks about his theology of religions, i.e. conception of the relationship between systematic theology, theology of religions and religious studies and the notion of religion in D'Costa. The second chapter classifies D'Costa's approach within the context of contemporary theology of religions. We deal with D'Costa's critique of pluralism, inclusivism and exclusivism. Especially, the D'Costa's polemic with his former teacher John Hick is at the centre of our attention. In the third chapter we consider D'Costa's own paradigm of theology of religion which is based on the Trinitarian faith as well as respectful...

Sládková, Jana ; Vrzáček, Petr (advisor) ; Buda, Otakar (referee)
In 2009, the faculty hospital Motol acquired a certificate of accreditation SAK ČR. In fact it means that our hospital accomplished requirements of accreditation enquiry, accepted all standards of SAK ČR and this way it became one of several medical facilities in the Czech Republic, which are allowed to use this certificate of quality. By this accreditation, these facilities bound themselves to improve continually all-round care of their patients, medical background and to minimalize all hazards for patients and working staff. This graduation thesis is the guide through the whole accreditation process in the biggest medical facility in the Czech Republic. It goes through all phases of this complicated process from the preparation of the hospital through the before accreditation counsel, the correction of imperfections and shortfalls and the final comparison of the results before and after the accreditation. This work aims to become a small manual for other medical facilities trying to get the accreditation because it brings the whole process of the accreditation from the view of its author. It deals with the particular problems on workplace, not just from the point of view of an observer but from the position of a person incorporated in the process thanks to my position of the head-nurse, which...
Structure and dynamics of shell sources in general relativity
Turnovec, Aleš ; Žofka, Martin (advisor) ; Langer, Jiří (referee)
Cylindrically symmetric shell sources are studied and a general form of induced energy-momentum tensor of a collapsing shell is presented. The actual movement of the shell is numerically solved for a case when dynamics of the system is determined by energy conservation per unit length. It is then shown that additional assumptions can prevent the collapse, e. g. induced energy-momentum tensor as perfect fluid or null dust of counter-rotating particles. Collapse can be prevented also by introducing Thorne's C-energy into the system.

Resolution of Road Traffic Delicts in Theory and Practice
Žabenský, Martin ; Vopálka, Vladimír (advisor) ; Staša, Josef (referee)
Resolution of Road Traffic Offences in Theory and Practice The aim of my thesis is to analyze current situation in the Czech Republic in the field of road traffic offences resolution. The reason why I have chosen this topic is the fact that road traffic offences are an illegal conduct that you are very likely to come across every day, and, despite this fact, there is not much literature about it. Most road traffic offences are committed by a motor vehicle driver. In the Czech Republic, there are about 6.5 million driving license holders, i.e. almost two thirds of the Czech population. In my thesis I have focused on offences which are specified in section 22 of the Administrative Offences Act (No. 200/1990 Coll.), i.e. offences that are directly related to driver's behaviour on the road and which are very often capable of causing a traffic accident. The thesis is divided into six chapters, starting with a short introduction in Chapter One. Chapter Two introduces the principal sources of road traffic offences law. Chapter Three briefly explains which public authorities are involved in the resolution of road traffic offences. Chapter Four is the most important part of the thesis; in its nine sub-chapters it describes the entire procedure of road traffic offences resolution. First, it points out the...
Consumer protection under administrative law
Bohůnková, Kateřina ; Staša, Josef (advisor) ; Vopálka, Vladimír (referee)
Resume The subject of the thesis is consumer protection from the viewpoint of administrative law. The introduction of the thesis is devoted to the definition of the consumer relationship as well as the term of the consumer and the service provider that are the key entities of the aforementioned relationship. It is necessary to say that not only public but also private legal regulations are applicable to consumer protection. For this reason, comparison between public and private law is valid in the wording of the thesis. In addition, the thesis defines reasons for the necessity of public regulation with respect to this area and points to the fact that there is inequality in the consumer relationship by means of at least a brief specification of means and types of legal protection sufficient for the respective explanations. The institutional provision of public protection of the consumer is covered in an independent chapter where I focused in more detail on the Czech Trade Inspection Authority and the trade offices, namely due to the fact that the second part of my thesis covers the public duties supervised and possibly sanctioned by the aforementioned bodies of the state administration. Subsequently, I provided a list of fundamental legal regulations regulating consumer protection as such. The list is not at...
